Principal uses permitted subject to special conditions. 24 25 The following additional uses shall be permitted, subject to the standards specified for all special 26 condition uses as set forth in section 64.300(c). All principal uses permitted subject to special conditions 27 shall be reviewed and approved by the planning commission. 28 29 (1) All uses as permitted and regulated in the B-1 Local Business District under principal uses 30 permitted subject to special conditions. 31 32 (2) Open air uses within a planned shopping center as follows: 33 34 a. Retail sales of plants not grown on the site, lawn furniture, playground equipment, 35 and garden supplies; provided, further, that such use shall be located at the end or 36 rear of the building. 37 38 b. Recreational space providing children's amusement park and other similar recreation 39 when part of a planned shopping center development; provided, further, that such use 1 � �- 1�a� 40 be located at the end or rear of the building but not at the intersection of two (2) 41 major thoroughfares. Such recreation space shall be fenced on all sides with a four- 42 foot chain-link-type fence or similar fence with suitable gate and safety features. 43 44 c. No such use shall lessen or impinge upon the off-street parking area or the off-street 45 loading area, nor impair the system of pedestrian access or flow. 46 47 (3) Bowling alley, billiard hall, indoor archery range, indoor tennis courts, racquet ball and hand 48 ball courts, dance hall, electronic game room, indoor skating rink, or similar forms of indoor 49 commercial recreation when located at least one hundred (100) feet from any front, rear or 50 side yard of any residential lot in an adjacent residential district measured from the closest 51 point of the building in which the use is located to the closest residential property line. 52 53 (4) Planned shopping center. 54 55 (5) Fully enclosed automobile sales or service centers, when developed as part of a planned 56 shopping center. 57 58 (6) Auto convenience markets, auto service stations and auto specialty stores subject to the 59 following conditions: 60 61 a. The construction and maintenance of all driveways, curbs, sidewalks, pump islands or 62 other facilities used in conjunction with the operation of the auto service station shall 63 be in accordance with current city specifications. Such specifications shall be 64 developed by the city planning coordinator, traffic engineer and city fire marshal, and 65 shall be approved by the planning commission, and filed with the city clerk. 66 67 b. A ten-foot buffer area with screen planting and an obscuring wall or fence shall be 68 required along any property line adjoining an existing resident or adjoining vacant 69 land zoned for residential use. 70 71 c. The minimum lot area shall be fifteen thousand (15,000) square feet, and so arranged 72 that ample space is available for motor vehicles which are required to wait. At the same time, the Council adopted an interim ordinance prohibiting the establishment of pawn shops at new locations until the study was completed and any needed amendments adopted by the City Council. On June 28, 1996, the Planning Commission held a public hearing on proposed pawn shop zoning amendments, and after accepting revisions from its Zoning Committee, recommended their approval on July 26th. The Commission's resolution is attached. The proposed amendments make pawn shops that conduct business entirely within a building special condition uses in B-2, B-3, B-2C, RCC-1, and I-1 districts and permitted uses in B-4, B-5, and I-2 districts. Pawn shops that display pawned property outdoors, such as cars, will be special condition uses in B-3 and I-1 districts and permitted uses in I-2 districts. By late 1994 there were 11 pawn shops in the City and 5 of these had been established during the year. With the sharp rise in the number of pawn shops and pawned articles the Police Department was inundated with 3,000 paper records of pawn transactions a month. This large amount of paper records rendered the investigation of potentially stolen property at pawn shop unmanageable. The Office of License, Inspection and Environmental Protection is revising the pawn shop license regulations so that an electronic record system is added to the paper record system. Each pawn shop will be required to install a computerized system by which information concerning the pawn transaction will be sent to the Police Department each day. The information will include name, residence, description, and picture of the person pawning the property; description of the property pawned; and pictures of the property if it has no serial number. With the pawn information in electronic form and using search and sort methods, it will be much easier, faster, and less costly to look for and recover stolen property. The electronic record system, called "automated pawn system", has been developed by Minneapolis. Since the electronic records of pawned property for both cities will be available to Minneapolis and �aint Paul police departments, this will potentially help increase the recovery rate. � ' � i � �� (0a-� PROPOSED AMENDMENT The 11 pawn shops are located throughout the City. Map 1 shows their location and Table 1 shows that they are located in B-2, B-3, B-4, and B-5 zoning districts. Staff recommends that pawn shops which conduct business within a building be first allowed as a permitted use in B-2 districts. This type of pawn shop most resembles a combination general retail store and loan office: The B-2 district is the first district where the sale of all types of inerchandise is allowed. Currency exchanges are first permitted in B-2 districts and almost all banks are located in B-2 or less restrictive districts. Staff recommends that pawn shops that display pawned property outdoors, such as cars, trucks, or boats, be first permitted as a special condition use in B-3 districts. This type of pawn shop will be treated the same as used car lots and must also meet the site conditions of used car lots. One existing pawn shop is this type of pawn shop - Twin City Auto Pawn. Staff recommends that pawn shops whose business is conducted within a building provide parking at he same rate as do "retail stores in general" and that pawn shops with outdoor sales space provide parking at the same rate as used automobile sales. B-2 Community Business District. Sec. 60.532. Principal uses permitted. In a B-2 Community Business District the use of land, the location and erection of new buildings or structures, and the alteration, enlargement and moving of existing buildings or structures from other locations or districts shall conform to the following specified uses unless otherwise provided in this code: (1) All principal uses as permitted and as regulated in a B-1 District. Theaters, assembly halls, auction halls, bingo halls, concert halls, reception halls or similar places of assembly when conducted completely within enclosed buildings. f. Business schools, nonacademic colleges or trade schools operated for profit. g. Colleges, universities, and seminaries, and other such institutions of higher learning, public and private, offering courses in general, technical, or religious education and not operated for profit; provided, that: 1. Dormitories or other group student housing shall not be permitted within the district; 2. When an institution is established in the district, the institution shall be required to provide the minimum number of off-street parking spaees for employees, staff, or students as set forth in section 62.103(g). The institution shall be required to provide additional parking spaces only when the minirnum number of parking spaces will have to be increased due to a more than ten (10) percent or three hundred (300) gain in the total number of employees, staff or students, whichever is less. II. Chair's Announcements Steerin� Committee Report: - Steering Committee discussed when public hearings are held at the Commission level versus the Zoning Committee level. They decided that the current system works well: the Zoning Committee will be allocated the responsibility for public hearings on minor zoning text amendments; public hearings on 40-acre studies done through committees other than the Zoning Committee come to the full Commission and then are referred back to the committee; 40-acre studies done through the Zoning Committee are held at the Zoning Committee level unless Commission members feel, for some serious reasons, that it should be held at the full Commission level. - The new chair of the Capitol City Partnership, John Labosky, �vill be our guest at the July 26 Planning Commission meeting to discuss the roll of that partnership. - A reconnection is planned with the Minneapolis Planning Commission, perhaps in September. - The public hearing on the moratorium on metal shredders on the river �vas held Wednesday at the City Council. The vote will probably be taken next Wednesday, July 3, 1996. Michael Samuelson, Executive Director for the Thomas-Dale Planning Council, 369 University Ave, approached the podium first. He stated that their Land Use Committee met on June 10, 1996, to review the proposed amendment. The board met last night and recommends that the City ought to restrict pawn shops to onl}' B-3, business community strips, and keep them off of neighborhood, commercial streets or B-2 districts like Dale or Rice Street, and have them located at least 100 feet from a residentially zoned land use. 2. Gary Unger, 1847 East Idaho, president of District 2, also spoke in opposition to pa�vn shops in residential neighborhoods. To him, a pawn shop suggests a deteriorating neighborhood. He said that a pawn shop and a second-hand je«�elry store has recently appeared on �Vhite Bear Avenue �vith no input from the neighborhood. He feels that the definition is too general; it might apply to a bank or a finance company. He asked staff in �vhat zone banks were allowed. Mr. Ryan answered they were allowed in B-1. He said that pawn shops would be first permitted in a B-2 district. Mr. Vaught added that he will vote against the motion. He believes tl�at essentially, these types of facilities are banks for people who can't deal with traditional banks, because 1) they don't own real properiy; or 2) the property they have is not attractive to a typical financial or lending institution. He stated tllat he continues to be troubled by the labeling of these institutions as "undesirable" when they, in fact, service a need of a substantial number of inembers of the community who are not serviced by other traditional lending institutions. He said that he really does not see a fundamental functional difference behveen these facilities and banks, except for their clientele and the financial position of their clientele. Since these types of establishments have more restrictive requirements than do banks, he will vote against the motion. Commissioner Kramer is concerned about the Planning Commission holding the public hearing open for public comment, and yet voting today whether or not to forward the resolution to the Mayor and the City Council. He thinks that this case needs to be referred back to the Zoning Committee. Commissioner Field agrees with Commissioner Kramer's observations and also in part, with Co►nmissioner Vaught's concern with the definition of a pawn shop. Typical uses first permitted are: mortuaries, auto sales in a building, business equipment sales and services, printing, wholesale establishments, limited manufacturing, motels, and hospitals. Staff recommends that pawn shops be permitted in B-2 districts because they most nearly meet the intent of that district ("serve the needs of a consumer population larger than that served by the" [B-1 districtJ "and is generally characterized by a cluster of establishments generating large volumes of vehicle and pedestrian traffic") and because they are similar to that district's first permitted uses of a retail business selling merchandise in a building and currency exchanges. Staff does not recommend that a 100 foot buffer be required from residential property or that they be special condition uses. Uses are designated special condition uses or have buffers generally because they can generate high amounts of traffic (gas stations, fast food restaurants) can potentialiy create unwelcome noise (dance halls), can generate large numbers of police calls (currency exchanges), or there is a desire to avoid area concentrations (adult uses, residential community facilities), or some other special circumstance. Staff is unaware of the purpose for a buffer or a special condition use permit. If pawn shops are first permitted in B-3 districts, then Midway Jewelry and Pawn and Viking Pawn brokers �vould become nonconforming uses. If there is also a 100 foot buffer required from residentially zoned property, then both Cash-N-Pawns, both Lincoln Pawns, JJ Jewelry and Pawn, and Twin City Auto Pawn would be nonconforming as to the buffer because they are within 100 feet of residential zoned property. Pawn Shop - 40 Acre Studv, Discussion of Public Testimonv Roger Ryan, Planning Division staff, reviewed the July 11, 1996 memorandum included in the packets regarding Pawn Shop Testimony, which was presented as the staff report. Staff recommended a new definition of Paw�n shop. "A place where money is loaned on security of personal property left in uawn and pledged as collateral for the loan and where such propertv mav be redeemed bv the seller in a fixed period of time or sold to the general public. Commissioner Kramer reported that he compared the proposed regulation with those of the City of Minneapolis, that Minneapolis requires a special condition use permit for pawn shops and first permit them in the Minneapolis equivalent of a B-3 zone. Kramer said he was not comfortable with permitting that Pawn Shops be located just anywhere in Saint Paul, and that Saint Paul should require a SCUP so that public hearings are held and neighborhoods are notified, and that opportunity exists for conditions to be put on permits. Commissioner Kramer moved an amendment to the staff recommendation, that pawn shops be required to be done through a special condition use permit. Commissioner Field seconded the motion. Mr. Ryan said that pawn shops will have no difficulty in meeting the four or five general conditions which will be required by a special condition use permit. Commissioner Kramer said he was specifically concerned with the ability to apply specific conditions for a specific pawn shop given neighbors' or business organizations' concerns, as specified on SCUPs for auto sales uses for example. Commissioners Field and Gurney expressed support for the motion. Field stating it would provide the committee with latitude to address unique situations, and with Gurney stating that a SCUP would not tie all pawn shops to specific regulations that may not need be applicable in every case. The motion accepting the amendment carried on a voice vote of 7 to 0. Commissioner Kramer said that in speaking with members of various business associations that there is an attitude that pawn shops poison the business climate of neighborhood business strips. Kramer suggested that pawn shops essentially double traffic in those locations as there is both redemption and sale of ine��chandise going on, and in that regard are a more intense use and should be located in B-3 zones. Commissioner Kramer moved that pawn shops be located in B-3 zones.
