1 WI�EREAS, Minnesota Laws of 2000, Chapter 492, Section 7, Subdivision 13 contains an
2 appropriation to the Metropolitan Council for Regional Pazks and Open Space development grants,
3 including a grant to the City of Saint Paul for the Como Pazk Education Resource Center Project, as set
4 forth below:
"Education Resource Center: $16,000,000.00
6 For a grant to the Metropolitan Council to complete construction of education, administration,
7 meeting, and visitor reception facilities at the Como Park Education Resource Center. As long as
8 state bonds issued for the Como Park campus are outstanding, admission to the zoo must be free."
9 and
10 WHEREAS, the City of Saint Paul by its City Council Resolution 00-1084 has agreed to accept said
11 appropriation and to comply with the requirements of the grant, and
12 WHEREAS, the State grant is to be provided to the City via an agreement with and administered by
13 the Metropolitan Council, said agreement to contain all terms and conditions required of the recipient by
14 both the State and the Metropolitan Council, and
15 WHEREAS, the Como Park Education Resource Center Project, as detailed and described in the
16 Predesign Manual prepared by the City as required under MN Statute 16B335, is anticipated to cost
17 $21,000,000.00, and
18 WHEREAS, the Como Zoo and Conservatory Society has pledged $5,000,000.00 toward the Como
19 Park Education Resource Center Project, to complete the necessary funding,
20 NOW THEREFORE BE IT RESOLVED, that the City of Saint Paul act as legal sponsor for the
21 Como Park Education Resource Center Project contained in the Laws of 2004, Chapter 492, Section 7,
22 Subdivision 13, and
23 FURTHER RE50LVED, that the City of Saint Paul has the legal authority to apply for financial
24 assistance, and the institutional, managerial, and fmancial capability to ensure full and adequate
25 construction, operation, maintenance and replacement of the Como Pazk Education Resource Center
26 Project for its functional life, and

30 FURTHER RESOLVED, that the Mayor and proper City officials of the City of Saint Paul are
31 hereby authorized to execute such agreements as aze necessary to implement the Project on behalf of the
32 City.
33 FURTHER RESOLVED, by the Council of the City of Saint Paul, upon recommendation of the
34 Mayor and positive advice of the Long Range Capital Tmprovement Budget Committee, that
35 $5,000,000.00 is available for appropriation in the 2000 Capital Improvement Budget, and said 2000
36 budget, as heretofore adopted and amended by the Council, is hereby further amended as follows:

52 FINALLY RESOLVED, upon execution of the grant agreement with the Metropolitan Council and a
53 reimbursement agreement with the Como Zoo and Conservatory Society, that the Division of Parks and
54 Recreation is hereby directed to proceed with the Como Park Education Resource Center Project in such
55 manner that the schedule for construction contract payments is consistent with the terms and conditions
56 of the grant agreement and the schedules for State and CZCS reimbursements to the City.

10 WHEREAS, the City of Saint Paul by its City Council Resolution 00-1084 has agreed to accept said
11 appropriation and to comply with the requirements of the grant, and
12 WHEREAS, the State grant is to be provided to the City via an agreement with and administered by
13 the Metropolitan Council, said agreement to contain all terms and conditions required of the recipient by
14 both the State and the Metropolitan Council, and
15 WHEREAS, the Como Park Education Resource Center Project, as detailed and described in the
16 Predesign Manual prepared by the City as required under MN Statute 16B335, is anticipated to cost
17 $21,000,000.00, and
18 WHEREAS, the Como Zoo and Conservatory Society has pledged $5,000,000.00 toward the Como
19 Park Education Resource Center Project, to complete the necessary funding,
20 NOW THEREFORE BE IT RESOLVED, that the City of Saint Paul act as legal sponsor for the
21 Como Park Education Resource Center Project contained in the Laws of 2004, Chapter 492, Section 7,
22 Subdivision 13, and
23 FURTHER RE50LVED, that the City of Saint Paul has the legal authority to apply for financial
24 assistance, and the institutional, managerial, and fmancial capability to ensure full and adequate
25 construction, operation, maintenance and replacement of the Como Pazk Education Resource Center
26 Project for its functional life, and

30 FURTHER RESOLVED, that the Mayor and proper City officials of the City of Saint Paul are
31 hereby authorized to execute such agreements as aze necessary to implement the Project on behalf of the

33 FURTHER RESOLVED, by the Council of the City of Saint Paul, upon recommendation of the
34 Mayor and positive advice of the Long Range Capital Tmprovement Budget Committee, that
35 $5,000,000.00 is available for appropriation in the 2000 Capital Improvement Budget, and said 2000
36 budget, as heretofore adopted and amended by the Council, is hereby further amended as follows:
