3 WHEREAS, the Council of the City of Saint Paul, upon the petition of the St.Paul Fire and Marine
4 Insurance Company(aka St.Paul Companies) as contained in Finance Department File No.14-1993 did,
5 by that resolution stated in Council File 93-1688, approve the petition to vacate and discontinue as
6 public property, the following property: Parcel Nos. 1, 2, 3, 4, 5 and 6 as described in E�ibit "A";

10 WHEREAS, errors were found in the legal desciption of said vacated property, Council File No.
11 93-1688, which would cause the legal description to be inaccurate ; and

14 WHEREAS,the petitioner and the Department of Public Works have requested that the legal desciption
15 for said vacation be corrected; NOW THEREFORE,

along the east line of said block 2, 13.50 feet to the point of beginning of the
property to be described; thence south 82 degrees 35 minutes 55 seconds east

north 82 degrees 35 minutes 55 seconds west 10.00 feet to the east line of said

This vacation shall be subject to the following conditions:
1. That this vacation shall be subject to the terms and conditions of Chapter 130,
codified March 1, 1981, of the Saint Paul Legislative Code as amended.

° - .- -- 2. That the petitioner, its successors and assigns shall pay $500. as an
administrative fee for this vacation which shall be paid within 60 days of the
publication date of this resolution.
3. That a permanent utility easement shall be retained within the area of ��-- ��7(-S
vacated West Sixth Street to protect the interests of U. S. West
Communications.
4. That a permanent utility easement shall be retained within the area of vacated
West Sixth Street to protect the interest of Northern States Power Company,
� Gas Division.
5. That a permanent utility easement shall be retained within the entire vacated
area as described above, to protect the interests of Norther States Power
Company, Electric Division.
6. That a permanent utility easement shall be retained within the area of vacated
West Sixth Street to protect the interests of District Energy Saint Paul, Inc.
and District Cooling Saint Paul, Inc.
7. That the petitioner, its successors, and assigns, by acceptance of the terms and
conditions of this resolution agree to indemnify, defend and save harmless the
City of Saint Paul, its officers, and employees from all suits, actions, or claims
of any character brought as a result of injuries or damages received or
sustained by any person, persons, or property on account of this vacation or
petitioner's use of this property, including but not limited to a claim brought
because of any act of omission, neglect, or misconduct of said petitioner or
because of any claims or liability arising from any violation of any law or
regulation made in accordance with the law, whether by the petitioner or any
of its agents or employees.
8. That the petitioner, its successors, and assigns, shall within 60 days of the
publication date of this resolution, file with the City Clerk and acceptance in
writing of the conditions of this resolution and shall within the period(s)
specified in the terms and conditions of this resolution, comply in all respects
with these terms and conditions.
