2 Whereas, under Section 5.02 of the City Charter, the City may, upon recommendation of the
3 City Attorney and in the case of special or unusual circumstances, appoint outside counsel to
4 represent the City;

6 Whereas, such special and unusual circumstances exist in the case of Alter Tradin�
7 Corporation v. Citv of Saint Paul due to the legal issues raised in this case and the availability
8 of City Attorney staff to represent the City on this matter; and

10 Whereas, the City Attorney has recommended the appointment of outside counsel in this
11 matter.

13 NOW, THEREFORE, BE IT RESOLVED BY THE SAINT PAUL CITY COUNCIL:

15 The law firm of Briggs and Morgan is appointed to represent the City in the matter of Alter
16 Tradin�Companv v. Citv of Saint Paul. The fees to be paid to the firm shall not exceed those
17 based on the standards set forth in Rule 1.5 of the Minnesota Rules of Lawyer Professional
18 Conduct.
