1 RESOLVED, that, upon execution and delivery of a release in full to the City of Saint Paul,
2 the proper City officers are hereby authorized and directed to pay from the Tort Liability
3 Fund, 09081-0511, to Diane Smith, the sum of$2,798.81 in full settlement of her claim for
4 damages sustained on September 23, 1996 as a result of an accident with a City-owned vehicle
5 at or near Dale and Burgess streets.

On September 26, 1996 a City of Saint Paul truck, driven by George Leach, proceeded to make "
a left turn at the intersection of Dale Street and Burgess Street, striking a 1991 Ford
Escort, owned and driven by Diane Smith. Ms. Smith was proceeding South on Dale Street and
had the right-of-way. As a result of the collision, Ms. Smith's vehicle sustaina� $3,109.79
in damage. I have reached a settlement with Ms. Smith in the amount of �2,798.81.
