She had previously received a variance to build the fence beyond the height requirement for a portion of the yard. It was her desire to construct the remainder of the fence to block the noise and the use of her yard as the adjoining property ran a day caze business which attracted additional kids from the neighborhood. She also had a dog which was antagonized by some of the kids from the day care and she did not want her dog to become aggressive and bite anyone. Gregory Johnson,LIEP, stated that the Legislative Code was quite cleaz on the height requirement for fences. He suggested that the owner could construct a non-obscured six foot fence to the front line of the property and would be allowed 42 inches of screening in the fence. Mr. Strathman stated that he did not believe the owner demonstrated an exceptional circumstance to grant the variance. Therefore, he denied the variance. 2177 Fairmount Avenue Daniel Capouch, property owner, appeared and stated that he was requesting a variance to disconnect the central rainleader on the roof of his house. The house had a flat roof which would cause water to stand on the roof without the central rainleader. He had obtained the opinion of a roofer as well as a plumber and both indicated to him that it was not their recommendation to disconnect the rainleader as it would not a11ow for proper water drainage from the roof. The plumber suggested that the only option for plumbing the rainleader out of the house would be to go through several rooms in the house and then out through the garage. The plumber did not recommend plumbing the drain out through the basement. The estimate he received for this project was $5,084. He indicated that he did have two scupper drains on the roof which drained onto the lawn. Pat Cahannes, Public Works, stated that he inspected the property and it was his opinion that additional scuppers could be added to the roof and the central drain could be blocked. It was his suggestion that an alterna.tive could be to plumb the drain out through the basement,however,he had not inspected the basement. Mr. Strathman granted a five year variance. 1401 Stanford Avenue Robert Kinne, property owner, appeared and stated that he was requesting a variance to disconnect the rainleader on the roof of his house. Three of the rainleaders had previously been disconnected,however,the rainleader on the northwest corner of the house was still connected and he did not believe it was feasible to disconnect this rainleader as it would dump water out over and onto the sidewalk. Steve Herbert, Public Works, stated that it was his opinion that the rainleader could be disconnected with a drain across the sidewalk and into his yard. Property Code Enforcement Meeting � `�` � a'� � October 1, 1996 Page - 2 - Mr. Strathman stated that the owner did not prove that disconnecting the rainleader would cause a hardship to the occupants of the property. He denied the variance. 1610 Rome Avenue Royal and Sally Orren,property owners, appeared and presented pictures of the property. Mr. Orren stated that the house had a flat roof with a center rainleader. They had added two additional exterior drains, however, it was not enough to handle draining all of the water off of the roof. They had consulted a roofer who recommended to them that it would not be feasible to disconnect the rainleader. Steve Herbert, Public Works, stated that he had inspected the roof and he believed that adding additional scuppers would be adequate to handle the water drainage from the roof. He also suggested that the owners could disconnect the drain internally by running it through the garage and down the driveway. Mrs. Orren stated that they had a problem with water draining into their garage from their neighbor's property and she believed that this would cause an even worse problem with water in their garage.
