Please take notice that a hearing concerning the above-named
establishment has been scheduled for 4 :30 p.m. , October 9, 1996 in
the City Council Chambers, Third Floor, Saint Paul City Hall and
Ramsey County Courthouse .
Enclosed are copies of the proposed resolution and other documents
which will be presented to the City Council for their
consideration. This is an uncontested hearing, in that the

We represent JMS Investments, Inc. in the above-referenced
matter. In response to your September 3, 1996 letter and our
subsequent telephone conversation, my client does not dispute the
facts as you have characterized them in your letter and, thus,
waives an evidentiary hearing before an administrative law judge.
My understanding is that this matter will now be presented
�ir�ctly to the �ity Cou::ci? srd that my c�ient wil? ha�e ar
opportunity to address the City Council on the issue of what
penalty is to be imposed. My understanding is also that this is
being treated as a first violation pursuant to the ordinances'
"penalty matrix" and, thus, the presumptive penalty in this case

Dear Mr. Riley:
I am in receipt of information that could lead to adverse action
against all your business licenses. The basis for the adverse
action is :
On � August 20, 1996, an under-aged persoa purchased 2
_ bottles of St. Ides Special Brew, an alcoholic beverage,
on the licensed premises. The� sale to an under-aged
- person was a violation of Section 409. 08 of the Saint
Paul Legislative Code, as well as of state law, Minn.
Stat. § 340A.503 (1994) .
If you don' t dispute that the above incident took place, this
matter will be scheduled before the St . Paul City Council for �a
hearing to determine what penalty, if any, to impose. You will be
allowed to speak on your behalf at that hearing. I will need a
letter from you saying that you do not dispute the facts, to
present this matter directly to the City Council .
On the other hand, if you wish to dispute the above facts, I will

schedule an evidentiary hearing before an Administrative Law Judge
(ALJ) . You will receive a "Notice of Hearing, " so you will know
when and where to appear, and what the basis for the hearing will
be.

hearing before the ALJ, and you may be held responsible for the
costs of the hearing if you do not then appear and contest the

- On the above date-and time I was working a vice detail concerning the sale of alcohol to minors
at local liquor stores. I was accompanied by a female decoy that was born on 6-6-76 giving l�er
an age of 20_vears_. I had asked for her ID on a previous detail a few weeks ago and learned the
above birth date._I iook a polaroid photo of her to document how she appeared this evening. I
was also accompanied by Ms. Kris Schweinler of LIEP.
We went to Marshal_Liquors at 1845 hrs.No.sale was made to the decoy.
� We then went to the Liquor Barrel at Lexington and University at 1900 hrs. A sale was made to
the decoy. _ __

I gave the decoy a twenty dollar bill serial number A56010G11D. She went inside not carrying
anything and i followed approx. 30 seconds later. She pulled two bottles out of a cooler and
went to the counter. She waited in line momentarily. The clerk, a WM heavy-set in a white T-

shirt waited on her. I observed her give him money. He then put the bottles in a brown paper
bag. She �eft the store and i followed a moment later.
I confirmed that the purchase was an alcoholic beverage. I was two 20 oz. Bottles of St. Ides
�pecial Brew maltbeverage 6.0 %alcohol by volume. �

t, along with Ms. Schweinler went back in to speak to the party that sold the beverage to the
' decoy. We identified ourselves. He was identified by Minnesota DL as FREITAG, DANIEL
U� D��1Y.5455 Adams Street Moundsview Minn. 55112. DOB 8-17-63. He was still behind the
counter waiting on two_other customers. After fhey left we confronted Mr. Freitag. He was yery
calm about what happened and cooperated. �
I recovered the same twenty dollar bill from the:till. It had the above listed serial number on it. z
Another employee,.Leo Carter BM approx. 30 yeazs wearing all dark clothing opened the till for �
me at my request after I showed him my badge that was hanging azound my neck on a necklace.
� I gave Mr. Carter back the $17.00 in change. And told Mr. Freita� that we were keeping the two �
bottles of St. Ides as evidence. 1-
The bottles of ST. Ides were later placed in PL # 34. �'`�
We checked Campus/Goldies at 2445 Como Ave. At 1930 hrs. No sale was made. �
We checked Tiffany Bar and Grille 2051 Ford Parkway. At 2015 hrs. No sale was made. �
