PRESENT ZONING: RM-2 ZONING CODE REFERENCE: 67.402; 67.406; 67.703 5. STAFF INVESTIGATION AND REPORT: DATE: August 20, 1996 BY: Mike Kraemer A. PURPOSE: To consider a preliminary plat to allow concept approval of the redevelopment of the old Riverview Hospital site into nine lots for a single family home development. B. SITE & AREA CONDITIONS: The lot is 105,010 square feet or 2.41 acres in area. The site is mostly flat and currently vacant except for an old masonry power plant building. The adjacent properties to the south, east and west are developed with residential uses. The bluff is located on the north boundary of the property with apartment uses below the bluff along Concord Street. The property is zoned RM-2 Medium Density, Low-Rise Multiple-Family Residential District. Single family homes as well as a multiple family apartment buildings are permitted uses at this site. C. BACKGROUND: The old Riverview Hospital occupied this site until it closed in 1980. The Neighborhood Development Alliance acquired the site in 1993 with plans for a residential development. The hospital was also demolished in 1993. The proposed subdivision will be divided into nine lots with 7 new single family homes to be constructed on the site. The Neighborhood Development Alliance will construct four single family homes on the lots along Prescott Street and estimates that each house with lot will sell between $140,000 and $165,000. Lot 5 along the bluff will remain vacant and used as open green space. Lots 1, 3, and 4 along the bluff will be sold to individuals for building of single family residences. The old power plant building located on lot 2 will remain and will be sold for the proposes of remodeling it into a single family home. The applicant also is requesting a modification of the requirement of a minimum 25' front yard setback for Lots 1-5, in Block 1. The bluff line adjoins the rear of these lots. The River Corridor Ordinance requires that structures maintain a minimum 40' setback from the bluff line. The applicant is requesting that the front yard setback be reduced to 15' . This modification will allow the houses to be moved away from the bluff and maintain at least a 40' setback from the bluff line. The proposed subdivision will also contain a 20' x 30' private access easement from proposed Mt. H�pe Drive to the bluff to allow an overlook view of the river valley from the bluff. A Site Plan Review of the project has been submitted and must be approved prior to construction of the residences on the site. Access to the garages on the alley will be made by an access easement agreement. This vacation request will be before the City Council at a later date. Approval of a preliminary plat does not constitute acceptance or approval of the subdivision by the City, but is deemed an expression of approval of the design shown on the preliminary plat drawing. The final plat must also be approved by the City Council. D. DISTRICT COUNCIL RECOMMENDATION: On March 14, 1996, the Westside Citizens Organization, District 3 Community Council board voted and recommended approval of the development of the site into single family homes. E. REOUIRED FINDINGS 1. All the applicable provisions of the Legislative Code are complied with. City staff have reviewed the proposed plat and determined that it meets all requirements and standards of the City. ' 2. The proposed subdivision will not be detrimental to the present and potential surrounding land uses. Single family homes are permitted uses and will be developed with uses compatible to the area. 3. The area surrounding the subdivision can be planned and developed in coordination and compatibility with the proposed subdivision. The surrounding area and the area of the proposed preliminary plat are developed and compatible with respect to land uses. 4. The subdivision is in conformance with the Comprehensive Plan. The property is in compliance with the comprehensive plan for this area of the city. 5. The subdivision preserves and incorporates the site's important existing natural features, whenever possible. Existing natural features have been preserved where possible in the plat. The applicant is requesting front yard setback modifications for the five building lots along the bluff to provide a minimum 40' buffer and preserve the bluff area at the rear of these lots. 6. A1l land intended for building sites can be used safely without endangering the residents by peril from floods, erosion, continuously high water table, severe soil conditions or other menace. The requested 10' front yard setback variance will allow at least a 40' setback from the bluff line i'n the rear of lots 1-5, Block 1 to maintain and protect the bluff line. The land can be safely developed. 7. The subdivision can be economically served with public facilities and services. aC- 1yy� Neighborhood Development Alliance Preliminary Plat Staff Report #96-095 August 20, 1996 Page Three The lots on Prescott Street currently have access to services and the lots on proposed Mount Hope Drive will have new services provided within the right-of-way. F. VARIANCE REQUIRED FINDINGS: (a) Sec. 67.703 of the zoning code allows the city council to grant a variance to the subdivision regulations when compliance would create an unusual hardship to the development of the land, based on f indings that: (1) The intent of this chapter is met; The applicant wishes to maintain at least a 40' minimum setback from the bluff as required and increase the building depth of the houses on these lots. Additional land cannot be purchased to increase the depth of the lots. Prescott Street and the bluff line restrict the subdivision depth. (2) The granting of the variance will not be detrimental to the public safety, health or welfare or injurious to other property or improvements in the neighborhood in which the property is located; Granting the front yard setback variance will allow at least a minimum 40' bluff line and even greater depending on the building design. Granting the variance will help preserve the bluff by maintaining a 40' setback and would likely not require a future River Corridor modification to build closer to the bluff. (3) The conditions upon which the request for a variance is based are unique to the property for which the variance is sought and are generally not applicable to other property; The bluff is an existing natural feature of the site. Since the bluff line adjoins the rear of the lots, a 40' minimum building setback is required. Houses is the area without the bluff line in the rear yard require only a 25' rear yard setback from the rear property line. (4) The literal interpretation of the provisions of this chapter would deprive the applicant of rights commonly enjoyed by other properties in the same zoning district; A single family home is a permitted use in the RM-2 residential zoning district with the required setbacks. The variance request for a 10' front yard setback will maintain at least the 40' rear yard minimum setback and still allow enough depth within the setback area for a new house. (5) The special conditions and circumstances do not result from the actions of the applicant; and The bluff is an existing natural feature of the property. (6) Because of the particular natural surroundings, shape or topographical conditions of the specific property involved, unusual hardship to the owner would result, as distinguished from a mere inconvenience, if the.�"strict letter of these regulations were carried out. Requiring a 25' front yard setback would require that a proposed house be constructed closer to the minimum 40' setback from the bluff line. °� C�- I ��II Neighborhood Development Alliarice Preliminary Plat Staff Report #96-095 August 20, 1996 Page four Requiring these setbacks would also limit the depth of a proposed house on a lot. A proposed house may even require a future River Corridor modification to allow structures to be built less than the 40' minimum requirement if the front yard variance is not granted. Houses may also need to be wider on the lots to make up for the loss in lot depth and limit the design options for these lots. Wider houses would also limit or block more of the view from the bluff from the street and neighboring properties. (b) Variance recommendation: Since the variance will maintain at least a 40' setback from the bluff and allow greater depth for house design as commonly enjoyed by most lots, staff recommends approval of the requested 10' front yard setback variance to allow a 15' front yard setback on Lots 1-5, Block 1. G. STAFF RECOMMENDATION: Based on the above findings, staff recommends approval of the preliminary plat of Mt. Hope Addition and approval of a 10' front yard setback variance to allow a front yard setback of 15' on Lots 1-5, Block 1, subject to the following condition: 1.
