8 THE COUNCIL OF THE CITY OF SAINT PAUL DOES HEREBY ORDAIN:

12 Chapter 140.01 of the Saint Paul Legislative Code dealing with Skyway Governance is hereby
13 repealed and rescinded in its entirety.

STRUCTURED UNDER THE CAPITOLRIVER COUNCIL, DISTRICT 17
At it's 18 September 1996 Board of Directors meeting a motion was passed unanimously to support th�reorganizing of
the current Skyway Govemance Committee.With the partnership of the Greater Saint Paul Buifding Owners and Managers
Association(BOMA)this oommittee would be sstablished as a committee of the District Council.
The purpose of reorganizing the Skyway Governance Committee is to improve the commiltee's effectiveness.
District 17 is on officially ordained citizens'council(501 C-3)rep�esenting Downtown SaiM Paul constituents and the
Skyway System, This citizen participation comm'rttee will be effeative in it's objectives oommunicating dinectly with City
Counail.
BOMA, CVB(Convention and Visitors Bureau)and CRC wifl appoint their own representative without predetertnined limits
of service.This will relieve the committee of political appointments for a public pedestrian system.
We recognize that the staff of the Planning and Economic Devebpment Department is heavily burdened. However,the
Skyway Govemance Committee needs assurance that the aty will enforoe provisions of the Skyway Ordinanoe_
BOMA and CRC representatives discussed the folbwing reorganized Skyway Governance Committee structure and
administrative functions.

• The Skyway Governance Commrttee will follow up on complaints, both wr"rtten and phone ca11s and notity the
appropriate city agencies ie. PED, LIEP, Publio Works.

I understand that the third reading repealing existing reference to the Skyway Governance Committee
is scheduled for December 18. Althougli the draft ordinance repeals and rescinds Chapter 140.01, it
does not provide for replacement language. I would suggest the attached for consideration as amended
language to Section 140.01.
Highlights of the suggested amendment are:
1. For purposes of clarification, change name of the committee to Skyway Advisory Committee.
2. Designate Real Estate Division for administration.
3. Change composition of co►nmittee, including allowing BOMA, CRC and CVB to designate
representatives without term limits.
I have forwarded the attached to BOMA and CapitolRiver Council for their review. Martha Larson
and I are available to discuss tl�is further if you have any questions. Thank you for considering this
proposed change.

Chapter 140. Skyway Conduct
Sec. 140.01 Definitions

Pedestrian skyway system same
Skyway System Administrative Responsibiliry. The skyway system is located on public
property or within public easements. As such the city has a proprietary obligation for
developing, operating and maintaining the skyway system. In order to maximize its
effectiveness as a public pedestrian system, the City Real Estate Division shall staff and
administer the skyway system, receiving input from a skyway advisory committee. ,
The Skyway Advisory Committee shall advise the mayor, council and city staff on matters
relating to the successful public use of the pedestrian skyway system and pedestrian malls.
The skyway advisory committee shall provide input regarding, but not limited to lighting,
standardized signs and directories, improved communications, hours of operation, levels of
maintenance, use of skyway space for sales and performance (see Section 140.06) and
advertising in the corridors (see Section 140.08). The skyway advisory committee shall
conduct policy discussions at public meetings, notifying interested parties of its meeting time
and place.
Skyway Advisory Committee Membership. The "skyway advisory committee" shall consist of
seven (7) persons including 3 members who represent, respectively, the Building Owners and
Managers Association (BOMA) the CapitolRiver Council (CRC), and the Convention and
Visitors Bureau (CVB), and 4 at large members from among downtown residents, residential
or commercial building managers, the disabled community, and skyway-connected small
businesses or professionals. Representatives for BOMA, CRC and CVB will be designated by
tl�at organization, and shall be represented without limits of service. The mayor, with the
consent of the city council, will appoint the remaining 4 members at large. At least 3 of the
7 committee members shall have education or experience in building systems, property
management, or a related discipline. A chairperson shall be elected by the committee to call
and preside over its meetings. Public meetings shall be held at least once a quarter at an
accessible site.
