1 WHEREAS, the Board of Water Commissioners and the City of Saint Paul have been apprised of the fact that
2 the tonens properiy described below ("the Property") has filed of record a perpetual easement held on behalf of
3 the Boazd and the City for the purpose of diverting, taking and drawing water from Lake Baldwin in Anoka
4 County for the purpose of supplying water to the inhabitants of the City of Saint Paul.

7 Lot 2 except the Northerly 50 feet of Lot 2, all of Lot 3 and the Northerly 35 feet of Lot 4, Block 1, Paco
8 Industrial Park, according to the plat on file in the office of the Registrar of Titles of Anoka County,
9 Minnesota, as corrected by Surveyor's Certificate filed as Registraz of Titles Document No. 107818.

12 WHEREAS, upon investigation of this matter, the Board and City were apprised that they do not need an
13 easement over this Properiy and that the recording of such easement must have been in error; and

15 WHEREAS, the Board and City were requested by the current owner of the Property to release the afore stated
16 rights on the Property by executing a Release of Easement document to be filed of record in Anoka County; and

WHEREAS, the Board did approve a Release of Easement which does release the afore stated rights on the
Property possessed by the Board and the City, and did request the Council of the City of Saint Paul to adopt a
resolution approving said Release of Easement; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul does hereby approve the Release of Easement which
does reiease all rights on the above described Property possessed by the City of Saint Paul and the Board of
Water Commissioners of the City of Saint Paul to divert, take and draw water from Lake Baldwin in the County
of Anoka, State of Minnesota, to supply the inhabitants of the City of Saint Paul, and that the proper officers are
hereby authorized to execute said Release of Easement on behalf of the City.

that the torrens property described below ("Property") has filed of record a perpetual easement held on behalf
of the City of Saint Paul and iu Boazd of Water Commissioners for the putpose of diverting, ta.king and
drawing water from Lake Baldwin in Anoka County for the purpose of supplying water to the inbabitants of
the City of Saint Paul.
Propertv descrintion:
Lot 2 except the Northerly 50 feet of Lot 2, all of Lot 3 and the Northerly 35 feet of Lot 4, Block 1,
Paco Industrial Pazk, according to the plat on file in the office of the Regis�ar of Titles of Anoka
County, Minnesota, as corrected by Surveyor's Certificate filed as Registrar of Tifles Document No.
107818.
and
WHEREAS, upon investigation of this matter the Boazd and City Council have been apprised that the City
and Board do not need an easement over this Properry and that the recording of such easement must have been
in error; and
WI�EREAS, the Boazd and City Council were requested by the current owner of the Property to release all
easement rights on the Properry by executing a release of easement document to be filed of record in Anoka
County; and
WHEREAS, staff has prepazed a Release of Easement which does release all easement rights possessed by
the City and the Board over the Properiy, and the assistant city attorney has approved same as to form; now,
therefore, be it
RE50LVED, that the Boazd of Water Commissioners of the City of Saint Paul does hereby approve the
Release of Easement which does release all rights on the above described Property possessed by the City of
Saint Paul and the Board of Water Commissioners of the City of Saint Paul to divert, take and draw water
from Lake Baldwin in the County of Anoka, State of Minnesota, to supply the inhabitants ofthe City of Saint
Paul, and that the proper officers aze hereby authorized to execute said Release of Easement on behalf of the

FURTHER RESOLVED, that the Honorable Council of the City of Saint Paul is hereby requested to adopt
a resolution approving said Release of Easement and to authorize the proper officers of the City of Saint Paul

For valuable consideration, the City of Saint Paul, a municipal corporation organized under the laws
of the State of Minnesota, hauing its office located at 15 West Kellogg Boulevazd, St. Paul, Minnesota 55102
and Boazd of Water Commissioners of the City of Saint Paul, a municipal corporation organized under the
laws of the State of Minnesota, having its offices located at 8 Fourth Street East, 5uite 400, St. Paul,
Minnesota 551 O l hereby release any and all easement interest in the following real property located in Anoka
County, Minnesota and described as follows:
Lot 2 except the Northerly 50 feet of Lot 2, all of Lot 3 and the Northerly 35 feet of
Lot 4, Block 1, Paco Industrial Pazk, according to the plat on file in the office ofthe
Registraz of TiUes of Anoka County, Minnesota, as corrected by Surveyor's
Certificate filed as Registraz of Tities Document No. 107818.
The Registraz of Titles of Anoka County, Minnesota is hereby authorized to omit from future
certificates of title for the land now covered by Certificate of Title No. 76538 the following recital:
Subject to a perpetual easement held by the City of Saint Paul and Boazd of Water
Commissioners of the City of Saint Paul to divert, take and draw water from Lake
Baldwin in the County of Anoka, State of Minnesota, to supply the inhabitants of

WHEREAS, the Board of Water Commissioners and the Ciry of Saint Paul have been apprised of the fact
that the torrens property described below ("Property") has filed of record a perpetual easement held on behalf
of the City of Saint Paul and iu Boazd of Water Commissioners for the putpose of diverting, ta.king and
drawing water from Lake Baldwin in Anoka County for the purpose of supplying water to the inbabitants of
the City of Saint Paul.
Propertv descrintion:
Lot 2 except the Northerly 50 feet of Lot 2, all of Lot 3 and the Northerly 35 feet of Lot 4, Block 1,
Paco Industrial Pazk, according to the plat on file in the office of the Regis�ar of Titles of Anoka
County, Minnesota, as corrected by Surveyor's Certificate filed as Registrar of Tifles Document No.
107818.
and
WHEREAS, upon investigation of this matter the Boazd and City Council have been apprised that the City
and Board do not need an easement over this Properry and that the recording of such easement must have been
in error; and
WI�EREAS, the Boazd and City Council were requested by the current owner of the Property to release all
easement rights on the Properry by executing a release of easement document to be filed of record in Anoka
County; and
WHEREAS, staff has prepazed a Release of Easement which does release all easement rights possessed by
the City and the Board over the Properiy, and the assistant city attorney has approved same as to form; now,
therefore, be it
RE50LVED, that the Boazd of Water Commissioners of the City of Saint Paul does hereby approve the
Release of Easement which does release all rights on the above described Property possessed by the City of
Saint Paul and the Board of Water Commissioners of the City of Saint Paul to divert, take and draw water
from Lake Baldwin in the County of Anoka, State of Minnesota, to supply the inhabitants ofthe City of Saint
Paul, and that the proper officers aze hereby authorized to execute said Release of Easement on behalf of the
Board; and, be it
FURTHER RESOLVED, that the Honorable Council of the City of Saint Paul is hereby requested to adopt
a resolution approving said Release of Easement and to authorize the proper officers of the City of Saint Paul
to execute said Release of Easement on behalf of the City.

RELEASE OF EASEMENT
For valuable consideration, the City of Saint Paul, a municipal corporation organized under the laws
of the State of Minnesota, hauing its office located at 15 West Kellogg Boulevazd, St. Paul, Minnesota 55102
and Boazd of Water Commissioners of the City of Saint Paul, a municipal corporation organized under the
laws of the State of Minnesota, having its offices located at 8 Fourth Street East, 5uite 400, St. Paul,
Minnesota 551 O l hereby release any and all easement interest in the following real property located in Anoka
County, Minnesota and described as follows:
Lot 2 except the Northerly 50 feet of Lot 2, all of Lot 3 and the Northerly 35 feet of
Lot 4, Block 1, Paco Industrial Pazk, according to the plat on file in the office ofthe
Registraz of TiUes of Anoka County, Minnesota, as corrected by Surveyor's
Certificate filed as Registraz of Tities Document No. 107818.
The Registraz of Titles of Anoka County, Minnesota is hereby authorized to omit from future
certificates of title for the land now covered by Certificate of Title No. 76538 the following recital:
Subject to a perpetual easement held by the City of Saint Paul and Boazd of Water
Commissioners of the City of Saint Paul to divert, take and draw water from Lake
Baldwin in the County of Anoka, State of Minnesota, to supply the inhabitants of
the City of Saint Paul.
IN WITNESS WHEREOF, the parties hereto have executed this Release, the day and yeaz first
