5 WI�RF.AS, the mission of the Sewer Utility of Public works is to provide a basic
6 service of transporting sanitary wastewater to the regional treatment system and to
7 provide this sexvice at a reasonable cost; and
8
9 WHEREAS,Metropolitan Council Environmental Services will not be increasing their 1997
10 rate for regional wastewater treatment to the City of Saint Paul; and
11
12 WHERFA►S, Sanitaxy Sewer Service charges pay for the cost of operating, maintaining
13 the sewage disposal system including the principal and interest on bonds sold for
14 system construction and for paying Saint Paul's share of the Metropolitan Council
15 Wastewater Services's annual budget as provided in Chapter 473, Minnesota
16 Statutes, and in accordance with the provisions of the Clean Water Act; and
17
18 W�IEREAS, an additional nussion of the Sewer Utility of Public Works is to collect and
19 transport storm water to the river through a separate system of pipes, to improve the
20 quality of our stormwater discharges and to provide this service at a reasonable cost;
21 and
22
23 WHEREAS, the City of Saint Paul pursuant to Chapter 14, Article 19, First Special
24 Session, Laws of Minnesota, 1985, and all other laws particularly Minnesota Statutes,
25 Section 444.075 and applicable charter provisions, enacted Ordinance #17359 (6/3/86)
26 establishing a Storm Sewer System Charge for the purpose of paying the cost of
27 construction, reconstruction, repair, enlargement and improvements necessitated by the
28 separation of the combined sewer system and for the maintenance, operation and use of
29 the separated storm sewer system; and
30
31 WHEREAS, the Storm Sewer System Charge shall be based on a parcel's
32 anticipated contribution of storm water runoff to the storm sewer system, which
33 is a function of the parcel's size and its land use; and
34
35 WHEREAS,the Storm Sewer System Charge ordinance provides that the City
36 Council may, from time to time, by resolution, establish Storm Sewer System
37 Charge rates for the various land use classifications which will be based upon
38 data provided by the Department of Public Works; and

40 WHEREAS, the revenue collected from the Storm Sewer System Charge is used to
41 pay back the Sewer Revenue Bonds sold for the purpose of paying for the
42 construction of the storm sewer system; and

44 VV�iEREAS, the Department of Public Works will review the costs and benefits of
45 consolidating the Storm Sewer System Charge onto the Water Utility Billing
46 System and thereby eliminating the separate annual billing of the Storm Sewer
47 System Charge; and
48
49 WHEREAS, state and federal mandated environmental programs have been
50 imposed upon Saint Paul without accompanying funds; and
51
52 WHERF.AS,there is a critical need for increased revenues and retained earnings in
53 the Sewer Enterpriae Fund as evidenced by Standard and Poor's 1993 bond rating
54 of BBB+ with a negative outlook; and
55
56 WHERF.AS, the proposed 1997 Budget will result in anticipated expenditures,
57 credits and financing for the sanitary and storm sewer systems as follows:

98 Now, therefore, be it RESOLVED, that pursuant to Section 81.05 of the Saint Paul
99 Legislative Code pertaining to Storm Sewer System Charges and upon
100 recommendation of City Administration, the Council of the City of Saint Paul
101 does hereby establish the amount and basis for Storm Sewer System Charges
102 to be levied and collected effective January 1, 1997 through December 31, 1997:

119 the 1996 Storm Sewer System Charge rates; and

121 Be it FURTHER RESOLVED, that pursuant to Section 77.02 of the Saint Paul
122 Legislative Code pertaining to Sanitra�y Sewer Service Charges and upon the
123 recommendation of City Administration, the Council of the City of Saint Paul does
124 hereby eatablish the amount and basis for Sanitary Sewer Service Charges to be
125 levied and collected effective January 1, 1997 through December 31, 1997:

127 $2.34 per 100 cubic feet for the first 100,000 cubic feet; and
128 $2.31 per 100 cubic feet for the next 400,000 cubic feet; and

155 smaller shall be billed quarterly. Properties served by meters larger than one
156 inch shall be billed monthly, with the exception of one and two family homes
157 which shall be charged quarterly for Sanitary Sewer Service Charges; and

159 Be it FURTHER RESOLVED,that the Sanitary Sewer Service Charges for one
160 and two family dwellings for the billing year shall be determined by the amount of
161 water consumed, regardless of the size of the water meter, and the amount billed
162 shall never be greater than the amount of water consumed during the quarter
163 consisting of the first three months prior to the first billing of the year, except for
164 those dwellings assessed minimum charges; and

166 Be it FINALLY RESOLVED, that the Sanitary Sewer Service Charges for all other
167 properties, regardless of the size of the meter, shall be based on actual water
168 consumption for each billing period.

As required in the Legislative Code,sanitary sewer rates must be set annually. The Sewer Division's budget is
showing only an inflationary increase. Therefore,Public Works is proposing a 2�increase in sanitary rates and
the same increase in the Storm Sewer System Charge. This increase will add$4.00 to a typical homeowner's
annual sanitary sewer bill and it will add S 1.00 to their annual storm sewer bill. '
ADVANTA4ESIF APPROVED
The new rates will provide an adequate revenue to operate and maintain the City's sewer system. Appmving the
resolution will also satisfy the City's legal requirement to set sanitary sewer rates annually.
