2 An ordinance amending Chapter 60 of the Saint Paul Legislative Code pertaining to zoning for the City of
3 Saint Paul and the zoning maps thereof:

5 WHEREAS, Pursuant to Minnesota Statutes §462.357 and §64.400 of the Legislative Code, MICHAEL
6 OSTERMAN duly petitioned to rezone 1595 DAYTON AVENUE, being legally described as Lot 13,
7 Block 1; Oakland Park Addition, from RT-1 to P-1 to allow parking for an auto body repair shop, the
8 petition having been certified by the Planning Division on August 26, 1996 as having been consented to
9 by at least 67 percent of the owners of the area of the property to be rezoned, and further having been
10 consented to by at least two-thirds of the owners of the property situated within 100 feet of the total
11 contiguous property within one year proceeding the date of the petition; and
12
13 WHEREAS, The Zoning Committee of the Planning Commission held a public hearing on October 3,
14 1996, for the purpose of considering the rezoning petition, and pursuant to §107.03 of the Administrative
15 Code, submitted its recommendation to the Planning Commission that the petition be granted; and
16
17 WHEREAS, The Planning Commission considered the rezoning petition at its meeting held on October
18 11, 1996 and recommended that the City Council approve the petition; and
19
20 WHEREAS, notice of public hearing before the City Council on the said rezoning petition was duly
21 published in the official newspaper of the City on October 17, 1996 and notices were duly mailed to each
22 owner of affected property and property situated wholly or partly within 350 feet of the property sought to
23 be rezoned; and

25 WHEREAS, a public hearing before the City Council having been conducted on November 6, 1996,
26 where all interested parties were heard, the Council having considered all the facts and recommendations
27 concerning the petition; now, therefore

Dear Ms. Anderson:
MICHAEL OSTERMAN submitted a petition to rezone property at 1595 Dayton Avenue. The Zoning
Committee of the Planning Commission held a public hearing on the proposed rezoning on October 3,
1996. The applicant addressed the committee. At the close of the public hearing, the committee
voted 5-0 to recommend approval to rezone to P-1. The Planning Commission upheld the Zoning
Committee's recommendation for approval on a vote of 16-0 on October 11, 1996.
This proposed rezoning is scheduled to be heard by the City Council on November 6, 1996. Please
notify me if any member of the City Councii wishes to have slides of the site presented at the public
hearing.

WHEREAS, MICHAEL OSTERMAN, file #96-207 has petitioned to rezone 1595 DAYTON
AVENUE, situated on the south side of the street between Snelling & Fry from RT-1 to P-1
to allow parking for an auto body repair shop; and
WHEREAS, the Zoning Committee of the Planning Commission held a public hearing on
October 3, 1996, at which all persons present were given an opportunity to be heard pursuant
to said application in accordance with the requirements of Section 64.400 of the Saint Paul
Legislative Code; and
WHEREAS, the Saint Paul Planning Commission, based on the evidence presented to its
Zoning Committee at the public hearing, as substantially reflected in the minutes, made the
following findings of fact:
1. The a�plicant has owned the property since 1980. He operates an auto body shop called
Freeway Auto IIody from the property at 229 North Snelling Avenue. He has very little •
space to store cars once Ile is finistled working on tllem. He would like to be able to
provide customers their cars in clean condition and therefore needs space to store cars
for a day or two until customers can pick them up. His intention for the property on
Dayton Avenue is to rezone it from residential to parking and construct a building on the
lot. He states that the building would be used for the parking of vehicles only and that
no repair or refinishing of any kind would take place in the building. He adds that
simply rezoning the property to P-1 and constructing a parking lot on the site would not
be sufficient to meet his need to provide customers their vehicles in clean condition,
especially in the winter months.
2. The proposed rezoning to P-1 is in conformance with the comprehensive plan. One of
the Neighborhood Improvement Strategies of the Selby Snelling Small Area Plan states,
"identify and develop additional off-street parking sites...particularly on the west side of
Snelling," #10, p.17. In addition, one of the recommendations of the District 13 Plan
states, "the neighborhood commercial areas need off-street parking and improvements in
image," #11, p.l.

The P-1 Veliicular Parking District is intended to permit the establishment of off-street
parking facilities to be used solely for off-street parking of private passenger vehicles as
a use incidenta( to a principal use. The district will serve a use district which has
developed without adequate off-street parking. Required conditions of the P-1 district
include: 1)no commercial repair work or service of any kind, or sale or display thereof,
shall be conducted in such parking facility; and 2) no building other than that for the
shelter of attendants shall be erected upon the premises unless specifically approved by
the planning administrator during site plan review.
Thus, if the rezoning to P-1 is approved the applicant will need approval from the
planning administrator to allow a building to be built on the lot. The planning
administrator intends to approve the applicant's plans for a building during site plan
review. However, the record must be perfectly clear: off-street parking is the only
permitted use allowed in the P-1 zoning district and absolutely no storage of parts or
supplies, nor repair or refinisliing work of any kind, will be permitted in P-1 zoning
district.
3. Tt�e proposed rezoning to P-1 is consistent and compatible with the way the area has
developed and will not have an adverse impact on surrounding property. The parking
• will servc an area with a documented need for off-street parking. Thc site of the
proposed parking is surrounded on the north, east, and west by office and commercial
uses.
4. Current zoning does not allow reasonable use of the property. This is the only small
residential lot on the entire block. It is unlikely this lot would be developed for
residential use given that it is surrounded by commercial uses to the north, east, and
west. Parking is an appropriate use for the site and serves a commercial area that was
developed without adequate off-street parking.
5. The applicant submitted a sufficient petition signed by two-thirds of the property owners
within one hundred (100) feet the property to be rezoned consenting to the rezoning (11
parcels eligible, 8 parcels needed, and 8 parcels signed).
NOW, THEREFORE, BE IT RESOLVED, by the Saint Paul Planning Commission that the
petition of MICHAEL OSTERMAN to rezone property at 1595 DAYTON AVENUE, more
particularly described as Lot 13, Block 1; Oakland Park Addition, from an RT-1 zoning
classification to a P-1 zoning classification is consistent with the Comprehensive Plan for the
City;�and
BE IT FURTHER RESOLVED, that the Saint Paul Planning Commission does hereby
recommend to the Council of the City of Saint Paul that°property located at 1595 DAYTON
• AVENUE be rezoned from RT-1 to P-1 in accordance with the petition for rezoning on file
with the Saint Paul Planning Division.

MICHAEL OSTERMAN, 1595 Davton Avenue; northside between Snellinq and Frv;
#96-207; Rezoninq. Rezone the property from RT-1 (residential) to P-1
(parking) to allow parking for an autobody repair shop.
Kady Dadlez, Planning Division staff, reviewed the staff report and presented
slides. Staff recommended approval of the petition to rezone to P-1 based on
findings 1 through 5 of the staff report.
The Merriam Park Community Council voted to support the rezoning petition,
with two recommended provisions from the neighbors, as stated in the letter
submitted by them on September 17, 1996 and which was distributed at the
meeting.
Michael Osterman, the applicant, 113 Bellwood, Maplewood, was available to
respond to questions. .
No one spoke, either in support or opposition of the proposal.
Commissioner Faricy recommended approval of the rezoning. Commieaioner Field
seconded the motion.
Commissioner Vaught said he supported the motion, however felt the means in
which it was done was inappropriate. He said that building a building is not
a P-1 use, and believed that the next use of the building would not be
consistent with P-1.
Ms. Dadlez reviewed that the alternatives were either I-1 or P-1. I-1 was not
consistent with the comprehensive plan and would have resulted in spot zoning.
Staff's suggestion was P-1 without a building, but did not suit the
applicant's needs. Ms. Dadlez reviewed that the applicant understands that if
and when the property is ever sold that its use would be limited to parking
and that no other use could occur inside the building.
The motion carried on a voice vote of 5 to 0.
Commissioner Gurney was not present for the vote.

E. ZONING CODE CITATION: Section 64.400 (a) of the zoning code states in
part, "the council may, from time to time, amend, supplement or change
the district boundaries or the regulations herein, or subsequently
established herein pursuant to the provisions of Minnesota Statutes
Section 462.357 and amendments thereto as may be made from time to time.
The planning commission may, from time to time, review district boundary
lines to determine if, pursuant to state laws, such district boundary
lines should be changed. "
Section 64.400 (b) states in part, "an amendment to the zoning code may be
initiated by the council, the planning commission or by petition of the
owners of sixty-seven (67) percent of the area of the property to be
rezoned. "
F. HISTORY/DISCUSSION: There are no previous zoning cases concerning this
property.
G. DISTRICT COUNCIL RECONIl�IENDATION: The Merriam Park Community Council
voted to support the rezoning petition.

H. FINDINGS:
1. The applicant has owned the property since 1980. He operates an auto
body shop called Freeway Auto Body from the property at 229 North
Snelling Avenue. He has very little space to store cars once he is
finished working on them. He would like to be able to provide
customers their cars in clean condition and therefore needs space to
store cars for a day or two until customers can pick them up. His
intention for the property on Dayton Avenue is to rezone it from
residential to parking and construct a building on the lot. He states
that the building would be used for the parking of vehicles only and
that no repair or refinishing of any kind would take place in the
building. He adds that simply rezoning the property to P-1 and
constructing a parking lot on the site would not be sufficient to meet
his need to provide customers their vehicles in clean condition,
especially in the winter months.
2. The proposed rezoning to P-1 is in conformance with the comprehensive
plan. One of the Neighborhood Improvement Strategies of the Selby
Snelling Small Area Plan states, "identify and develop additional off-
street parking sites. . .particularly on the west side of Snelling, "
#10, p.17. In addition, one of the recommendations of the District 13
Plan states, "the neighborhood commercial areas need off-street
parking and improvements in image, " #11, p.l.
The P-1 Vehicular Parking District is intended to permit the
establishment of off-street parking facilities to be used solely for
off-street parking of private passenger vehicles as a use incidental
to a principal use. The district will serve a use districti which has �
developed without adequate off-street parking. Required conditions of
the P-1 district include: 1)no commercial repair work or service of
any kind, or sale or display thereof, shall be conducted in such
parking facility; and 2) no building other than that for the shelter
of attendants shall be erected upon the premises unless specifically
approved by the planning administrator during site plan review.
Thus, if the rezoning to P-1 is approved the applicant will need
approval from the planning administrator to allow a building to be
built on the lot. The planning administrator intends to approve the
applicant's plans for a building during site plan review. However,
the record must be perfectly clear: off-street parking is the only
permitted use allowed in the P-1 zoning district and absolutely no
storage of parts or supplies, nor repair or refinishing work of any
kind, will be permitted in P-1 zoning district.
3. The proposed rezoning to P-1 is consistent and compatible with the way
the area has developed and will not have an adverse impact on
surrounding property. The parking will serve an area with a
documented need for off-street parking. The site of the proposed
parking is surrounded on the north, east, and west by office and
commercial uses.
4. Current zoning does not allow reasonable use of the property. This is
the only small residential lot on the entire block. It is unlikely
this lot would be developed for residential use given that it is
surrounded by commercial uses to the north, east, and west. Parking
is an appropriate use for the site and serves a commercial area that
was developed without adequate off-street parking.
