STATE OF ISSUE The issue to be determined in this proceeding is whether adverse action should be taken against the license issued to the Respondent because of criminal and other noncompliant activities taking place on the licensed premises located at 1171 Jackson Street, St. Paul, Minnesota. Based upon the record herein, the Administrative Law Judge makes the . following: � FINDINGS OF FACT 1. On January 11, 1996 the City of St. Paul, Office of the License, Inspections and Environmental Protection (LIEP) issued a Class I license for a "tanning facility" to Rustelle Kujawa for the premises located at 1171 Jackson Street, St. Paul, Minnesota. Exhibit 3. 2. In May 1996, the St. Paul Police Department, Vice Unit, conducted an investigation of the licensed premises, based upon neighborhood complaints that adult males were frequenting the establishment at off business hours. In connection with that investigation, the officer's stopped an adult male after leaving the licenses premises and questioned him regarding his activities there. He admitted that he had responded -. to a newspaper ad and had paid for sex at the licensed premises. 3. A Ramsey County search warrant was granted for the licensed premises and executed by the St. Paul Police Department on May 31, 1996. 2 .� � ������ 4. Sergeant Eugene Polyak, St. Paul Police Department, �ce Unit, made an appointment at the licensed premises under the name "Geno, P.P." At approximately 10:30 a.m., May 31, 1996, he was admitted to the premises by the licensee, Rustelle Kujawa. He was introduced to one female employee named "Shane" and left in a small bedroom and told to "get comfortable". Sergeant Polyak understood this to mean that he should undress and wrap a towel around his waist. 5. The female identified as Shane, later entered the bedroom dressed in undergarments and proceeded to rub oil on Sergeant Polyak's body. While lying on the . bed beside him she advised the officer that for $150.00 he could have sex with her. After she had opened and held a condom in her hand, she was advised that she was under arrest for engaging in prostitution. 6. The search warrant was then executed by Sergeant Polyak and other officer's on the licensed premises. Various items were seized, including black leather female undergarments, sexual aid devices, electric and otherwise, as well as condoms, a rolodex of names, work scheduling documents and other items not related to the operation of a tanning facility. Exhibit 1. 7. An adult male on the premises during the execution of the search warrant was questioned and indicated that he had paid $50.00 and received a massage from a woman in undergarments and he had ejaculated while fondling her in a sexual manner. � Exhibit 1. 8. The licensee, Rustelle Kujawa, was arrested for promotion of prostitution. The other two females on the premises were arrested for engaging in prostitution. One 3 - , `� . �=1�-1�Z�5 of the employees on the premises at the time of the execution of the release, had a prior conviction for engaging in prostitution. Exhibit 4. 9. At no time during the execution of the search warrant was any tanning equipment observed to be set-up or operating on the licensed premises. 10. On August 1st and August 20th, 1996, St. Paul City Attorney sent to the licensee's business and last known home address Notices of the intent to pursue adverse action against her license in connection with criminal and non-licensed activities on the premises. Exhibit 5 and 6. . 11. On September 6, 1996, the City Attorney's Office sent a Notice of Hearing to the licensee at her business and last known home address. Exhibit 7. Based upon the foregoing Findings of Fact, the Administrative Law Judge makes the following; CONCLUSIONS OF LAW 1. The City Council and Administrative Law Judge have jurisdiction in this matter pursuant to Minn. Stat. § 14.55 and St. Paul Legislative Codes Section 310.05 and .06. 2. The City of St. Paul has fulfilled all relative substitutive and procedural requirements of law and rule. 3. The City of St. Paul has the burden to prove, by preponderance of the - evidence, the allegations of violation by the licensee. Minnesota Rule 1400.7300 Sub. part 5. 4. The licensee is responsible for the acts of its employees; 4 •. " - �1,�-�5'l�S "a. Any aet by a clerk, bar keeper, agent, servant, or empioyee of any licensee hereunder, in violation of this chapter, shall be deemed the act of the employer and licensee of such piace as well as that of such clerk, bar keeper, agent, servant or employee...." The City of St. Paul did prove by a preponderance of the evidence that on May 31, 1996, that the licensee was not operating a business on the licensed premises . in compliance with the license issued for the premises. 6. The licensee has conducted activities on the licensed premises that are not in compliance with the license and are in violation of ordinance and statute relating to the promotion of and engaging in prostitution and further, permits conditions that unreasonably annoy, injury or endanger the safety� health, morals, comfort and repose of a considerable number of inembers of the public. By testimony, the business was essentially closed following the execution of the search warrant on May 31, 1996. Testimony indicated that the landlord took control of the premises and used it in a different fashion, for his own purpose, shortly after the o�cers made the arrests on May 31, 1996. Notices of this proceeding were _ sent to both the business address of record and the last known home address of the licensee in August and September 1996. Service to the "last known address" is adequate °service" in accordance with the rules. i.e.: Minn. Rules Section 1400.5100s19. The proceedings in connection with this matter were conducted by default. Evidence was taken, however, in support of the allegations and factual assertions contained in the notices sent to the licensee. The evidence presented by testimony and documents were more than adequate to support the Findings, Conclusions and Recommendations made herein. It is clear that at the time of the execution of search warrant, May 31, 1996, that the licensee had made no efforts to operate the premises as a tanning facility in a fashion consistent with the license issued by LIEP. The licensee has abandoned the license, the premises and whatever business was being operated at the licensed premises. The City Council should revoke the license. Mosman, Administrative Law Judge, commencing 9:30 A.M., October 22, 1996 in Room 42, St. Paul City Hall, 15 West Kellogg Boulevard, St. Paul, Minnesota. Stephen J. Christie, Esq., Office of the City Attorney, 400 City Hall, 15 West Kellogg Boulevard, St. Paul, Minnesota 55102, appeared on behalf of the City of St. Paul. No appearance was made by the Respondent, Rustelle Kujawa. The record of the proceeding closed on October 22, 1996, at the conclusion of the hearing. This report is a recommendation, not a final decision. The St. Paul City Council will make the final decision after a review of the Record and may accept, reject, or modify the Findings, Conclusions and Recommendations contained herein. Pursuant to St. Paul Legislative Code, Section 310.05 (c-1), after receipt of this Report, the St. Paul City Council will provide an opportunity to present oral and/or written arguments q� -I 5�g alleging error in this Report and to present arguments related to any action recommended in this Report. STATE OF ISSUE The issue to be determined in this proceeding is whether adverse action should be taken against the license issued to the Respondent because of criminal and other noncompliant activities taking place on the licensed premises located at 1171 Jackson Street, St. Paul, Minnesota. Based upon the record herein, the Administrative Law Judge makes the following: FINDINGS OF FACT 1. On January 11, 1996 the City of St. Paul, Office of the License, Inspections and Environmental Protection (LIEP) issued a Class I license for a "tanning facility" to Rustelle Kujawa for the premises located at 1171 Jackson Street, St. Paul, Minnesota. Exhibit 3. 2. In May 1996, the St. Paul Police Department, Vice Unit, conducted an investigation of the licensed premises, based upon neighborhood complaints that adult males were frequenting the establishment at off business hours. In connection with that investigation, the officer's stopped an adult male after leaving the licenses premises and questioned him regarding his activities there. He admitted that he had responded to a newspaper ad and had paid for sex at the licensed premises. 3. A Ramsey County search warrant was granted for the licensed premises and executed by the St. Paul Police Department on May 31, 1996. 2 �� - I 5�1g 4. Sergeant Eugene Polyak, St. Paul Police Department, Vice Unit, made an appointment at the licensed premises under the name "Geno, P.P." At approximately 10:30 a.m., May 31, 1996, he was admitted to the premises by the licensee, Rustelle Kujawa. He was introduced to one female employee named "Shane" and left in a small bedroom and told to "get comfortable". Sergeant Polyak understood this to mean that he should undress and wrap a towel around his waist. 5. The female identified as Shane, later entered the bedroom dressed in undergarments and proceeded to rub oil on Sergeant Polyak's body. While lying on the bed beside him she advised the officer that for $150.00 he could have sex with her. After she had opened and held a condom in her hand, she was advised that she was under arrest for engaging in prostitution. 6. The search warrant was then executed by Sergeant Polyak and other officer's on the licensed premises. Various items were seized, including black leather female undergarments, sexual aid devices, electric and otherwise, as well as condoms, a rolodex of names, work scheduling documents and other items not related to the operation of a tanning facility. Exhibit 1. 7. An adult male on the premises during the execution of the search warrant was questioned and indicated that he had paid $50.00 and received a massage from a woman in undergarments and he had ejaculated while fondling her in a sexual manner. Exhibit 1. 8. The licensee, Rustelle Kujawa, was arrested for promotion of prostitution. The other two females on the premises were arrested for engaging in prostitution. One r 3 q(o-15�1g of the employees on the premises at the time of the execution of the release, had a prior conviction for engaging in prostitution. Exhibit 4. 9. At no time during the execution of the search warrant was any tanning equipment observed to be set-up or operating on the licensed premises. 10. On August 1st and August 20th, 1996, St. Paul City Attorney sent to the licensee's business and last known home address Notices of the intent to pursue adverse action against her license in connection with criminal and non-licensed activities on the premises. Exhibit 5 and 6. 11. On September 6, 1996, the City Attorney's Office sent a Notice of Hearing to the licensee at her business and last known home address. Exhibit 7. Based upon the foregoing Findings of Fact, the Administrative Law Judge makes the following; CONCLUSIONS OF LAW 1. The City Council and Administrative Law Judge have jurisdiction in this matter pursuant to Minn. Stat. § 14.55 and St. Paul Legislative Codes Section 310.05 and .06. 2. The City of St. Paul has fulfilled all relative substitutive and procedural requirements of law and rule. 3. The City of St. Paul has the burden to prove, by preponderance of the evidence, the allegations of violation by the licensee. Minnesota Rule 1400.7300 Sub. part 5. 4. The licensee is responsible for the acts of its employees; 4 q�- I 5"1`� "a. Any act by a clerk, bar keeper, agent, servant, or employee of any licensee hereunder, in violation of this chapter, shall be deemed the act of the employer and licensee of such place as well as that of such clerk, bar keeper, agent, servant or employee...." St. Paul Legislative Code, Section 409.14 (a) 5. The City of St. Paul did prove by a preponderance of the evidence that on May 31, 1996, that the licensee was not operating a business on the licensed premises in compliance with the license issued for the premises. 6. The licensee has conducted activities on the licensed premises that are not in compliance with the license and are in violation of ordinance and statute relating to the promotion of and engaging in prostitution and further, permits conditions that unreasonably annoy, injury or endanger the safety, health, morals, comfort and repose of a considerable number of inembers of the public. Record; the proceedings were tape recorded. MEMORANDUM The issue of the sufficiency and service of notice in this matter requires examination. By testimony, the business was essentially closed following the execution of the search warrant on May 31, 1996. Testimony indicated that the landlord took control of the premises and used it in a different fashion, for his own purpose, shortly after the o�cers made the arrests on May 31, 1996. Notices of this proceeding were sent to both the business address of record and the last known home address of the licensee in August and September 1996. Service to the "last known address" is adequate "service" in accordance with the rules. i.e.: Minn. Rules Section 1400.5100s19. The proceedings in connection with this matter were conducted by default. Evidence was taken, however, in support of the allegations and factual assertions contained in the notices sent to the licensee. The evidence presented by testimony and documents were more than adequate to support the Findings, Conclusions and Recommendations made herein. It is clear that at the time of the execution of search warrant, May 31, 1996, that the licensee had made no efforts to operate the premises as a tanning facility in a fashion consistent with the license issued by LIEP. The licensee has abandoned the license, the premises and whatever business was being operated at the licensed premises. The City Council should revoke the license. Based on my past experience in working sauna's it is common knowledge that, make yourself comfortable, means to take all your clothes off and place the towel around your waist and wait on the bed until the female returns. I waited on the bed and approximately 10 minutes passed when Shane entered " my room. Shane was wearing a bra and pair of lingerer under panties. Shane took a bottle of lotion off of a shelf next to the bed and asked me to roll over on my back. Shane then kneeled on the bed between my legs and asked if she could remove my towel. I stated that was okay so she removed it and started to rub lotion on my back. I made small talk with Shane. We talked about where I worked and where I was from. Shane eventually moved down to my lower back and eventually rubbed lotion on my buttocks. Shane then asked if I wanted to roll over and I replied, "sure". Shane got off the bed and removed her bra and panties. I observed that she had a open condom tucked in the waist band of her panties. Shane removed the condom and placed-it;on the end of the bed. Shane then laid next to me and rubbed my chest and stomach azea. I asked Shane if I could ask her an embarrassing question and she replied go ahead. I stated the add in tlie paper � �� said the session was a"hazem session" and I asked what harem meani. Sliane said that means y�u__________. get three girls. I said ,so you mean I get two more girls and she replied no, you did not pick that session. It was at this point that Shane reached down to the end of the bed and got the condom:I--- --� —� then commented that the lady I spoke with on the phone stated the session_would cost me $150___ __,____.____ dollars. Shane nodded her head 2nd replied that's right. I asked if we had to use a condom and she replied yes. I asked if the$150 dollars included sexual intercourse and�si�e replied yes. When Shane leaned her ear next to my mouth I told her that I was a police o�cer and she was under arrest. Shane stated she would cooperate. I instructed her to get dressed and gave a signal to my back up o�cers to enter the building. Z --I instructed Shane to sit on the bed while I went out to the T.V. room where Rustelle was seated and at that time a second blond female later identified as Stephens, Dana Pauline was also seated in tfie room. I instructed-tbe fwo females to remain seated and identified myself as a police `�O officer. I then instructed Rustelle to go and let the o�cers in at the door. There was also a blue box containing x-rated video's and a simulated allegator brief case I asked if these items belonged to her and she said they were also her's. I also recovered the condom Shane had started to place on me. I also recovered a brochure on information from the center for sex research addressed to Rustelle Witt at 635 Galtier Apt#107. This is the same address Rustelle Kujawa resides at. There were also 9latex condoms I recovered from Rustelle's purse. These items were inventoried by Sgt. Kumagie. I left a copy of the warrant and a copy of the inventory receipt at 1171 Jackson. While at the scene I did a brief interview with each of the three females. I first questioned Rustelle. I asked Rustelle if there was a safe in the building and she replied,No. I asked where the money is kept and she stated she would rather wait until she has an attorney before she said _ . ___. anything. _ _ _ _ . I then questioned Notarino, Marie Bernadette. I asked marie if she was willing to cooperate and she replied, "yes". I asked where they keep the money for the business. Marie stated the girls --� � --" keep there share and that's it. I asked who gets the rest and she stated Rustelle takes it. I asked.__ _._. _ _._____ who hired her and she stated she was hired over the phone by Rustelle. I asked if she would be wiiling to talk further af police headquarters and she replied,"yes". _ __- - _ _. _ _ _ . _ _ __._ __ _ _ _ ____._ I questioned Stephens. I asked if she would be willing to answer a few questions and she replied, Sure. I asked iP she was just with a customer and she explained yes. Nortarino, replied that based on the nature of her work it would be difficult to deal with a boyfriend. At Police Headquarters I interviewed both Notarino, Marie and Stephens, Dana. I read both suspects their Miranda rights and recorded the interview on a micro cassette tape which was turned in to the property room. When I interviewed Notarino, she stated that- she- did not_ want_ to answer any questions until she had a lawyer present . Stephens also had several warrants out of Minneapoiis so she was R.P.F, I on the GM Erigaging charge and Minneapolis picked her up on the warrants . Kuwaja, Rustelle was not interviewed because she had previously indicated she wanted an attorney before she answered any questions. Reece, Valerie Dana goes by the working nameif"Tiffany". While at 1171 Jackson I recovered a work schedule as well as a customer appointment schedule from the end table next to the telephone. These items were contained inside a Mead notebook which Kujawa, Rustelle admitted belonged to her. On the customer appointment sheet it shows my appointment time in room#1 at 10:30 hrs under my first name of Geno with the initials P.P. representing the first initials of my middle and last name. Next to my name is the name"Shane"which is the name of the female I was scheduled with for my session. On this same sheet in Room#2 an appointment is made at 10:30 hrs with a customer named Ron L.C. with a female named"Tiffany". At the time I selected Shane I was informed by Kujawa, Rustelle that there was a third girl working but she was currently with a customer and unavailable. Sgt. KUEHL later � identified the Male customer Tiffany was with as Cazlson, Ronald Leigh(initials R.L.C) The name Tiffany also appears on other work schedules where the girls names are listed and there working hours. (See attached work schedule and customer schedule) At the scene Tiffany stated this was her first day at work as an employee at Polyanesian Paradise Tanning . I asked why in that case had I observed her car pazked behind 1171 Jackson as part of my investigation during the week prior to the warrant. Tiffany stated she stops by to visit from time to time. Although the recovered work schedule's do not contain dates it is obvious that Tiffany has been a scheduled employee at 1171 Jackson for some time. We were monitoring Sergeant Polyak activity inside of 1171 Jackson and we were informed that a white� male had just left and got into a car that was parked a short distance West of 1171 . We observed the white male get into car lic number 268-FYN and drive away. Squad 197 officer Cooper stopped the car for us and ID the driver with a Minnesota drivers license as CARLSON, RONALD LEIGH 30380 STACY MN DOB 06-19-39 . Phone 462- 5108 . I spoke to Carlson to conduct a investigative stop. I asked CArlson what he was doing at 1171 Jackson? Carlson stated that he was at a Sales meeting for some Health and__Beauty_ products . I informed Carlson that I thought he was lying to me because I spoke to someone yesterday after they left 1171 Jackson- and- the�.told me - the same thing at first and then they told me they had got a blow . job and a massage for $150 . 00 . Calson then stated that he-to had- received a Massage from a young woman but he only paid $50 . 00 and that he did not have any type of sex act . Carison- stated--that-he------ --- was offered something more for an additional $100 . 00 but he declined and left . I was then informed that- other officers��were� --- -- executing the warrant and I released Carlson. After entry was made I assisted in searching for items listed on �the warrant . In the linen closet _ that was outside of the bathroom I recovered a Red Mead 3 subject notebook and a 5x5 Brown plastic Phone address book. These items were turned over to inventory sergeant Kumagai. Sergeant Kumagai listed these item as items number two on the inventory return sheet . I then assi'sted Sergeant Tredal in the North West bedroom. This room was very messy. There were clothes thrown around on the - floor_ There was also numerous pornographic books. lying. around on ___ the floor. Paul Dear Ms . Kujawa: I am in receipt of information that could lead to adverse action against your licenses at the above-named premises . The basis for � the adverse action is that : On May 31, 1996, an undercover St. Paul police officer entered the above named establishment for a previously booked session for a massage that included exotic dancing in lingerie. During the session the dancer/masseuse undressed and responded to the officer that the fee did include engaging in sexual intercourse. A search warrant was executed. Among the items recovered were a rolodex with customer's names, customer appointment schedules, work calendars and schedules, x- rated videos, condoms and empty condom wrappers, 2 electric penises, a double headed penis, and various items of lingerie. These items were recovered from the break room/ dressing room, TV room and from an end table � by the telephone. The actions of the employee ' along with the items recovered from the � premises constitute probable cause that the licensee was iavolved in the promotion of prostitution on the licensed establishment. During the session the dancer/masseuse uadressed and responded to the officer that . the fee did include engaging in sexual intercourse. A search warrant was executed. Among the items recovered were a rolodex with customer' s names, customer appointmeat schedules, work calendars and schedules, x- rated videos, condoms and empty condom wrappers, 2 electric penises, a double headed penis, and various items of lingerie. These items were recovered from the break room/ dre8sing room, TV room and from an end table by the telephone. The actions of the employee along with the items recovered from the premises constitute probable cause that the licensee was involved in the promotion of prostitution on the liceased establishment. . This constitutes grounds for adverse action against the licenses for the premises. You have the right to be represented by an attorney before and during the hearing or you can represent yourself . You may also have a person of your choice represent you, to the extent not prohibited as unauthorized practice of law.
