96-1513 ``'� ' ` � � � ���� � Council File # �b —` S 1� Green Sheet # y O \ ' RESOLUTION . - C Y F SAI UL, MINNESOTA � Presented By Referred To Committee: Date 1 2 WHEREAS, for many years, the City of Saint Paul and Ramsey County have sought to s merge, under one governance and management structure, their respective Departments of Public 4 Health; and 5 6 WHEREAS, staff from the City of Saint Paul and Ramsey County have proposed a Joint � Powers Agreement (JPA) to initiate the merger process via a purchase-of-service contract; and s 9 WHEREAS, The Saint Paul City Council has reviewed and approved the JPA, as amended lo by its Resolution #96-583, dated July 3, 1996, and forwarded the amended JPA to the Ramsey �� County Board of Commissioners; and 12 ls WHEREAS, The Ramsey County Board of Commissioners held a subsequent policy i4 discussion on the City's amendments to the JPA at its meeting of August 13, 1996; and 15 i6 WI�REAS, The Ramsey County Board of Commissioners approved Resolution #96-354 1� on August 27, 1996, "Bringing together the two Public Health Departments; identifying areas of 1s concern in Governance, Property, Term, Termination, and Personnel; and calling for meetings �9 between the Board and City Council to form a working committee of elected officials to negotiate 2o the differences on this issue."; and 21 22 WHEREAS, To reconcile the two approved JPAs, the City Council and County Board have 23 jointly met on several occasions and discussed the JPA; and 24 2s WHEREAS, The main areas of difference between the City and County have included term 26 and termination, service priorities and assurance process, governance, and property; and 27 2s WHEREAS, Issues relating to the personnel impacts of the proposed JPA have been 29 discussed by members of the two bodies; and 30 31 WHEREAS, City Council and County Board members have reaffirmed their support for the 32 JPA as the method to bring together their respective Departments of Public Health; and 33 34 WHEREAS, City Council and County Board members, in setting their 1997 proposed 35 levies, have each agreed to include half-year funding of$1,009,736 for a Joint Powers 36 Agreement, to support the merger under one governance and management structure, their 3� respective Departments of Public Health; and 38 40 `��.-� s �� 4i WHEREAS, City Council and County Board members present at the November 25, 1996, 42 joint meeting directed staffto prepare a resolution outlining areas of compromise and reaffirming 43 their joint commitment to continuing discussions regarding their respective Departments of Public 44 Health; and 45 46 WHEREAS, City Council and County Board members further directed staffto prepare this 4� resolution for their review and action prior to their next joint meeting; 48 49 NOW, THEREFORE, BE IT RESOLVED that the Saint Paul City Council and the 49 Ramsey County Board of Commissioners instruct their respective staffs to continue their work 5o with employee representatives to identify and develop solutions for personnel issues that have si been identified by employees and their representatives; and 52 53 BE IT FURTHER RESOLVED, that the Saint Paul City Council and the Ramsey s4 County Board of Commissioners hereby agree to the following conditions regarding term and 5 5 ternunation: 56 s� The initial term of the JPA shall be five years from the date ss of complete execution of the Agreement. This JPA will 59 automatically renew for additional ten-year terms, unless 6o written notice of intent not to renew is provided by either 6� party to the other, at least one year prior to the end of the 62 term then in effect. In such a case, the agreement shall 63 expire at midnight on the last day of the term then in effect, and 64 65 BE IT FURTHER RESOLVED, that the Saint Paul City Council and the Ramsey 66 County Board of Commissioners hereby agree to the following conditions regarding service 6� priorities and assurance process: 68 69 1) The Saint Paul-Ramsey County Department of Public Health will complete The �o Community Health Services Monitoring Working Document and present it to the City �� Council for review and comment in July, 1997, and in March and September of each �2 subsequent year thereafter. 73 �4 2) The 5aint Paul-Ramsey County Department of Public Health will complete the update �s to the Saint Paul-Ramsey County Community Health Services Plan and present it to �6 the City Council for review and approval in September, 1997. The revised four-year �� plan and subsequent updates, along with service priorities identified within the Plan, �s will be presented to the City Council for review and approval in September, 1999, �9 2001, 2003, and 2005, and every two years thereafter throughout the term of the JPA. 80 81 3) The Saint Paul-Ramsey County Department of Public Health will annually present the s2 budgets for the operations of the services provided herein to the Saint Paul City s3 Council for review and comment, no later than the third week in November of the year s4 prior to the budget. 85 86 `� c�—�Si3 s� 4) The Saint Paul-Ramsey County Community Health Services Advisory Committee will ss monitor the Saint Paul-Ramsey County Community Health Services Plan, Plan s9 Update, Monitoring Working Document, and annually submit their assessment of the 90 implementation to the County Board and City Council, and 91 92 BE IT FURTHER RESOLVED, that the Saint Paul City Council and the Ramsey County 93 Board of Commissioners hereby agree to the following conditions regarding governance: 94 95 In the event that the City of Saint Paul wishes to increase service levels beyond that called 96 for in the Saint Paul-Ramsey County Community Health Services Plan or the annual budget, 9� the City may purchase an increase in the level of a service by paying the cost for the 98 services to the County. The County shall have the authority to deliver any such increased 99 services on behalf of the City, and. 100 ioi BE IT FURTHER RESOLVED, that the Saint Paul City Council and the Ramsey County �02 Board of Commissioners hereby agree to the following conditions regarding property: 103 l04 The City of Saint Paul will convey the City Public Health property (555 Cedar Street) to �05 Ramsey County. If the County wishes to use the building for a non-County purpose, the �06 County will present the proposal to the City Council for an advisory vote. If the JPA is not io� renewed, the County will convey the building back to the City, and the City will los reimburse the County for its share of any capital improvements.
