Lamers - by Joseph Lamers, son SUBJECT: Request waiver of vacant building registration fees because of financial hardship. APPEAR.ANCE : Joseph Lamers • -2- 10/10/78 - Meeting No. 144 . . , PROCEEDINGS: , .�; t:_ ���,�.� Mr. Lamers explained that his father, who had lived in the duplex for 20 years , was �8 years old, had an income of $285 per month from social security, and was now living with his daughter. Joseph Lamers said attempts were being made to sell the property, but these effoxts were at a standstill at present because of a legal problem. A prospective buyer, Michael Maxim, had put .down earnest money and had been given the abstract for examination. After failing to appear at three successive closing dates to complete the sale, Mr. Maxim had refused to accept the return of his earnest money and had not returned the abstract papers, The Lamers family was in process of suing for return of the abstract, but could not sell the property until the matter was settled. Steve Roy stated that the building was determined to be vacant, officially, by his department as of June 1, 1978. Payments due amounted to $110, cover.- ing the period up to December 1 , 1978. BOARD ACTION: � Chairman Wozniak moved that the vacant building registration fees due for the period of Friedrich Lamers ' ownership be waived. Mr. Heider seconded. MOTION CARRIED AND SO ORDE RED. THE VOTE : Ayes - 4 Nayes - 0 Abstentions - 0 � -4- 10/10/78 - Meetin g No. 144 APPEARANCE: Michael P. Maxim PROCEEDINGS: Chairman Wozniak asked Mr. Maxim how many buildings he owned, and Mr. Maxim said he owned six. Chairman Wozniak explained the vacant buildin� ordinance , noin tin� out that the Board' s authority to grant a waiver was limited to cansiderations of financial hardship. It did not seem to him that payment of the fees could be such a hardship to Mr. Maxim because of his substantial hoZdings. The purpose of the ordinance was to spur activity in rehabilitation, to elimin ate them as targets for van dalism and to improve the general appearan ce of the neighborhood. If an owner could not afford to do the necessary work in a reasonable time, he should sell it to someone who could. Mr. Maxim said he had worked full time on his pronerties for the past year and ahalf. He had been hampered by a shortage of sheetrock materials in completing the project at 547 Ashland, but was now ready to proceed and would have it ready to rent in a matter of two or three weeks. As for 611 Holly, he had recently listed it with a realtor to be sold. Tf a satisfactory sale could not be accomplished in a short time, he would start rehabilitation there as soon as 547 Ashlan,d was completed. Steve Roy reported that several notices had been sent to Mr. Maxim in regarc� to keeping grass an d tall weeds cut at these properties. In addition, 611 Holly was not kept secured, although notices had been sent from time to time . The city' s contractor was sent out to board up openings seve raI times . Mr. Maxim said he had used 611 Holly to store some of his materials , and had attempted to keep it boarded up, but neighborhood children frequently tore boarding off. - Mr. Tieso asked if he didn' t think he owned more buildings than he could handle and if it might not be best to sell some of them. Mr. Maxim agreed this was probably true, that originally he had had two partners, but they had removed themselves from the projects , leaving Maxim with the entire lo ad. He said he had already sold one of the properties the original group had owned. Steve Roy said there was a total of $165 in fees due on 611 Holly as of October 8, 1978, and $115 on 547 Ashlan d as of October 4 . Chairman Wozniak asked Mr. Maxim what his schedule was regarding rehab work on the two properties being appealed. Mr. Maxim said he had listed both of them for sale. If they didn� t sell, he would begin work within two weeks on 611 Holly. At 547 Ashlan d, he felt he could begin work within two months . BOARD ACTION• Mrs. Peake moved to deny the appeal, based on her opinion that the buildings were being held an speculation for sale at a profit. Mr. Tieso seconded. MOTION NOT CARRIED. Maxim must either start work on both properties or the fees du� would become payable. If the properties should be sold during the o�-day period, fees due would also become payable. Alice Bijjani commented that Mr. Maxim could not obtain a building permit ��.�i�ss the fees presently due were waived by the Board. ���ve Roy asked the Board, if it granted a 60-day suspension of payment, i;o make clear that a building permit could not be taken uut by anyone atner than Mr. Maxim during the period. If either buildinb was sold�, suspension w�uld not carry over to the new owner, and all accumulated fees °�vou3.� become payable before he could obtain a permit. Mr. Roy said t�hat, u.�der the terms the Board was discussing, fees would stop accumulating at tlie poi.nt when permits were taken out. At the end of the 60-day period, the Board would make a decision on whether Mr. Maxim would have ta pay the fees. �hairman Wozniak stated that, as Mr. Maxim was getting married December 9, which would be the approximate end of the 60-day period, Mr. Roy should contact Mr. Maxim around December 1 to arrange an inspection for a report on pro�ress to the Board at its December 12 meeting. ! BOAR;� ACT I ON: Chairman Wozniak moved to grant a 60-day suspension on payment of accumulated vacan t building fees, an d an inspection of the two properties was to be made by Mr. Roy about Decembe� 1, with a report by Mr. Roy to the Board to be made at the December 12 meeting.
