WHEREAS, Auto Body Maintenance, A division of Acryl T.M. , Inc. ,
has applied for a license for an auto body repair shop at 71 West
Annapolis; and
WHEREAS, it was the recommendation of the License Inspector
that the license be denied because the property was not zoned for
the intended auto body repair use; and
WHEREAS, at a hearing before the License Committee on October 25 ,
1978, evidence was presented that a si.milar non-conforming use was
in operation on the subject premises at the time of the enactment
of the St. Paul Zoning Ordinance and has been in operation within
365 days of the date this license application was made; and
WHEREAS, authorization for the continuance of a non-conforming
use is set forth in Section 62.102 of the Zoning Ordinance; and
WHEREAS, it was agreed by the License Committee and the applicant
that no heavy auto repair work or entire paint jobs be conducted on
the subject premises.
NOW THEREFORE, BE IT RESOLVED by the Council of the City of
Saint Paul, that an auto body repair license be issued to Auto Body
Maintenance, a division of Acryl T.M. , Inc. , for the premises located
at 71 West Annapolis, St. Paul, Minnesota, subject to the condition
that no heavy auto body repair work or total car painting be conducted
on the premises.
