15881, approved August 29, 1975, entitled
"An Ordinance adopting a new Zoning Ordi-
nance for the City of Saint Paul, repeal-
ing Chapters 60, 61, 62, 63 and 64 of the
Saint Paul Legislative Code and the Zoning
Map of the City of Saint Paul.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the Zoning Map of the City of Saint Paul, Sheet No. 27,
as incorporated by reference in Section 60 . 401 of the Saint Paul
Legislative Code, is hereby amended as follows:
That property owned by M/A Associates, Inc.
located on the south side of Watson between
Drake Street and Osceola Avenue more particu-
larly described as Lot 4, Block 7, Finch' s
Addition is rezoned from RT-2 to 2-1.
Section 2.
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

WHEREAS, the Division of Housing and Building Code Enforcement'has
requested the City Council to hold a public hearing to consider the
advisability and necessity of the correction or wrecking and removal of the
. following described building, said structure having been reported to
constitute a public hazard:

Inasmuch as the conditions outlined above constitute a public hazard and
the owner has made no attempt to satisfactorily repair the damage despite
our warnings, and the continued vacant and boarded up condition contributes
a blighting influence on the neighborhood, it is the recommendation of
this Division that this matter be referred to the City Attorney' s office
for razing and removal through District Court proceedings.

This is written in response to the petition of M/A Associates, Inc. to rezone '-
' property located at 622 Watson Avenue, on the south side of Watson between
Osceola and Drake, from RT-2 (Townhouse-Residential ) to I-1 (Light Industrial ). !�
The request was filed on a consent form petition. This rezoninq would allow
�
expansion of the existing M/A Associates building and would accommodate �'
additional warehouse and manufacturing space. �,
This matter was heard before the Current Planning and Zoning Committee on ";
August 3, 1978. There was no one present in opposition. Three neighbors
. spoke in support. Staff recommended that the petitioner's request be approved,
based on findings that there would be no substantial detriment to the adjacent
residential property and that the I-1 zoning is an appropriate land use of the
site. A representative of M/A Associates agreed to accept the setback regu-
lations req uired by the Zoning Ordinance.
On August 11 , 1978 the Planning Commission unanimously confirmed the Current �
Planning and Zoning Committee's recorronendation to approve the rezoning. '
This matter is scheduled to be heard by the Saint Paul City Council on October
5, 1978. �

PRESENT: Mmes. Summers, Karns and Nelson, Messrs. Pangal and Bryan of the
Current Planning and Zoning Committee; Mr. Robert Straughn, Assistant City
Attorney; Mr. Richard Amey of the Division of Housing and Building Code
Enforcement; Mmes. McNeally and Fox, and Mr. Rob Salmon of the Planning Staff.

The meeting was chaired by Mr. James Bryan, the Chairman.
M/A ASSOCIATES, INC. (#8322): A petition to rezone from RT-2 to I-1 property
located on the north side of Watson between Drake and Osceola (634 Watson).
The petitioner was present. There was no opposition present at the hearing.
Ms. McNeally showed slides of the subject site, and read the staff report
recommending approval of the rezoning request.
Mr. Joseph L. Melzarek, Attorney, with offices at 500 Degree of Honor
Building, said he represented the petitioner, M/A Associates, Inc. P�r.
Melzarek then proceeded to give specific reasons for the rezoning request.
He said access would not be on private property, but off the Drake Street
address, and the alley and Watson Street would not be used. He mentioned
that Mr. Harold Specktor, the contractor, and Mr. Mike Jackson of M/A
Associates were both present to answer any questions. He said the pictures
shown by Ms. McNeally had not been able to depict the condition of the
building a year ago, and since then the building has been brought up to
code, and M/A Associates will accept the setback regulations.
Ms. Summers made a motion to recommend approval of the rezoning request. The
motion was seconded by Ms. Nelson and passed on a unanimous 5 to 0 roll call
vote.
Mr. Bryan stated that because there was no opposition from neighbors, no
substantial detriment to adjacent residential property, and because the I-1
is an appropriate land use of the site, the reco�ronendation to the Planning
Commission for their August 11 ,1978 meeting would be for approval of the
rezoning request.

A. SUFFICIENCY: The applicant's request was filed on a consent form petition subscribed

B. PURPOSE: To rezone from RT-2 (Townhouse-Residential ) to I-1 (Light Industrial ) to
permit expansion of M/A Associates' warehouse.
C. FRONTAGE & AREA: The lot has 38 ft. frontage on Drake and is 126 ft. deep, for an
approximate area of 4,788 sq. ft.
D. SIT� COPJDITIONS: The site is vacant and overgrown. Above street grade, it slopes
own to t e south. Adjacent to the north is a single family house; across Watson
to the east is Rustic Furnishings; adjacent to the south is a vacant, fenced lot
owned by M/A Associates; across an alley to the west is property owned by Lametti
Construction. M/A Associates' building is situated at the northwest corner of
Drake and Watson.
E. AREA CONDITIONS: The area is a mixture of residential and industrial uses. The
railroad yards and the brewery dominate the area to the south of the site.
F. FTWDINGS:
1 . The site was previously zoned Heavy Industry.
2, ?�e site adjoins I-1 to the north, south and east.
3. M/A Associates owns Lots 1-4. Lots 1-3 are zoned I-1 ; Lot 4 is zoned RT-2.
M/�. Associates proposes to expand the existing warehouse onto Lots 3 & 4,
both of which are vacant.
4. The �istrict 9 Land Use Plan proposes a mixture of Commercial/Business use
for the site, with Industrial use adjacent to the east.

F. FINDINGS: (cont'd) �
5. Mr. Melzarek, attorney for the applicant, states that the proposed
expansion will include a covered drive from Drake; neither the alley
nor Watson would be used for access. This coupled with the fact
that Drake is a truck route should minimize impact on neighboring
residential property.
6. Use of the lot for residential development appears unlikely, given
the proximity to Industrial use, the size of the lot (38' x 126' ),
and the zoning (RT-2).
7. Warehouse use would appear to be less offensive to adjacent residential
use than some other permitted uses in an I-1 zoning district. �
8. Some of the uses permitted in an I-1 district might have a detrimental
impact on the adjacent neighborhood.
G. STAFF RECOMMENDATION:
Based on Findings 1-7, Staff recommends approval of the rezoning.
