nance for the City of Saint Paul, repeal-
ing Chapters60, 61, 62 , 63 and 64 of the
Saint Paul Legislative Code and the Zoning
Map of the City of Saint Paul.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the Zoning Map of the City of Saint Paul, Sheet No. 23,
as incorporated by reference in Section 60. 401 of the Saint Paul
Legislative Code, is hereby amended as follows:
Property owned by John Schneider, proprietor of Posey�
Miller Florist, located at 1767 Old Hudson Road, the
north side of Old Hudson Road between White Bear and
Kennard, more particularly described as Lot 1, Block 4,
and Lots 5 , 6 and 7, Block 3, Keltings: Addition, is I
rezoned from R-3 to B-3.
Section 2.
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

This is written in response to the petition of John Schneider, Proprietor of Posey- ��
Miller Florists & Greenhouses, at 1767 Old Hudson Road, on the north side of Old ;'
Hudson Road between White Bear & Kennard, from R-3 (Single Family Residential ) to ;j
B-3 (General Business) . The rezoning will allow replacement of an energy inefficient +
greenhouse.

This matter was heard before the Current Planning & Zoning Comnittee on August 3, 1978. '�
There. was no neighborhood opposition; however, there was concern on the part of the ��
City Staff and the Current Planning & Zoning Comnittee members that a B-3 zoning may :�
not solve the problem of the greenhouse operation as a nonconforming use. The reason
. for this concern was that greenhouses are first permitted in an I-1 district, whereas ;
"plant material nurseries" are permitted as a special condition use in a B-3 zone. �
The Current Planning & Zoning Committee recormnended approval of this request on a vote �
of 5 to 0, based on the finding that the proposed use of the new greenhouse being :
constructed would be more like a plant material nursery (most plants would be brought �
in rather than grown on the site) than a greenhouse (where most plants are started =
from seeds) . ,
On August 11 , 1978 the Planning Commission unanimously confirmed the Current Planning
& Zoning Committee's recort�nendation to approve the rezoning, based primarily on the
findings that:
1 ) Rezoning the site to allow reconstruction of a more energy efficient greenhouse
would not have a detrimental effect on the area.
2) Although "greenhouse" is first specifically mentioned in an I-1 district, the
proposed greenhouse would also be an accessory structure customarily incident �t
• to the operation of a plant material nursery as allowed in Section 60.503(f) .

On September 8, 1978 the Planning Commission approved the initiation of a "40 Acre Study" 'i
which includes studying the possibility of making g�eenhouses a permitted use or
use subject to special conditions in a B-3 or B-2 zone. �

The City Council has scheduled a hearing on this matter on October 5, 1978. �:

The meeting was chaired by Mr. James Bryan, the Chairman.
POSEY-MILLER FLORISTS (�8323) : A petitfon to rezone from R-3 to B-3 property �
located at 1767 Old Hudson Road. �
The petitioner was present. There was no opposition present at the hearing. �
Mr. Salmon read the staff report recommending approval of the rezoning request
and showed slides of the subJect site. '
Mr. Straughn cortmented on Finding �4 of the Staff Report, saying greenhouses as �
such would not be permitted as an accessory use and that the proper zontng for '
"greenhouses" is I-1 . ,`

Mr. Bryan said this would be a continuing legal nonconforming use, and he asked �
Mr. Straughn whether the nonconforming use would be able to continue if changed i
� �;; to B-3. Mr. Straughn said the nonconforming use would be able to continue but �
Posey-Miller would not be able to expand their existing structure.
Mr. Amey said a B-3 zoning might make it conforming.
Mr. Pangal inquired, since neighbors were notified this would be a B-3 zone,
would they have to be renotified if it is to be considered an I-1 zoning?
Mr. Straughn said an 1-1 petition would be needed and brought before the Committee.

Mr. John A. Schneider, 400 Flandrau, one of the owners of Posey-Miller Florists. �
said his is a family owned business. He said he has been trying to tear down the ':
structures built many years ago and trying to get his costs down because of the
high cost of heating these old structures. He has seven full-time and 7 part- �
time employees. He said he is trying to get a more energy efficient operation
and trying to clean up the area. i
Mr. Pangal asked whether there would be any problem for Mr. Schneide� in obtaining �
a new consent petition to come in with industrial , and Mr. Schneider said it is �
a matter of time. as everythTng is ordered in the fall , and delay would force him (
to lay off or fire 3/4 of his crew.

Mr. Pangal inquired if the Committee could approve B-3 and Mr. Schneider could ,
come in later with an I-1 request, but continue to build and replace his greenhouse �
on the basis of B-3 zoning. �
Mr. Straughn said the Zoning Administrato� would have to make a determination
:,���; that the use to whlch the property was being put would be a permitted use and
grant a butlding permit.

M�. Amey said the Zoning Administrator would take the position that storage of
!� the plants is a permitted use as an accessory use to the retail sales and a
permlt would be granted. He said an agreertaent could be reached whereby Mr. Schneider
couid do whatever growing he does in the exlsting greenhouse. Mr. Schneider
said he is not changing anything; that he is growing the same thing they have
grown for the past 40 years.
Mr. Warn. as a point of information, told the Cannittee that gree�houses had been
a permitted use under the "A" Residence district in the 1922 ordinance. Most
existing greenhouses in the city are B-3 or less� Mr. Warn said, and would therefore
be nonconforming under a strict inte�pretation of the zoning ordinance.
Mr. Pangal said if Mr. Schneider does not tear down the greenhouse and will continue
to grow in the greenhouse, he could quality under B-3. Giving Mr. Schneider B-3
zoning at this time would resolve nothing because Mr. Schneider wouid still be
in the same position as nav. There would be a question as to whether the Zoning �
Administrator could give a permit for building on the basis of the City Attorney's
opinion and Mr. Schneider's statement.
Ms. McNeally said testimony had shown that 9� of the building wi)1 be used as
plant material nursery� which is aliowed in B-3. �
Mr. Amey said any growing that is done will be done in the old greenhouse as a
legal nonconforming use before Mr. Schneider dismat�tles it. If not rezoned to I-1 � �
then he could not have a new building to grow plants in under the existing ordinance.

� Mr. Schneider said the greenhouse is mainly a holding house. but 10� of the materials �
�'� is for growing� and due to heating costs. he may have to move out of the city unless I
rezoning is possible.
�
Mr. Amey said this would seem to be an enforcement problem.

Ms. Sunmers� asking for clarification, inquired whether there were two greenhouses ;
one of which will be torn down, and Mr. Schneider said a new one will be built in
a different manner� and will be about 9000 sq. ft. Ms. Summers said the Committee '
could give Mr. Schneider a B-3 zoning and meanwhile he could do what he can for his (
business and then the Ordinance could be changed, or Mr. Schneider could submit a request
for 1-1 . Mr. Bryan told her this was the case. �
Mr. Pangal then made a motion to reca►mend approvai �f the rezoning requests saying �
the Committee agreed with the rezoning because the 10'�o growing operation is going �
to be in the existing structure� so Mr. Schne�de- should therefore have no problem� '

Mr. Straughn advised Mr. Schneider that grant3ng a B-3 may cause him uncertainty a$ i
he may not be able to operate the gree�house for 4�-owing plants until such time as
it is rezoned to 1-1 . A building permit may allow construction, but would not allow �
its use for growing plants. �-:
Mr. Bryan suggested that the petitioner get together with the Zoning Administrator
for proper advice.
The motion was seconded by Ms. Summers and passed on a unanimous 5 to 0 roil call vote.

We have been doing business as a retail florist under the name of Posey-Miller �
Florist since 1945, using the greenhouses which were in exi�tence on the propetity �
at that time. These greenhouses were originally built in 1895 and although we have r
tried to keep them effic�Lent through repairs it is now imperative that they be re- .p.
placed economy-wise and energy-wise. 1

Our plans are to replace the existing long cement and glass houses with gutter !
connected �reenhouses constructed of steel frame work, fiberglase sidewalls and a �
roof of 2 layer of 6 mil poly with a.ir in between for insulation. This type of green- �
house has been proven to be the most energy efficient and strongest type of contr- !
uction.
With the changes we propose, we will be saving considerably on fuel for although }
we will keep our same heating system of low pressure steam generated by oil, the
buildings will be constructed for o eater energy efficiency. We will also be doing
away with glass which besided needing constant replacement, is dangerous on whieh to
work. +

There will also be less pollution created by the use of chemicals in fertilizing
and sterilizing soil due to the construction of these new buildin�s.
Along with the economical benefits of our proposed changes, we feel we will be �
adding to the asthetic value, of our property. The new greenhouses will blend with {
our present steel constructed retail building. Although when completed the build- �;
ings will be arranged differently from our present ones, the growing area will be €
�,:
as lar�e and will mean no reduction in employment. !

This is written in response to the petition of John Schneider, Proprietor of Posey-
Miller Florists & Greenhouses, at 1767 Old Hudson Road, on the north side of Old
� Hudson Road between White Bear & Kennard, from R-3 (Single Family Residential ) to
B-3 (General Business) . The rezoning will allow replacement of an energy inefficient
greenhouse.
This matter was heard before the Current Planning & Zoning Committee on August 3, 1978.
There. was no neighborhood opposition; however, there was concern on the part of the
City Staff and the Current Planning & Zoning Committee members that a B-3 zoning may
not solve the problem of the greenhouse operation as a nonconforming use. The reason
. for this concern was that greenhouses are first permitted in an I-1 district, whereas
"plant material nurseries" are permitted as a special condition use in a B-3 zone.
The Current Planning & Zoning Committee recommended approval of this request on a vote
of 5 to 0, based on the finding that the proposed use of the new greenhouse being
constructed would be more like a plant material nursery (most plants would be brought
in rather than grown on the site) than a greenhouse (where most plants are started
from seeds) .
On August 11 , 1978 the Planning Commission unanimously confirmed the Current Planning
& Zoning Corrannittee's recorrnnendation to approve the rezoning, based primarily on the
findings that:
1 ) Rezoning the site to allow reconstruction of a more energy efficient greenhouse
would not have a detrimental effect on the area.
2) Although "greenhouse" is first specifically mentioned in an I-1 district, the
proposed greenhouse would also be an accessory structure customarily incident
- to the operation of a plant material nursery as allowed in Section 60.503(f) .
On September 8, 1978 the Planning Commission approved the initiation of a "40 Acre Study"
which includes studying the possibility of making gxeenhouses a permitted use or
use subject to special conditions in a B-3 or B-2 zone.
The City Council has scheduled a hearing on this matter on October 5, 1978.

The petitioner was present. There was no opposition present at the heari�g. •

Mr. Salmon read the "staff report recommendi�g approval of the rezoning request ;
and showed slides of the subJect site. •
Mr. Straughn commented on Fin�ing �4 of the Staff Report, saying greenhouses as #'
such would not be permitted as� an accessory use and that the proper Zoning for '�
"greenhouses" is f-1 . j

Mr. Bryan said this would be a continuing legal nonconforming use� and he asked �
Mr. Straughn whether the nonconforming use would be able to contlnue if changed �''
},�,,;� to B-3. Mr. Straughn said the nontonforming use would be able to continue but �'
Posey-Miller would not be able to expand their existing structure. ,
Mr. Amey said a B-3 zoning might make it conforming.
Mr. Pangal inquired� since neighbors were notified this Mwuld be a B-3 zone�
would they have to be renotified if it is to be considered an I-1 zoning?
Mr. Straughn said an I-1 petition wouid be needed and brought before the Comnittee. '

Mr. John A. Schneider, 400 Flandrau, one of the owners of Posey-Miller Florists� �
said his is a family owned bustness. He said he has been trying to tear down the
structures built many years ago and trying to get his costs down because of the �'
high cost of heating these old structures. He has seven full-tione and 7 part-
time employees, He said he is trying to get a more energy efficient operatio� `
and trying to clean up the area.

Mr. Pangal asked whether there would be any problem for Mr. Schneider in obtaining ;�
a new consent petition to come in with tndustrial , and Mr. Schneider said it is �,
a matter of time, as everything is ordered in the fall � and delay would forte him
to lay off or fire 3/4 of his crew. }�

Mr. Pangat inquired if the Committee could approve B-3 and Mr. Schneider could
cane in later with an I-1 request, but continue to build and replace his greenhouse �a
on the basis of B-3 zoning. �

Mr. Straughn said the Zoning Administrato� would have to make a determination
� ,� that the use to which the property was being put would be a permitied use and
�" grant a building permit.

Mr. Amey said the Zoning Administrator would take the positton that storage of
!'"'+ the plants is a permitted use as an accessory use to the retail sales and a
permit would be granted. He said an agreement couid be reached whereby Mr. Schneider
could do whatever growing he does in the existing greenhouse. Mr. Schneider
said he ts not changing anything; that he is growing the same thing they have
grown for the past 40 years.

Mr. Warn, as a point of information, told the Committee that greenhouses had been
a permitted use under the "A" Residence district in the 1922 ordinance. Most
existTng greenhouses in the city are B-3 or less, Mr. Warn said� and would therefore
be nonconforming under a strict interpretation of the zoning ordinance.
Mr. Pangal said if Mr. Schneider does not tear down the greenhouse and will continue
to grow in the greenhouse. he could quality under B-3. Giving Mr. Schnetder 8-3
zo�ing at this time would �esolve nothing because Mr. SchneTder would still be
in the same position as now. There would be a question as to whether the Zoning
Administrator could give a permit for building on the basis of the City Attorney's
opinion and M�-. Schneider's statement.
Ms. McNeally said testimony had shown that 9�% of the building will be used as
plant material nursery, which is allowed in B-3. �
Mr. Amey said any growing that is done will be done in the old greenhouse as a
legal nonconforming use before Mr. Schneider dismahtles it. If not re=oned to I-1 ,
then he could not have a new building to grow plants in under the existing ordina�ce.
� Mr. Schneider said the greenhouse is mainly a holding house� but 1� of the materials
�`'� is for growing, and due to heating costs, he may have to move out of the city unless �
rezoning is posslble. �'
Mr. Amey seid this would seem to be an e�forcement problem. �

Ms. Summers� asking for clarification� inquired whethe� there were two greenhouses
one of which will be torn down, and Mr. Schneider said a new one will be built in
a dtffe�-ent manner, and will be about 9000 sq. ft. Ms. Summers said the Committee '
could give Mr. Schneide� a B-3 zoning and meanwhile he could do what he can for his �
business and then the Ordinance could be changed� or Mr. Schneider could submit a request �
for 1-1 . Mr. Bryan told her this was the case. j

Mr. PangaA then made a motion to recommend approval of the rezoning request, saying �
the Committee agreed with the rezoning because the 10'� growing operation is going I
to be in the existing structure, so Mr. Schneider should therefore have no problem. I
Mr. Straughn advised Mr. Schneider that granting a B-3 may cause hii� uncertainty as �
he may not be able to operate the greenhouse for growing plants until such time as
it is rezoned to I-1 . A building permit may allow constructfon, but would not allow �
its use for growing plants.
Mr. Bryan suggested that the petitioner get together with the Zoning Administrator
for proper advice.
The motion was seconded by Ms. Summers and passed on a unanimous 5 to 0 roll cali vote.

We have been doing business as a retail florist under the name of Posey-Miller ;
Florist since 1945, usin� the greenhouses which were in existence on the propetity ;
at that time. These �reenhouses were originally built in 1895 and elthough we have ;
tried to keep them efficcLent through repairs it is now imperative that they be re- ;�
placed economy-wise and energy-wise. ;�
Our plans are to replace the existing long cement and glaes housea with gutter �
connected greenhouses constructed of steel frame work, fiberglass sidewalls and a '.�
roof of 2 layer of 6 mil poly with air in between for insulation. This type of green-
housse has been proven to be the most energy efficient and strongest type of contr- �
uction. �

With the changes we propose, we will be saving considerably on fuel for although �,
we will ke�p our same heating system of low pressure steam generated by oil, the ,
buildingQ �"_ be constructed for greater energy efficiency. We will also be doing '!
away witYx ��a,ss which besided needing constant repiacement, is dan�erous on which to ;
work. '�

There will also be less pollution created by the use of chemicals in fertilizing ;;
and stexilizing soil due to the construction of these new buildin�s. %

Along with the economical benefits of our proposed changes, we feel we will be i�
adding to the asthe+.ic value, of our property. The new greenhouses will blend with '
ou� oresent steel constructed retail building. Although when completed the build- 'j
ings will be arranged differently from our present ones, the growing area will be ��
�.s Tar�e and will mean no reduction in employment. ��
