The Council of the City of Saint Paul has conducted a public hearing upon the above improvement, due notice
thereof having been given as prescribed by the City Charter; and
WHEREAS, The Council has heard ail persons, objections and recommendations pertaining to said proposed improve-
ment and has fully considered the same; now, therefore, be it
RESOLVED, That the Council of the City of Saint Paul does hereby order that the above-described improvement
be made, and the proper City officers are hereby directed and authorized to proceed with the improvement; and be it
FURTHER RESOLVED, That upon the completion of said improvement, the proper City officers shall calculate
all expenses incurred therein and shall report the same to the City Council in accordance with Chapter 14 of the City Charter.

In February, 1976, the City Council adopted and approved the Community
Development (CD) Year II program for Irvine Park. The approved program,
as with other ITA areas, was adopted prior to completing a new city-wide
assessment policy adopted in September, 1976. The •grior policy did not
assess for alley �mprovements completed under a renewal program.
A condition of vacating Sherman Street. between Ryan Avenue and Exchange
Street in Irvine Park, required a grant of easement by HRA to the City
of St. Paul for an L-shaped alley. Current city-wide assessment poZic�
' requires all` new alley construction and/or reconstruction be assessed.
It is estimated the total construction cost for this alley will be
_ appr�xim�tely $1?,.500 inclu�lir.g ne�essary st.^7-m sewer insta2lation
Widening and construction of this alley primarily benefits the duplex
redevelopment currently being undertaken by Portfolio, Inc. , north-
westerly of Elm Street and Ryan Avenue as shown on Exhibit ''A"
attached. This alley improvement provides the only direc�t vehicle
access to approximately 50% of the dwelling units within the site .
including minimum access by emergency vehicles. Secondary benefit
to property owners on the other side of the alley is incidental at
� best, for although it provides direct vehicle access to their garages,

; this 'benefit` is at the expense of additional vehicular traffic

i beyond that generally typical of residential alley use.

' Per the land sale agreement with Portfolio Inc. , previous board
action committed HRA to pay only this developer's share (approxzmately
� 500) of this alley assessment.
Since the above alley was included as a part of the street improve-
ment program for CD Year II and since CD Year II funds were budgeted
and are available for its construction, staff recommends Board
authorization and approval to pay all above alley assessments from
' the Year II Community DeveloFment funds for Irvine Park.

This memo is supplementary to our previous memo from J. M��ler ,�.t $
� dated 3/8/78. In February, 1976, the City Council adopted and ,(';
approved the Community Development (CD) Year II program for Irvine ���
Park of which the above subject alley is a part. Attached, you
will find a copy of a recent Board report dated 4/20/78 whereby
the City Council acting as the HRA Board of Commissioners not only
reaffirmed their commitment to the previously adopted CD II program
for Irvine Park, but also authorized the above alley assessments
resultinq from its improvement to be ap id bv th�= Please note
the funds for design and��construction of this alley are included
in the CD II budget for Irvine Park.
Therefore, in accordance with past discussions with Jack Davis
; of your staff, we request the above L-shaped alley, includinq
necessary storm sewer work, be designed and constructed under the
1978 city-wide alley contract. 'rT� believ� th�s would be the
preferable approach so as not to delay improvement of the Irvine
Park streets previously des 'igned under P-0745. Also, HRA retaining
wall construction estimated to be completed by mid-July, 1978,
together, with the developer' s (Portfolio) final grading plan
(anticipated to be substantially completed by the end of July, 1978)
would pretty well establish the adjacent alley grades necessary for
this construction. Al1ey improvements undertaken by the .City are
to be in accordance with the usual City ' standards' typical for this
work as opposed to improvements of a 'historical' nature. If .
possible, �ve respectfully request the above alley improvements be
: undertaken and completed as soon after 7/31/78 as your Contractor's
schedule permits. •
