WHEREAS, pursuant to resolution, C. F. 271760, approved Septamber 18. 1978, a public h earing was duly held on September 28, 1978 before the Council of the City of Saint Paul, said hearing perta�ining to the condition of the structure at 849 Albermarle, Saint Paul, Minnesota; and WHEREAS, upon the facts presented at the said hearing consistinq of photographs, inspection reports and the recommendation of the Build-� ing Department, it is found and determined by the City Council that according to the records and files in the office of the Register of Deeds tha Trustee of Fee is James F. Greenstein, attorney-at-law, 206 Skyway North, American Federal National Bank Complex, St. Paul, MN 55101; the contract purchaser is Thomas F. Stellwag, 714 Fuller Ave,, St. Paul, MN 55104i Juanita W. D. Flynn has an unknown interestp Esther C. The aontinued vacant and boarded up co�dition contributes a bYighting influence on the neighborhoodt nowt therefore be it RESOLVED, That in accordance with Minnesota Statutes Sections 463,15 through 463.26, and based upon the foregoing findings of the City Council, the Council of the City of Saint Paul does hereby make tha following ORDER: ORDER 1. Unless such aorrective action is taken to comply with this Order or an answer served upon the City of Snint Paul and filed in the office of the C�erk of the District Court of Ramsey County, Minnesota within twenty (20) days fram the date of the service of this Order, a Motion for Summary Enforc��nt of this Order to raze �nd remove the said building will be made to the Ramsey County District Courtj 3. In the event that the building is to be razed by the City of Saint Paul pursuant to �udgment of the District Court, all personal property or fixtures of any kind which may unreasonably interfere with the razing and removal of this building shall be removed within ten (10) days from the entry of �udgmentj and if not so removed, the City of Saint Paul shall remove and dispose of such personal pro�perty and fixtures as provided by lawf 4. The owners of record are: Fee Owner: Esther C. Templeton-Trustees, 1968 Grand Avenue, St. Paul , Minnesota 55105 . and Contract Purchaser: Thomas F. Stellwag, 714 Fuller Avenue, St. Paul, Minnesota 55104 . The legal description of the property is: Ex Alley, Lot 4 , Block 2, McKentys Outlots. The building is a two and one half story residential structure of wood frame construction. The subject property has been boarded up by the city since August 1, 1978 . The building because of age, deterioration, lack of proper maintenance, fire damage and vandalism is deemed hazardous and beyond feasible rehabilitation and should be razed as soon as possible. Inasmuch as the conditions outlined above constitute a public hazard and £he owner has made no attempt to satisfactorily repair the damage despite our warnings, and the continued vacant and boarded up condition contributes a blighting influence on the neighborhood, it is the recommendation of this Division that this matter be referred to the City Attorney' s office for ��ing and removal �hrough District Court proceedings.
