RESOLVED, That pursuant to the authority of Chapter 25.2'k�,(4)
of the Saint Paul Administrative Code, the Council hereby approves
the final positions of the City, as set forth in the attached
letter of Mayor Latimer, for arbitration of collective bargaining
matters with the St. Paul Police Federation.

Re: 1979 Collective Bargaining Arbitration
Saint Paul Police Federation
Dear Council President Hozza:
The current collective bargaining agreement between the City of
Saint Paul and the Sairt Paul Police Federation expires
December 31, 1978 . For several months Mr. I�iartin Companion and
the City Negotiating Team have met with the Federation' s
negotiators in an attempt to conclude a mutually satisfactory
agreement for 1979 . Negotiations have now reached an impasse
as certified by the State Bureau of Mediation Services.
Pursuant to Chapter 25 .02 (4) of the Saint Paul Administrative
Code, the Council must approve the City' s final positions for
arbitration of this matter, and the following is a summary of
the positions of both the Federation and the City:
(1) 6�ages - The Federation requested a 15 .5 percent
increase in base salary at the rate of a five-
year patrolman. This request equals a 52 ,807 .Q0
annual increase across the board for Federation
members.
- The City has almost every bargaining unit
with which it deals under contract for 197Q, and
the percentage increase in wage settlement for
each unit varies from 5 percent to 6 percent.
Based on surveys of police officers ' salaries
across the land, we believe that our police
force ranks very high, and coupled with the
negotiated settlements with other units for 1979,
an increase in excess of those concluded seems
unwarranted.

(2) Vacations - The Federation has requested a 24 .7
percent increase in the vacation schedule .
- The City believes that the present
vacation plan is competitive, in line with other
public and private employer practices, and does
not merit change.
(3) Seniority - The Federation has requested an
assignment-by-seniority plan.
- The City contends that such a plan
invades a crucial management prerogative reserved
to it by the Public Employment Labor Relations Act
and Administrative Code. The police power of the
City would be damaged if it had to deal out
assignments based on geography and time. The City
will contend that seniority is not subject to
arbitration.
(4) Dental Plan - The Federation has requested a City-
paid dental plan.
- The City has indicated a willingness
to involve itself in such a plan, but consistent
with its position that increases in City-paid
fringe benefits be figured as part of any percentage
increase, has insisted that the Federation deduct
this cost from its wage settlement. The Federation
responded in the negative.
(5) Sick Leave - The City has noted that, besides the
15 days annual accumulation of sick leave that all
City employees earn, police officers (and firefighters)
are the beneficiaries of two separate Charter pro-
visions granting only them further forms of "sick
leave" for on and off the job injuries . Recent
statistics as to the use of sick leave by �employees
of the Federation indicate that it has become
excessive and therefore, the City has initiated a
proposal to restrict this abuse.
(6) Liability for Injuries Clause - The Federation and
City have attempted to establish a clear delineation
in the area of liability for injuries occurring on

and off duty. It has occurred that officers
who are retained by some private employer in
an off-duty capacity are injured and claim the
resulting injury is the liability of the City
on a theory that they were acting in a law-
enforcement capacity. The City has suggested
clear contract language to eliminate such
contentions in the future.
(7) Uniform Allowance - The City presently provides
a clothing allowance to the Federation and is
suggesting wordage that will preserve the City ' s
right to negotiate any new increases in this
�lothing allo�aance, and, further, to deduct the
cost of any increases from any negotiated
settlement.
In conclusion, the Federation has been forthright in their demands,
but based on comparable settlements, salary surveys, and the
economic status of the City, the administration cannot recommend
acceding to the Federation' s positions. I would appreciate your
support in confirming, by resolution, the above-listed policy
positions of the City so that appropriate staff may have authority
to proceed to arbitration with the Federation.
