In the matter of hazardous buildings
being that wood frame duplex and garage known
and described as 124 Charles in the City of
Saint Paul and situated upon those premises
legally described as Lot 7, Block 2, Whitney's
Subdivision according to the plat on file and
of record in the office of the Register of
Daeds in and for the County of Ramsey, State
of Minnesota.
WHFREAS, pursuant to resolution,, C. F. No. 271594, approved
August 3, I978, a public hearing was duly hel.d on August 24, 1978
before the Council of the City of Saint Paul, said hearing pertain-
ing to the condition of the structure located at 1Z4 Charles,
Saint Paulf Minnesotat and
WfiER�AS, upon the facts presented at the said hearing consisting
of phatographs, inspectian reports and the recommendations of the
Buil.ding Department, it is found and determined by the City Council
that according to the records and files in the office of the Reg ister
of Deeds the fee owners of the above described property are Charles
Fiolmes and Joyce Holmes, 4292 Brigadoon Drive, St. Paul, N1N 55112t
that IInil Fahl Jr., l.'�i97 Juno Avenue, St. Paul, MN 55116 is the
contract purchaseXs and that Twin City Leasing, Inc„ Ruben H.
Anderegg, President, 6975 Washington South� Edina, MN 55435 is an
unlisted contract purchasert and that First Southdale National Hank
is a mortgageef and that it is further determined that the above
building constitutes a hazardous building within the definition of
Minnasota Statutes Section 463.15 for the following reasons:

b. This building because of age, deterioration, lack of proper
maintenance and vandalism is deemed beyond feasible rehabilitation?
c. The owner has not provided a plan for the rehabilitation or
wrecking of this builcTing as raquired by the vacant building ordinance;
d. The conditions outlined above constitute a public hazardt
e. The owner has made no attempt to satisfactorily repair the
damages
f. The continued vacant and boarded up m ndition contributes a
blighting influence on the neighborhoodt
now, therefore, be it
RESOLVED, That in accordance with Minnesota Statutes Sections
463.15 through 463.26, and based upon the foregoing findings of the
City Council,. the Council af the City of Saint Paul does hereby make
the following Order:
� ORDER
I. The owners of the above described building shall make the same
safe and not detrimental to the public peace. health, safety and wel-
fare b havin the said building razed and the materials therefrom

removed from the premises within thirty (30) days from the date of the
s�rvice of this Orderj
2. Unless such corrective action is taken to comply with this
Order or an answer served upon the City of Saint Paul and filed in the
Office of the Clerk of the District Court of Ramsey County, Minnesota
within twenty (20) days from the date of the service of this Order, a
Motion for Summary Enforcement of this Order to raze and remove the
said building wil.I. be made to the Ramsey County District Courtf
3. In the event that the building is to be razed by the City of
Saint Paul pursuant to judgment of the District Courtr all personal
property or fixtures of any kind which may unreasonably interfere with
the razing and removal of this building shall be removed within ten (10)
days from the entry of judgment1 and if not so removed, the Cit� of
5aint Paul shall re m�ve and dispose of such personal property and fix—
tures as provided= by law;
4. If the City of Saint Paul is compelled to take any corrective
action herein� all necessary costs expended by the City will be assessed
against the above described real. estate and collectad as other ta�ses;
and be it
FURTHER RESOLVLD, that a certified copy of this resolution and
incorporated Order hrein be served upon the Iast record owners of the
above described property in the manner provided by law.
