SUBJECT:
Rec{uest waiver of certain St. Paul Legislative Code rec�uirements pertaining
to electrical service, because of financial hardship .

PROCEEDI�tGS :
Mr. Laurents related that the city electrical inspector had ordered one
additional convenience outlet in each kitchen, the removal of some . illegal
�viring in the basement, and had found the service overfused. Mr. Laurents
said that the location of the property is such that property values are
likely to drop severely in the near future , in tivhich case he would suffer
a big loss if he installed a completely new service . His contractor had
informed him that a new service would be necessary in order to add any
more outlets . Instead, Mr. Laurents proposed to have the illegal wiring
removed and tiaould have proper-sized fustats installed to remove the danger
from overfusing.
;�Ir. Heider said he assumed that what Mr. Laurents was reQuesting was a
�aaiver on the additional kitchen convenience outlets , to avoid the expense
of a new electrical service .
Frank Staffenson pointed out that there �aere various other items on the
inspection report which were not related to the electrical service , and
asked what progress had been made on these .
Mr. Laurents reported that• he had taken care of alI except No. 7, which
involved a loose vent pipe on the water heater; No. 18, loose or missing
wall plaster in a pantry; and No. 28 , plaster woxk in the other pantry .
He said these would be repaired as soon as possible . No. 26, plaster
repair had been taken care of in the second floor bathroom, b ut the
tenant did not want it painted. Mr. Laurents explained that he was try-
ing to encourage the tenant to move to a high-rise because it was difficult
to deal with him, but he would try to complete the repair as ordered.
BOARD ACTION:
Mr. Heider moved to grant a waiver of the requirement for an additional
convenience outlet in each kitchen, on condition that proper-sized fustats
be installed in the electrical service and improper wiring in the basement
area be removed. Mr. Tieso asked that an additional condition be included
in the motion, that a porcelain receptacle tvith a convenien ce outlet
feature be installed in the bathrooms . All corrections were to be completed
within b0 days . Mr. Glassman seconded. MOTION CARRIED AND SO ORDERED.

hardship .

PROCEEDINGS:
i�s . Needham said she had bought the property in June , 1977 , with the hope
of occupying it in the fall of 1977. She had expected to obtain funds
for rehabilitation from HRA, but because that agency had not received
the expected amount of federal money, her loan could not be given at that
time . The money had now been made available to HRA, but Ms . Needham
could not get a building permit because she was in arrears on payment
of the vacant building fees . HRA would not loan the money until an owner
presented a building permit and bids on the work to be done . She had been
advised by her architect that the vacant building ordinance tivas unconstitu-
tional and that she need not pay the fees . Subsequently she rece�ved a
ticket for non-payment, appeared in court, was found guilty and fined $50 .
She understood now that the architect' s advice was in error.
N1r. Tieso asked who at the Public Housing Agency, which operates under
HRA, was handling her loan application .
Ms . Needham replied that Gordon Juvele, at 1010 University Ave. , was her
contact in the matter. She also told the Board that she tivould find it
very difficult to pay the vacant building fees and penalties for delin-
quent payment. She had not yet paid her court fine .
Steve Roy said there was nothing the Board could do to eliminate the
court fine, but it was empowered to waive registration fees , which now
amounted to $165, including penalties . He thought the $50 fine had
probably been increased to $75 by the court because it was in warrant
by this time . The only person who could waive that was the judge .
Mr. Tieso suggested that Ms . Needham go before the judge an d explain
why she had ignored the city' s notice to pay vacant building fees- -that
it was due to poor advice on the part of her architect . He also asked
Ms . Needham to have Mr. Juvele write to the Board to inform them when
everything is set for rehabilitation to proceed.
Mr. Roy asked that the secretary route a copy af the HRA le tter to him
when received.
BOARD ACTION :
�4r. Tieso moved to grant a tivaiver of all past, present , and future fees
due the city of St. Paul under the Vacant Building Registration Ordinance .
Mr. �Ieider seconded. MOTION CARRIED AND SO ORDERED.

Chairman Wozniak reported that the Code Enforcement Division had recom-
mended the return of the filing fee to Clarence A. Lindeke on an appeal
on property at 583 Ashland, i�hich had been settled administratively.
(Case No. 3Z- 78-H} . Mr. Lindeke had withdrawn his appeal.
BOARD ACTION: Chairman �1�ozniak moved to return the filing fee to Clarence
A. Lindeke for his appeal on property at 583 Ashland. Mr. Heider seconcled.
