Request time extension of two years to install certa�n. fire-safety
devices , because of cost and, also, because of future consalidation with
another school , iJhich would mean vacating present building.

PROCEEDINGS :
Mr. Miller related that the school had been ordered to install stairwell
enclosures , fire-rated doors , and a smoke and fire de tection system..
Because of steadily decreasing enrollment, consolida�ion with another
nearby grade school would probably take place within two years and the
present building would be vacated. The church reauested a two-year time
extension on compliance because it was not feasible to make such costly
installations if the building would become vacant in such a short time .
He pointed out that there was an electronic system in use, which made it
possible to sound a fire alarm throughout the buildi�g by pressing a button
in the principal' s office or one located in the hall . There w as also a
fire station 130 feet away. The school was concrete and brick structure ,
and the heating plant and kitchen facilities �aere in a separate building .
Mr. Coleman asked how much it would cost to comgly with the city' s orders .
Mr. Miller replied that it would be in excess of $2Q,000.
Chairman tiVozniak asked if smoke detectors could be ir�stalled and re-used
at another building, if the school should move . He felt this would give
some additional protection, and the Board might consider waiving the other
requirements .
Richard Amey said the code reauired smoke detectors ia� alI unused areas .
He felt it would be very difficult to separate the stairways, however,
and it would be reasonable to postpone enclasures. �ith the addition of a
better smoke and fire detection system, protection wc�uld be adequate.
BOARD ACTION :
Chairman Wozniak moved that a ttivo-year time extension be granted for com-
p"liance with Fire Code provisions pertaining to fire-rated doors and stair-
well enclosures , on condition that a minimum fire alarm system be installed,
nursuant to negotiation by the Church of St. James w3th the St . Paul Build-
ing Code Enforcement Division as to eYact specifications . hTr. Heider

SUBJECT:
Request waiver of St. Paul Legislative Code , Section 54 . 13, to permit
occupancy of two basement units , because of financial cansiderations .
APPEARANCE : James L. Crockarell
PROCEEDIPdGS :
Mr. Crockarell said he had bought the 10-unit building in April, I978,
afte r making certain that it was certified by the city as a 10-unit
structure . After an unusually heavy rainfall a short time later, water
backed up into the basement, and one of the tenants complained to the
city. An inspector came out and, in addition to insnecting -Che water
problem, had noted that the two basement units were more than 50a below
grade . Mr. Crockarell then received a letter from the city suggestin g
the he cease to rent out the two units because they were illegal . He
had already installed a backup on the sewer at some expense to correct
the water problem. Since he had paid a price based on the rental income
for 10 apartments , he would suffer great economic loss if the two basement
apartments could not be rented out . It would mean $4, 000 Iess per year
in income .
Alice Bijjani, city housing inspector, explained that the code vzolations
were mainly because of the grade level. She said there had been some
laxity in the certification of basement apartments up until a few years
ago, many having been certified even though they did not meet code spe�i -
fications . She noted that the last certification of 1985 Portland had
been made in 1975 , and since that time , code standards had been more
strictly enforced. It was for this reason that Mr. Crockarell had been
given the erroneous information when he called the city nrior to purchasing
the property. There appeared to be adequate light an d ventilation, as
no code violation was listed in any letters sent to Mr. Crockarell in the
recent past .
