WHEREAS, Chapter 293 of the

WHEREAS, §293.11 provides for the granting of variances from
the sound level limitations contained in §293.09, upon a finding
by the City Council that full compliance with Chapter 293 would
constitute an unreasonable hardship on an applicant, other
persons or on the community; and
WHEREAS, Mog-Ali, Inc., d/b/a Gabe's by the Park,
represented by Timothy Weiss, President, who has been designated
as the responsible person on the application, has applied for a
variance to allow live music at 991 North Lexington Avenue, on
March 16 and 17, 2001 and on October 26 and 27, 2001; and
WHEREAS, applicant is seeking a variance for the hours of
5:00 p.m. to midnight on March 16, 2001 from 1:00 p.m. until
12:00 midnight on March 17, 2001 and from 5:00 p.m. until
midnight on October 26 and 27, 2001; and
WHEREAS, if applicant is not granted a variance it will not
be able to present the live music; and
WHEREAS, the Office of License, Inspections, and
Environmental Protection has reviewed the application and has
made recommendations regarding conditions for the variance; now,
therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby
grants a variance to Gabe's by the Park, subject to the following
conditions:
1) The variance shall be for the hours of 5:00
p.m. to midnight on March 16, 2001, from 1:00
p.m. until midnight on March 17, 2001, and
from 5:00 p.m. until midnight on October 26
and 27, 2001.
2) All electronically powered equipment used in
conjunetion with the event shall not exceed
95 dBA as measured from the wall located
opposite from the stage.

3) The applicant shall provide personnel and
equipment who shall provide continuous sound
level monitoring between 5:00 p.m. and
midnight on March 16, 2001, between 1:00 p.m.
and midnight on March 17, 2001 and between
5:00 p.m. and midnight on October 26 and 27,
2001 to ensure compliance with Condition #2•
4) All electronically powered equipment, PA
systems, loudspeakers or similar devices
shall be turned off no later than midnight on
March 16 and 17, and October 26 and 27, 2001.
FURTHER RESOLVED, that any violation of the conditions set
forth above on any of the dates may result in revocation of the
grant of a variance for any of the subsequent dates set forth
above, in addition to any criminal citation which might issue.

Attached is a sound level variance application from Tim Weiss, President, Mog-Ali Ina (Gabe's
By The Park), to allow live bands and amplified music in an outdoor tent. A variance is
requested from 5:00 p.m. until midnight on March 16, 2001, from 1:00 p.m. until midnight on
March 17, 2001, and from 5:00 p.m. until midnight on October 26 & 27, 2001.
Also attached is a copy of the Public Hearing Notice sent to property owners within 200 feet of
the 991 Lexington Parkway N..

Live Bands and Amplified Music Events
Attached is a sound level variance application from Tim Weiss, President, Mog-Ali Ina (Gabe's
By The Park), to allow live bands and amplified music in an outdoor tent. A variance is
requested from 5:00 p.m. until midnight on March 16, 2001, from 1:00 p.m. until midnight on
March 17, 2001, and from 5:00 p.m. until midnight on October 26 & 27, 2001.
Also attached is a copy of the Public Hearing Notice sent to property owners within 200 feet of
the 991 Lexington Parkway N..
