TEK/Jws/ck - P_TT�C:?:•IENTS: Adminstrative Order ' Advisability � Desirability Report � , � . � _ : ' � Summary of Engineerin� Recommendations September 22, ]977 ADVISABILITY AND DESIRABILITY � PROJECT: �_ Condemning and taking an easement in the land necessary for the slopes, cuts and fills, including right of removal of lateral support from subject land or remainder thereof, occasioned by excavations thereof or construction of slopes in the process of constructing new sidewalk on portions of both sides � of DAVERN STREET from West Seventh Street to the railroad tracks near Wilmont Avenue. INITIATING ACTION: The improvement of Davern Street�,from West 5eventh Street to the railroad : racks near Wilmont Avenue was approved through the Capital Improvement B�dget process and the Final Order was approved by the City CourrciT on July 12, � 1971. In the process of design, it is found that slope easements wi11 be needed for construction of �new sidewaik. Public Works is initiating this action to con�+enn slopes. EXISTING CONDITIONS: � Approximatety 90� of the portion of Davern Street does not have a public side- walk. Boutevards are irregular and off grade. A number of trees, bushes, fences, driveways and power poles and house outwalks are within the p roposed sidewalk area. PROPOSED.ACTION: . ! t is proposed to condemn slopes in order to construct a 5 foot wide public sidewalk where no sidewatk now exists. Slopes are needed by the fact that the proposed walk grade yaries from the existing ground line. It is planned ta (�''� construct the walk on the property line with one exception. On the east side � `�% of Davern near Sheridan, a house is positioned 1 .2 feet back from the property line and about 4.5 feet higher than the proposed curb grade. Here, the sidewalk wi.11 be moved to a location directly behind the curb. Slope easements witl necessitate the removai of the following - all on pubtic right-of-way: 6 trees (20", 3", 4", 20", 24" and 18" diameters) 16 feet of picket fence ' 80 feet of hedge • 2 power potes 3 house outwalks 2 asphalt (and 6 dirt) driveways The following, located on public right-of-way neede� not be removed: 3 trees (15", 8" and 4" diameters) 2 bushes � - • ���� � � . -z- - , . - t The following, located on private property, but within about 8 feet of the property line, will not be removed: � 15 trees 1 hedge 3 fences The following work will be done under the Roadway Improvement Contract: New trees - equal in number to those removed-will be planted on the boulevard (additional reforestation wili be done � by others) House walks will be reconstructed in kind. Oriveways will be reconstructed with concrete or bituminous material . Power poles will be r'elocated by the utility companies. � ALTERNATES: Public sidewatks could be eliminated from the roadway improvement proposal . Slope easements would then not be needed. Davern functions as a neighborhood collector type roadway and Public Works feels new sidewalks would be desirous. The public sidewalk could be positioned somewhere other than on the property line. In doing so, the following should be considered: 1 . The removals as described above would not change appreGiably. 2. The location would be contrary to Public Works des�ire to maintain the , . complete public right-of-way for public purposes. . • 3. Boulevard widths would be narrawer allowing less room for new trees. POSITIVE BENEFITS: „ � --_ --- . ' � '�' The acquisition of slopes will allow sidewalk construction to proceed in a legal and orderly manner. . AOVERSE EFFECTS: Removals may be construed by some as an adverse effect. This will be negated somewhat thru replacements and payment of slope damages. SPECIAL CONSIDERATIONS: . Davern Street is a Municipal State Aid Project. { t wilt be coordinated and con- structed with the Sheridan-Wheeter residential street repaving project which includes portions of Munster, Wordsworth, Sheridan, Fie1d and Wheeier Streets. . � , ' , ' -3- . , � �� TIME SCHEDULE: . ;�1��'�,�i The acquisition of slopes is expected to be completed during th�Winter of 1977-197$• Construction should commence during the Spring of 1978. COST ESTIMATE: Slope damages will be determined by the Valuation Engineer. ESTIMATED FINANCING: � Construction costs necessary to correct slope damages will be funded with Municipal State Aid funds. SOURCE OF ADCITtONAL INFORMATION: The Project Engineer is James W.�,Stahnke, who may be contacted at 298-5311 . RECOMMENDATION: � The Department of Public Works feels the construction of new sidewalk on Davern Street is desirabte.
