WHEREAS, The City of Saint Paul condemned and acquired a
temporary easement for construction purposes on a strip of land
eight feet in width on the west side of the east four feet of
Lot 8, Block l, Bryant' s Randolph St. Addition, and also a
temporary construction easement over the west eight feet of
Lot 9, Block 1, Bryant's Randolph St. Addition, the condemnation
and acquisition having been acquired in 1963; and
WHEREAS, The purpose for the temporary construction easement
having been completed and the public sewer constructed, the City
of Saint Paul no longer needs nor requires the said temporary
easement; now, therefore, be it -
RESOLVED, That the Council of the City of Saint Paul does
hereby authorize and direct the proper City officers to execute
on behalf of the City a release of the temporary construction
easements over the portions of Lots 8 and 9 , Block 1, Bryant' s
'Randolph St. Addition as described above.

RELEASE OF PUBLIC SEWER EASEMENT
WHEREAS, the CITY OF SAINT PAUL, a municipal corporation
of the State of I�sinnesota, acting through its City Council did
adopt an intermediary order identified as C. F. 213033 on
May 28, 1963, proposing the acquisition and condemnation of an
easement for sewer purposes over the west four feet of Lot 9,
Block 1, Bryant's Randolph St. Addition; and
WHEREAS, the said City Council, by its Resolution C. F.
214532 adopted September 3, 1963, did find and determine that
it was not necessary to acquire the sewer easement over the
west four feet of Lot 9, Block l, Bryant' s Randolph St. Addition,
but instead determined to acquire a sewer easement over the
east four feet of Lot 8, Block 1, Bryant' s Randolph St. Addition;
and
WHEREAS, it appears from these proceedings that there is
doubt whether the City intended to acquire the sewer easement
over the portion of Lot 9 described above, and the intent of
this release is to remove all doubts that the City did not
intend to nor did it in fact acquire a permanent sewer easement
over the west four feet of Lot 9, Block l, Bryant's Randolph St.
Addition.
NOW, THEREF�RE, the CITY OF SAINT PAUL, acting by and
through the authority granted by its City Council, does hereby

discharge and forever release any interest that it might have .
or claim to have in a permanent sewer easement over the west
four feet of Lot 9, Block l, Bryant's Randolph St. Addition,
and the Ramsey County Recorder and Registrar of Titles of Ramsey
County, Minnesota, are hereby authorized and directed to remove
as a memorial any reference to this permanent sewer easement
over Lot 9, Block 1, Bryant's Randolph Street Addition.

RELEASE OF TEPiIPORARY CONSTRUCTION EASEMENTS
WHEREAS, The City of Saint Paul, a municipal corporation
of the State of Minnesota, acquired a permanent sewer easement
across the east four feet of Lot 8, Block 1, Bryant's Randolph
St. Addition, from Randolph Street to the alley in the rear of
said iot, and further the City acquired temporary construction
easements for the purpose of constructing the said public sewer,
the temporary construction sewer easements being described ac
the west eight feet of Lot 9, Block 1, and a strip of land
eight feet in width on the west side of the east four feet of
Lot 8, Block l, all in Bryant's Randolph St. Addition; and
WHEREAS, The public sewer has been constructed and the
purposes for which the temporary sewer easements were conveyed
and acquired by the City of Saint Paul have been satisfied and
the City no longer requires or needs the use of the said
temporary construction easements;
NOLa, THEREFORE, The City of Saint Paul, acting by and
through the authority granted by its City Council, does hereby
discharge and forever release the temporary construction ease-
ments acquired by the City of Saint Pau1 pursuant to its
Resolution, Council File No. 215438, adopted November 13, 1963,
and the Ramsey County Recorder and Registrar of Titles of
Ramsey County, Minnesota, are hereby authorized and directed

Dear Mr. Donnivan:
Our clients have purchased Lot 9, Block 1, Bryant's Randolph
Street Addition, which is the property at 946 Randolph
Street. It is registered title, and the record discloses a
temporary easement for sewer construction purposes given to
the City of St. Paul in 1963 by an instrument recorded as
document No. 465366. .
The Certificate of Title also contains a memorial of a taking
by the c:ity of a four foot permanent easement �ver the west
four feet of the lot, in City Council File 211265, supplemented
by Council File 213033 and 213530, all in 1963. These actions
were apparently later amended so as to take a four foot per-
manent easement on the east four feet of Lot 8 , in Block l,
presumably in lieu of an easement over the west four feet of
Lot 9. However, the documentation which constitutes the
memorial on the Certificate of Title, is not clear that the _
city did not take a permanent easement over the west four feet
of Lot 9. We are told that the city does not claim to have an
easement over the west four feet of Lot 9, notwithstanding the
memorial on the Certificate of Title.
We are hereby confirming a request which has already been orally
made to your office, for the city to execute and deliver a release
of the temporary easement on Lot 9, and a release of any permanent
easement which the city may possibly have acquired on the
west four feet of Lot 9.
Wauld you please review this matter and let us know if for any
reason such releases, in recordable form, cannot be obtained.
