D elopment) - u r Resolution � � Presented By ` Referred To Committee: Date — Out of Committee By Date WHEREAS, the Council has heretofore adopted guidelines for the City's Rehabilitation Loan and Grant Program for housing; and WHEREAS, these guidelines established income limitations for the purpose of this program; and WHEREAS, a situation has arisen where a female, single head of household participated to the maximum amount of her ability to repay in the City's rehab loan program; and WHEREAS, it has been determined that additional work remains to be done to the structure; and WHEREAS, the owners income exceeds the limits contained in the guidelines by 10%; and WHEREAS, the Board of Commissioners of the Housing and Redevelopment Authority has recommended the-waiver of the Rehabilitation Grant Income limits for the owner of 1227 Randolph Aver�ue; now, therefore, be it RESOLVED, that the City Council , upon the recomnendation of the Mayor, does hereby grant the waiver of income limits due to the unique problems and hardships involved for the owner of 1227 Randolph. The owner of the property at 1227 Randolph Avenue received a City-wide Rehabilitation loan o October 4, 1975, in the amount of $16,250 to do extensive rehabilitation on her house. � A.pproximately one year after completion of the work, the owner discovered water damage fram � w::at app�ar2d ��o he a lea:;�:,g rouf. (A new roof covering was part of the rehabilitation wor ' Subsequent inspection by staff revealed that there are some problems with the new roof , covering, but two badly deteriorated chimneys that were not included in the Scope of Work appear to be the main cause o€ the leaking roof. . These deteriorated chimneys were undetecta from the ground on the original City inspection and the problem was nat pointed out during construction so that the owner could have deleted some less essential work from her contract to cover the cost of repairing the chimneys. - � The owner is a single woman, working as a typist, trying to maintain her home, and has two young adult dependents. Her income is approximately $8,S�S0 which exceeds tiie grant incoma r--°"-'- __�_�_..F�_._...-�.--.r.._.r._.<.... limit by $880. The owner neither wants nor can afford an additional loan payment. The staff has discussed this wiCh the l�fayor's Advisory Coimnittee and it is the Committee�s recor�endation, as well as staff`s, that the grant income 17Lmits be waived and that the owne: be given a City-wide Rehabilitation grant of $1,500 to make the necessary chimney repairs. '�he contractor has committed himself to make the necessary roof repairs even though his warranty period has expired. - _ _ To prevent this from reoccurring, staf£ has made a policy to have the contractor report the condition of the chimney after examining it from the roof, if the condition cannot be deter- mined from the ground level or f rom the attic. Commissioners appraved the staff recommendation granting the waiver. However, the ReMabil�tation Loan and Grant Program Concept and Guidelines were adopted by Council � File No. 264630, November 21 , 1974 and the Council must approve the waiver.
