This matter was originally heard before the Current Planning & Zoning Committee on December 1 , 1977. The committee laid the matter over because staff reported insufficient information to continue. Subsequent to that meeting a letter was received from the Economic Development Division staying all action on this rezoning until such time as a 40 Acre Study could be initiated. This matter is being processed now because several of the lots have been sold to the general public and they cannot obtain building permits without rezoning. This matter was again heard before the Current Planning & Zoning Corr�nittee on March 2, 1978 at which time staff recommended approval of the petitioner's request subject to initiation of a 40 Acre Study to rezone the remaining lots fronting on the north and south sides of Dayton Avenue between Dale & Kent Streets. E. SITE CONDITIONS: All 7 sites are vacant and bordered by large older homes in various states of repair and rehabilitation. F. AREA CONDITIONS: The area is one of extensive home and corrmercial rehabilitation e orts. e y Avenue, an old canmercial strip undergoing renovation, is one block to the south. The Control Data proposal is located 3 blocks to the north. G. FINDINGS: 1 . The proposed rezoning sites are vacant. 2. Nine of the 11 remaining lots on both sides of Dayton between Dale & Kent have existing residential structures. , , f ' . HRA (Woodland Park Addn. ) Page 2 3. The existing residential structures, ranging from single family to a 10-unit building, will not be nonconforming even though they will remain in a B-2 zone. The reason for this is Section 62.103(e)(7) of the zoning ordinance which states that "In any OS-1 , B-1 , B-2, 6-3 district, existing residential uses shall not be nonconforming . . . " 4. The Renewal Division of the Dept. of Planning & Economic Development has promised to immediately initiate a 40 Acre Study to rezone the remaining lots fronting on the north and south sides of Dayton between Dale and Kent to remove the existing B-2 classification. 5. If the remaining lots are not rezoned to a residential classification, a potentially undesirable condition could result with conflicting business uses adjacent to residential uses in this block. 6. The District 8 Rehab/Improvement Plan dated August 1976 shows this area in a Residential II classification, which permits residential density not to exceed 24 dwelling units per acre (which is roughly equivalane to an RM-2 zoning). , OTHER CONSIDERATIONS: There is a sense of urgency for this rezoning because several of the lots involved in the rezoning haye been sold to the general public and those people are now discovering that they cannot build or occupy a new house in a B-2 district. Lending institutions are becoming increasingly aware of the zoning ordinance and its effects on long term mortgages. This consideration may become important if the existing residential structures remain in a B-2 zone. The existing residential structures, ranging from single family to a 10-unit building, will not be nonconforming even though they will remain in a B-2 zone. The reason for this is Section 62.103(e)(7) of the zoning ordinance which states that "In any OS-1 , B-1 , 6-2, 6-3 district, existing residential uses shall not be nonconforming . . . " 4. The Renewal Division of the Dept. of Planning & Economic Development has promised to immediately initiate a 40 Acre Study to rezone the remaining lots fronting on the north and south sides of Dayton between Dale and Kent to remove the existing B-2 classification. 5. If the remaining lots are not rezoned to a residential classification, a potentially undesirable condition could result with conflicting business uses adjacent to residential uses in this block. 6. The District 8 Rehab/Improvement Plan dated August 1976 shows this area in a Residential II classification, which permits residential den�sity not to exceed 24 dwelling units per acre (which is roughly equivalane to an RM-2 zoning). OTHER CONSIDERATIONS: There is a sense of urgency for this rezoning because several of the lots involved in the rezoning have been sold to the general public and those people are now discovering that they cannot build or occupy a new house in a B-2 district. Lending institutions are becoming increasingly aware of the zoning ordinance and its effects on long term mortgages. This consideration may become important if the existing residential structures remain in a B-2 zone. Because the request for the rezoning of this property was filed pursuant to a Housing and Redevelopment Authority administrative order, the with- drawal of the petition should technically be accomplished by an official rescinding order. The HRA Legal staff is presently in the process of preparing a new administrative order requesting the Planning Cotn- mission to initiate a 40 acre study in Planning District 8 and rescinding the short-form petition request for those properties previously men- tioned. The requested 40 acre study may take into consideration additional rezoning requests for HRA properties in Planning District 8 which would be in accordance with the general district plan for that portion of the City.
