WI�REAS, the City of Maplewood, in cooperation with the City of Saint Paul and Ramsey County, established a deer management program which was adopted in August of 2000 by the Maplewood City Council; and WHEREAS, the program contemplates that in densely populated or highly developed areas where archery is not feasible that deer will be trapped and shot; and WHEREAS, the City of Saint Paul, through its Animal Control Office has the personnel and resources to trap and shoot deer in accordance with the management plan, which the City of Maplewood does not have at this time; and WHEREAS, Maplewood wishes to enter into an agreement whereby Saint Paui Animal Control Officers will participate in and implement portions of the deer management progam, as more fully set forth below; Now, therefore, parties to this agreement, in consideration of the mutual terms and conditions, promises, covenants, and payments hereinafter set forth, agree as follows: Scope of Services Saint Paul will provide qualified Animal Control personnel and equipment to implement the deer management program, through the trapping and shooting of deer on pubiic or private property at sites which Mapiewood determines in accordance with the provisions of the deer management program. Saint Paul will be responsible for daily maintenance of each site, excluding weekends which shall include: setting traps; checking traps; removing the deer from the traps each day; cleaning the area to remove, to the extent reasonabiy possible, blood or other visible signs of the shooting; transporting the deer to a site for processing and turning the deer over to a Department of Natural Resources conservation. Saint Paul will also provide an Animal Control Officer to be present, as requested by Maplewood, at neighborhood meetings to explain the process, demonstrate trap funcrions and answer questions. Currently rivo sites aze anticipated during the term of the Agreement and Saint Paul would attend one meeting per site, with an additional meeting if necessary because of change in sites. 2. Term of Agreement This Agreement shall be effective upon signmg and shall continue through Apri130, 2001. No extensions to the Agreement shall be permitted except upon written amendment. 3. Billine and �ayment 0�-1�3 Maplewood shail make an initial payment of $250, due within 30 days of the signing of the Agreement, for the costs involved in establishing and coordinating the program. In addition, Maplewood shall pay the sum of $150 for each deer removed from the traps located in Maplewood during the term of this Agreement. Saint Paul shall submit monthly invoices to Maplewood, and payment shall be due within 30 days of receipt of the invoice. 4. Resnonsibilitv of each partv A. Maplewood shall be responsible for selecting each of the sites at which Saint Paul will perform the duties under this Agreement, advising area residents of the existence of the program and taking such steps as aze necessary to reduce any risk of harm to person or properry on the site. B. Maplewood shall be responsible for providing all necessary permits and for having any landowner permission forxns and waiver of liability/release of claim forms executed for sites located on private property. C. Maplewood shall advise Saint Paul of the time, date and place of any neighborhood meetings which they aze expected to attend at least one week prior to the scheduled date. D. Saint Paul will provide qualified personnel to perform the services listed in Paragraph 1 at the sites to be determined by Maplewood, but in no event at more than two sites during the term of this Agreement. A change in location prior to trapping and removal services being perforxned shail not be considered an additional site. E. Saint Paul shall be responsible for knowing and abiding by the rules of the DNR permit authorizing the deer management program. F. Saint Paul shall submit a written report no later than Apri130, 2001 to Maplewood, suminarizing the results of the removal program and containing the information required by the DNR permit. 5. Indemnification Each party agrees to be responsible for its own acts and omissions and those of its officers, employees, agents or representatives in carrying out the terms of this Agreement and the results thereof to the extent authorized by law, and shall not be responsible for the acts and/or omissions of the other pariy and the results thereof. The liability of the City of Saint Paul, its officers, employees, officials and agents shail be govemed by the provisions of the Municipal Tort Claims Act, Minn. Stat. Chapter 466, and other applicable law. 6. Modifications Any modifications or amendments to this Agreement shall only be valid if they are in writing, and signed by authorized representatives of the parties. ol_ ��3 7. Default and Ternunarion Either party to this Agreement may temrinate it with or without cause upon thirty (30) days written notice to the other party. Tenninarion of the Ag�'eement shall not discharge any liability, responsibility ar right of any parry which arises or arose from the performance of or failure to adequately perform the terms of this Agreement prior to the effective date of temunation. Neither party shall be held responsible for delay or failure to perform the terms of the Agreement where the failure or delay is caused by fire, flood, unusually severe weather or other acts o£God. 8. Maplewood shall be responsible for selecting each of the sites at which Saint Paul will perform the duties under this Agreement, advising area residents of the existence of the program and taking such steps as aze necessary to reduce any risk of harm to person or properry on the site. B. Maplewood shall be responsible for providing all necessary permits and for having any landowner permission forxns and waiver of liability/release of claim forms executed for sites located on private property. C. Maplewood shall advise Saint Paul of the time, date and place of any neighborhood meetings which they aze expected to attend at least one week prior to the scheduled date. D. Saint Paul will provide qualified personnel to perform the services listed in Paragraph 1 at the sites to be determined by Maplewood, but in no event at more than two sites during the term of this Agreement. A change in location prior to trapping and removal services being perforxned shail not be considered an additional site. E. Saint Paul shall be responsible for knowing and abiding by the rules of the DNR permit authorizing the deer management program. F. Saint Paul shall submit a written report no later than Apri130, 2001 to Maplewood, suminarizing the results of the removal program and containing the information required by the DNR permit. 5. Indemnification Each party agrees to be responsible for its own acts and omissions and those of its officers, employees, agents or representatives in carrying out the terms of this Agreement and the results thereof to the extent authorized by law, and shall not be responsible for the acts and/or omissions of the other pariy and the results thereof. The liability of the City of Saint Paul, its officers, employees, officials and agents shail be govemed by the provisions of the Municipal Tort Claims Act, Minn. Stat. Chapter 466, and other applicable law. 6. Modifications Any modifications or amendments to this Agreement shall only be valid if they are in writing, and signed by authorized representatives of the parties. ol_ ��3 7. Default and Ternunarion Either party to this Agreement may temrinate it with or without cause upon thirty (30) days written notice to the other party. Tenninarion of the Ag�'eement shall not discharge any liability, responsibility ar right of any parry which arises or arose from the performance of or failure to adequately perform the terms of this Agreement prior to the effective date of temunation. Neither party shall be held responsible for delay or failure to perform the terms of the Agreement where the failure or delay is caused by fire, flood, unusually severe weather or other acts o£God. 8.
