THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, sheet number
seven (7) , as incorporated by reference in Section 6.0. 401 of the
St. Paul Legislative Code is hereby amended as follows:
The property owned by A & D Realty Company on the •
east side of Gary Place between Iowa and Hoyt
Avenues and more particularly described as Lots
34 and 35, Block 6, Hillcrest Center Addition, is
rezoned from R-3 to P-1. �
Section 2.
This ordinance sha-ll--take effect and be in foree thirty (30)

record as being opposed to the rezoning of Lots 17, 34, and 35,

Residential, to P-1, Parking District, for the construction of
a parking lot.

already received petitions from that neighborhood and other

2. Land use conflict problems have always existed in areas where housing
and business uses meet. Housinq interests usually have been infringed on.
3. The location of the site in relation to existing comme�cial development
severely limits its marketability for future single family housing.
4. One of the intents of a zoned parking district is to provide a buffer
zone between incompatible land uses.
�. Without any site plan for review showing intended layout and aesthetic
controls, it is not possible to comnent on the impact of such facility
/ �.57j upon i ts surroundi ngs.

6. A plan is being prepared by the General District planning process, one
of the issues being land use and circulation conflicts. This plan is
anticipated to be in draft form sometime during 1977.
G. STAFF RECOMMENDATIONS: Designation of the site as a P-1 district restricts
the use of t e property to the parking of automobiles. Overnight parkinq
and automobile maintenance are prohibited on P-1 facilities by ordinance.
To change the use of this property to any other use would require a new
petition and another hearing. P-1 districts abutting residential property
have the most restrictive standards for parking of any district in Saint
Paul . While granting this rezoning may increase interest in similar actions
on other properties in the area, each case would be considered on its own
merits. The use of this property for any of the purposes for which it is
now zoned is improbable. Staff recommends approval of the rezoning.

A. SUFFICIENCY: The applicant's request for rezoning was filed on a long form
petition. On January 21 , 1977 the Finance Director determined that the
petition was sufficient. The City Planning office received the letter requesting
review and recommendation from the City Clerk's office on January 31 , 1977.
B. PROPOSED USE: The applicant is requesting rezoning of three lots from R-3
Tsingle fami y residential ) to P-1 (parking district) for the purpose of
developing offstreet parking for business uses on the west side of Gary Place.
C. FRONTAGE & AREA: Lot 17 has a 37 ft. frontaqe on Iowa, and Lots 34 & 35 have
a combine 88 ft. frontaqe on Hoyt. The depth of all 3 lots is 125.5 ft. and
the total area is approximately 15,688 sq. ft. , not including alley right-of-way.
D. SITE CONDITIONS: The entire site is vacant. Lots 34 & 35 slope gradually up to
t e a ley an presently contain a large mound of debris or soil near the
center. Lot 17 is about 5 or 6 ft. higher than the alley and is relatively
level and landscaped somewhat by the abuttinq property owner.
E. AREA CONDITIONS: The entire area, except for these vacant lots and a few
lots to the north, is fully developed and appears well maintained. Newer,
modestly valued, single family housinq occupies the area east of Gary Place
and the alleys that separate housing from commercial developments alonq White
Bear Ave. These areas are zoned R-3 and R-4 residential . West of Gary Place
is the White Bear Ave. business district and the Hillcrest Shopping Center
complex. Directly west of the subject lots is Hafners Restaurant & Bowling
which has been built up to the lot line along the southern and eastern limits
of the block. Offstreet parking for this enterprise is located within the
block to the north and west of the structure, but is limited in space.
On the north side of this block is the "1590" building, a small office structure
with parking facilities mingled in with Hafners.
F. FINOINGS:
1 . The commercial uses along White Bear Ave. are regarded as assets by the
neighborhood and the corimunity.

and that the lot be posted for employee parking only. There was considerable
opposition which focused on run-off created by blacktopped areas,spot rezoning,
infringement on the residential neighborhood, and the devaluation of homes.
The motion to accept the recommendation of the zoning committee was denied on
a 78 to 25 vote.
This matter is scheduled to be heard by the Saint Paul City Co�tncil on August
15, 1978.

Dear Madam:
� This is written in response to the petition of A & D Realty Company to rezone
property on the east side of Gary Place between Iowa and Hoyt from R-3 (Single
Family Residential ) to P-1 (Parking). The request was filed on a consent form
petition subscribed & sworn to before a notary public on November 29, 1976.
This matter was heard by the Current Planning & Zoning Corr�nittee on February 7,
1977. There was considerable neighborhood oppasition; major concerns were
the encroachment of business and associated noise, crime, tr°affic and parking
problems. Staff recommended approval of the rezoning. The Current Planning &
� Zoning Committee recommended denial on a vote of 3 to 2, based on the concerns
raised by the neighborhood.
On February 18, 1977 the Planning Corr�nission determined that inasmuch as the
neighborhood concerns had not been addressed, and that a site plan of the proposed
lot had not been submitted to the committee, the matter should be referred back
to the committee. The Commission advised the applicant of their alternatives:
request another hearing before the Current Planning & Zoning Committee or after
60 days petition the City Council for a hearing date.
On March 28, 1977 the Greater East Side Council voted to oppose the A & D Realty
rezoning (letter attached). On May 18, 1978 A & D Realty appeared before the
City Council to request disposition of the rezoning. A hearing date of July 6,
1978 was set. _
On July 6, 1978 A & D Realty, complying with the Greater East Side Council , re-
quested that the Council lay over the rezoning to permit A & D Realty to attempt
a solution through the district planning process.
On August 8, 1978 at the general membership meeting of the Greater East Side
Council,their zoning committee recommended the denial of the rezoning of Lot
17 (fronting on Iowa) and the approval of the rezoning of Lots 34 & 35 (fronting
on Hoyt), with the stipulation that A & D Realty comply with the P-1 regulations

Re: Petition of A & D Realty to Rezone Property
By letter of May 18, 1978, you requested advice regarding the
� above-referenced rezoning matter.
It is our understanding that the rezoning petition was found to be
sufficient and referred to the Planning Commission by the City Council
in February, 1977. The Current Planning Committee of the Planning
Commission thereafter received a report from the staff of the
Planning Office, held a public hearing, and made its recommendation
to the Planning Commission. The Planning Commission then tabled
further action indefinitely to allow A & D Realty to meet with area
residents and reach some sort of compromise. A & D Realty has now
requested that the City Council set a hearing preparatory to acting
on the petition.
A petition to rezone property is jurisdictional. Once the neighbor-
ing property owners have granted �urisdiction to the City Council
by consenting to the petition, the Council has the authority to grant
the reguested rezoning if it finds such action to be in the public
welfare. There is no requirement that the Council act within a
certain period of time, so long as any delay is not unreasonable
and a consenting party has not changed his position in reliance on
the failure to act.
The Council' s authority to act on the petition is limited by Minn.
Stat. s� 462.357, Subd. 4, which reads as follows:
"An amendment to a zoning ordinance may be initiated
by the governing body, the planning agency, or by

petition of affected property owners as defined
in the zoning ordinance. An amendment not ini-
tiated by the planning agency shall be referred
to the planning agency, if there is one, for study
and report and may not be acted upon by the govern-
ing body until it has received the recommendation
of the planning agency on the proposed amendment or
until 60 days have elapsed from the date of refer-
ence of the amendment without a report by the
planning agency. "
Since more than 60 days have elapsed since the petition was referred
to the Planning Commission, the Council may proceed with the matter
either by setting a public hearing and acting without a recommenda-
tion from the Planning Commission or by requesting the Planning
Commission make its recommendation as soon as practicable.

a partnership consisting of Albert and Donald Hafner. Some time
ago, a Rezoning Petition was filed by A & D Realty seeking to
rezone Lots 17, 34, and 35, Block 6, Hillcrest Center. On
January 27, 1977, the City Council referred said Petition to the
Planning Commission. On February 17, 1977, the Planning Committee
by a vote of 3-2, recoa�ended that the Petition be denied. On
February 25, 1977, the Planning Commission laid over the matter.

City Council Agenda for a decision by that body. Consequently,

Dear Mr. Hozza,
Last evening, August 8, 1978 at 7:30 p.m. , the Greater Eastside Community
Council - District II held its monthly general membership meeting at Hillcrest
Hirise - 1743 E. Iowa, St. I'aul. The second item on the scheduled agenda, under
New Business, was the discussion of A & D Realty�Hafners' request to rezone
Lots 17, 34 and 35 - Block 6, Hillcrest Center in order to construct two employees
parking lots across the street from the business establishment. A brief summary
of those proceedings follows.
The GESCC Zoning Committee's report was presented by Mr. Otas Helemas,
Chairman (see attached) which recommended the following action be taken:
1. That the parcel north of the alley (Lot 17), proposed 7 car parking�
lot be denied . (Motion to grant: 5 no, Z yes, Z absent)
2. That the parcel south of the alley (Lots 34 and 35), proposed 22 car
parking lot be granted, complying with all legal requirements of a
P-1 zoning, and that the agreement to use it as an employee park-
ing lot be honored and perpetuated. Visual sight screening to be
placed on the north, east, and south sides, to be asthetic-and func-
tional, either by fencing or planting. Lighting to be placed in such a
manner as to be of least annoyance to adjacent residents. (Motion
to grant: 1 no, 6 yes, 2 absent).
After lengthly discussion and debate, and presentations by opponents and supporters
of the rezoning issue, a motion was made by D, C. Hoffman and seconded by Jayne
Lallier to accept the recommendation of the Zoning Coxnmittee. The motion failed
to win approval by a vote of: 24 for, ?5 against.
After the votes were tallied, the following re5olution was moved by Bruce Haug,
seconded by Herbert Haxnmer,. �.nd passed that:
"The GESCC recqmmends that the City of St. Pau]. City Council not
grant any coxnmercial e stablishment any reque st for zoning change s or
building permits within District II on White Bear Avenue, until the prob-
lems with the Flandrau-Ht�yt sewer systems - both sanitary and atorm
water - are resolved and corrected".
A further motion was introduced by Orville Kemp, and passed that:

Dear Sir:
Upon receipt of a notice for rehearing before the City Council� on 6 July, 1978�
the District 2. Zoning Committee in a letter to Mr. Hozza, Chairman of the St. Paul
City Council, requested that the above stated petition be returaed to District 2.
for consideration. The request was honored. ,
An informational meeting wa� held on 26 Ju1y� '1978, with representativea of
residents opposed to rezoning, (7members) the petitioners (4 members)� and membere
of District 2. Zoning Committee (2 members). A proposed layout was presented by
Mr. Nordby, of K.G. Nordby and Associates (Commission Nr. 55-76 dated 12/29/76),
Archetects for A & D Realty� stating their propossals for site development.
The residents voiced a strong objection to rezonin� on grounds that their properties
will be devaluated,- traffic noise from patrons of Hafners Supper Club and
Bowling Alleyss occuring at a late hour�-the time of refuse removal at early
morning hours. Concern was expressed toward a con�inuous expansion for parking
space toward the east, relating to the present ownership of residential properties
owned by A1 and Don Hafner. The matter of run-off and floding were mentioned�
and are being addressed at the present time by agencies of the city, in obtaining
relief to this problem. An agreement was obtained from Messrs. Hafner, that if the
petition to rezone is granted, parkin$ is to be for emplayees only. The informational
meetiug was concluded in a cordial manner, with an exehange of information benefici.al
to all parties concerned.
The District 2. Zonibg Committee met on 3 August, 1978. A quorum being present, the
committee addressed the A & D Realty petition for rezoning. Information and data
used was frora present and past meetings and hearings. Aft�r due deliberations, the
Di,strict 2. Zoning Committee makes these recomendations:

Dear Madam:
This is written in response to the petition of A & D Realty Company to rezone
property on the east side of Gary Place between Iowa and Hoyt from R-3 (Single
Family Residential ) to P-1 (Parking). The request was filed on a consent form
petition subscribed & sworn to before a notary public on November 29, 1976.
This matter was heard by the Current Planning & Zoning Comnittee on February 7,
1977. There was considerable neighborhood opposition; major concerns were
the encroachment of business and associated noise, crime, tr.affic and parking
problems. Staff recommended approval of the rezoning. The Current Planning &
Zoning Committee recommended denial on a vote of 3 to 2, based on the concerns
raised by the neighborhood.
On February 18, 1977 the Planning Commission determined that inasmuch as the
neighborhood concerns had not been addressed, and that a site plan of the proposed
lot had not been submitted to the committee, the matter should be referred back
to the committee. The Commission advised the applicant of their alternatives:
request another hearing before the Current Planning & Zoning Committee or after
60 days petition the City Council for a hearing date.
On March 28, 1977 the Greater East Side Council voted to oppose the A & D Realty
rezoning (letter attached). On May 18, 1978 A & D Realty appeared before the
City Council to request disposition of the rezoning. A hearing date of July 6,
1978 was set.
On July 6, 1978 A & D Realty, complying with the Greater East Side Council , re-
quested that the Council lay over the rezoning to permit A & D Realty to attempt
a solution through the district planning process.
On August 8, 1978 at the general membership meeting of the Greater East Side
Council,their zoning committee recommended the denial of the rezoning of Lot
17 (fronting on Iowa) and the approval of the rezoning of Lots 34 & 35 (fronting
on Hoyt), with the stipulation that A & D Realty comply with the P-1 regulations

and that the lot be posted for employee parking only. There was considerable
opposition which focused on run-off created by blacktopped areas,spot rezoning,
infringement on the residential neighborhood, and the devaluation of homes.
The motion to accept the recommendation of the zoning committee was denied on
a 78 to 25 vote.
This matter is scheduled to be heard by the Saint Paul City Cou ncil on August
15, 1978.

petition. On January 21 , 1977 the Finance Director determined that the

developing offstreet parking for business uses on the weSt side of Gary Place.
C. FRONTAGE & AREA: Lot 17 has a 37 ft. frontaqe on Iowa, and Lots 34 & 35 have
a combine 88 ft. frontaqe on Hoyt. The depth of all 3 lots is 125.5 ft. and
the total area is approximately 15,688 sq. ft. , not i�cluding alley right-of-way.
D. SITE CONDITIONS: The entire site is vacant. Lots 34 & 35 slope gradually up to
t e alley an presently contain a large mound of debris or soil near the
center. Lot 17 is about 5 or 6 ft. higher than the alley and is relatively
level and landscaped somewhat by the abuttinq property owner.
E. AREA CONDITIONS: The entire area, except for these vacant lots and a few
lots to the north, is fully developed and appears well maintained. Newer,
modestly valued, single family housinc� occupies the area east of Gary Place
and the alleys that separate housing from comnercial developments along White
Bear Ave. These areas are zoned R-3 and R-4 residential . West of Gary Place
is the White Bear Ave. business district and the Hillcrest Shopping Center
complex. Directly west of the subject lots is Hafners Restaurant & Bowling
which has been built up to the lat line along the southern and eastern limits
of the block. Offstreet parking for this enterprise is located within the
block to the north and west of the structure, but is limited in space.
On the north side of this block is the "1590" building, a small office structure
with parking facilities mingled in with Hafners.
F. FINDINGS:
1 . The commercial uses along White Bear Ave. are regarded as assets by the
neighborhood and the community.

2. Land use conflict problems have always existed in areas where housing
and business uses meet. Housing interests usually have been infringed on.
3. The location of the site in relation to existing comme�cial development
severely limits its marketability for future single family housing.
4. One of the intents of a zoned parking district is to provide a buffer
zone between incompatible land uses.
� Without any site plan for review showing intended layout and aesthetic
controls, it is not possible to corrment on the impact of such facility
/ �;5?j upon its surroundings.

6. A plan is being prepared by the General District planning process, one
of the lssues being land use and circulation conflicts. This plan is
anticipatPd to be in draft form sometime during 1977.
G. STAFF RECOMMENDATIONS: Designation of the site as a P-1 district restricts
the use of the property to the parking of automobiles. Overnight parkinq
and automobile maintenance are prohibited on P-1 facilities by ordinance.
To change the use of this property to any other use would require a new
petition and another hearing. P-1 districts abutting residential property
have the most restrictive standards for parking of any district in Saint
Paul . While granting this rezoning may increase interest in similar actions�
on other properties in the area, each case would be considered on its own
merits. The use of this property for any of the purposes for which it is
now zoned is improbable. Staff recommends approval of the rezoning.
