2 WHEREAS, the Council of the City of Saint on 11-1-00, adopted C.F. No. 00-1041 to
3 immediately impose prohibitions on the development of any parcel of land or part thereof within
4 the areas of the White Bear Avenue Study Area pending the formal adoption of a moratorium
5 ordinance pursuant to City Charter Sec. 6.05; and

WHEREAS, the Council of the City of Saint Paul on November 22, 2000 duly adopted
the said interim ordinance which prohibited the issuance or approval of zoning and building
permits, plat approvals or lot splits, until the expiration of twelve months as provided in Minn.
Stat. § 462355, Subd.(4), or until such earlier time as the Council of the City of Saint Paul had
taken action on the recommendations contained in the study; and
WHEREAS, the Council of the City of Saint Paul is advised that the St. Pascal's Parish
has undertaken and completed a capital improvements campaign and that St. Pascal's Parish now
desires to make improvements to its parish campus wtuch will require the approvai of zoning and
building permits; and
WHEREAS, St. Pascal's Parish is a long standing and desirable instiYutional use serving
the White Bear Avenue community and that improvements to such uses should be allowed where
the use is consistent with the present needs and future vision of the White Bear Avenue Corridor;

2 THEREFORE, BE IT RESOLVED that pending the amendment of C.F. 00-1043 under
3 sepazate ordinance, the provisions of C.F. 00-1043 shall not prevent St. Pascal's Parish from
4 applying for or receiving any zoning or buiiding permit necessary to undertake improvements to
5 its physical plant; AND
6
7 BE IT FINALLY RESOLVED, that in the event C.F. 00-1043 is not amended to provide
8 St. Pascal's with the means necessary to obtain the appropriate approvals and permits, that St.
9 Pascal's acl�owledge that it proceeds with its affairs at its own risk.
