Dear Madam:
This letter is written in response to the petition of Rice Investors to rezone
property located at 1236-1238 E. Seventh Street (Southwest corner of E. Seventh
& Atlantic) from RT-1 (Two-Family Residential) to OS-1 (Office Service).
This matter was heard before the Current Planning & Zoning Corr�nittee on December
15, 1977 at which time the petitioner, Arrigoni Brothers, changed their original
request of rezoning from RT-1 to B-3 to RT-1 to OS-1 . Staff reconmended denial
of the original request to rezone from RT-1 to B-3. Staff recomnended at the
Current Planning & Zoning Committee meeting that the revised request to rezone
from RT-1 to OS-1 be approved. Mr. Pangal moved to recommend approval
to rezone to OS-1 . Ms. Grittner seconded the motion and it passed on a 6 to 0
roll call vote.
On December 16, 1977 the Planning Corr�nission confirmed the recomnendation of the
Current Planning and Zoning Committee by a 17 to 0 vote.
This meeting is scheduled to be heard before the Saint Paul City Council on
January 26, 1978.

We live in an alder neighborhood. �lost oP us are homeownere
and have inveated large sums of money into our homea. Younger cauplee
are moving into our neighborhood and thB posaibility oP more reaidentiai
construction ia possible. The neighborhood ie well kept and I don�t
see how s General 8usihess lat could help our neighborhood. In fact�
I Peel this would cauae deterioration of our neighborhood.
East 7th Street is a high trat'Pic area. A Genaral 8usinees
on the corner of 7th and Atlantic would increase the vehicular trafPic
on Atlantic and Ross streets. There are many children in the neighbor—
hoo� with na real play areas and increased traffic could ceuse problema.
There is not adequste parking on the site. Parking oP more
than three (3) cars would be on the atreet. At present� people using
the building occasionally park in my backyard. If the aite is not
eltered� the owner is not responaible to aupply adequate parking

Dear Council Members:
The �Dayton's Bluff Community Council would like to voice our unanimous and firm opposition
to the rezoning from RT-I to B-3 the property at 1236-1238 East Seventh Street, aka part of
Lot I, Block 3, Messerli and Eschbachs Addition.
At our Executive Board Meeting, held December Sth, the Dayton's Bluff Community Counci)
voted unanimously to oppose this rezoning and to support efforts of neighborhood residents to
prevent the intrusion of this new business into their community.
Such spot commercial zoning is in direct and fundamental confli ct with the District 4 Gen-
eral District Plan which has been approved by the residents of Datyon's Bluff, and would
destroy the essentially residential character of East Seventh Street which runs from Newcombe
Street to White Bear Avenue. It would also undercut and make shambles of the Council's
attempt to maintain and rennovate the precious few remaining neighborhoods in Dayton's
Bluff. '
In addition, a B-3 rezoning is not necessary for the avowed intent of the developer, namely
a real estate office, and would open the door to other less desirable businesses in the future,
as well as encouraging businesses of a similar nature to ask for spot rezonings on this section
of East Seventh $treet. Allowing new businesses to creep into a neighborhood would doom
this section of East Seventh to the inevitable fate of one vast commercial strip.
Furthermore, such rezoning is not needed when there is ample space and opportunity for the
development of a real estate office or other business in the commercial strip of East Seventh
running from Mario to Duluth Strc:et:, where nc�w husinEasses are n�ed���l. This is especially
the case in that section of EasF Sevcnth frcxn 1=iank lo Uuluth Shect, less than 2 blocks a-
way from the proposed rezoning site, and where no rezoning should be necessary. Why
destroy a neighborhood, even a border neighborhood, with the intrusiori of a new business
when sites just a short distance away are vacant and begging for new owners?

Finally, the noise and air pollution from heavy truck and car traffic on East Seventh already
discouroges people from residing on East Seventh. More businesses would add to this problem,
causing traffic and parking problems, and further lowering residentiat property values as well
as destroying any neighbo�hoad. It is time to put a stop to the encroachment of businesses
on new property and neighborhoods of East Seventh Street and encourage them to maintain,
renno'vate, and develop the existing commercial st�ip of East Seventh.
� On behalf of residents of the East Side, we strongly urge you to deny Rice Investors their
petition to rezone this property.

RICE INVESTORS (#8241 ): A request to rezone from RT-1 to B-3 property located
on the south side of East Seventh Street between Atlantic and Duluth.
The petitioner was present. There was opposition.
Mr. Warn read the staff report and showed slides of the subject site.
Mr. Del A. Arrigoni , 1450 Arlington, said Rice Investors was formerly Schroeder
Milk Company, and the property had been purchased in September. He referred to
the commercial properties in the area and described the subject site as having
15 ft. ceilings, with taxes at $1300 per year. He said it had been purchased
for the Arrigoni real estate office subject to the lease to Alcoholics Anonymous
which will expire December 31 , 1978. He said the site is a $60,000 investment
and their real estate office takes 1/3 of the building. He said they should
be getting more money than they are getting from Alcoholics Anonymous ($300/mo.
for 4000 sq. ft.)
Mr. Pangal asked the petitioner if he would consider reducing his request to OS-l .
Mr.Arrigoni asked if OS-1 would include a liquor store and Mr. Pangal answered no.
Mr. Arrigon� said the Red Mill might be condemned and might make him an offer.
Mr. Robert Arrigoni , 2171 Valley View Place, the son of Del Arrigoni , said he grew
up 3 blocks from the subject site when it was a grocery store. He said AA will not
be able to stay in the building after their lease runs out next year. He added
that AA has meetings every day, six days a week. He said the Arrigonis intend to
have the building used for more of a business place, and they have no intention
at the present time to put in a liquor store.
Mr. Humner asked if the present zoning had been known when they purchased the
property, and Robert Arrigoni said yes--they had received a letter from the City
of Saint Paul saying they were nonconforming. He said the building could not be
residential with the high ceilings, etc.
Mr. �Bruce Lightner, 1235 Ross, spoke in opposition to the rezoning request. He
submitted a petition signed by 47 neighbors who live within 350 feet and read
a prepared statement of opposition. Upon being queried by Ms. Grittner, he said
people do park in his backyard where there is no garage.
Mr. Orlando Messerli , 1216 East Seventh Street, said he was interested in trying
to keep up the neighborhood, and that anything below Newcomb Street is definitely
commercial but has deteriorated. He said the corner lot had been a grocery store
for three generations, and all the neighbors were glad to have a grocery store there.
They feel if it is rezoned, a liquor store could very easily be put there, and
property values would go down. He said the Red Mill and other tavern are far

enough away that they do not get the noise, but on thiS cornel^;.nvise would affect
all the homes in the area. He said young people have invested their money and
are trying to build up the neiqhborhood and trying to protect their investments.
Mr. Messerli said that if Mr. Arrigoni bought the property knowing it was zoned
wrong, it is their own fault.
Mr. Ron Wagner, 1787 East Minnehaha, said he represented his father at 1212
East Seventh St. and he also is the new canmunity coordinator for Daytons Bluff.
He read a letter from the Daytons Bluff Cormnunity Council in unanimous opposition
to the rezoning requestt saying there are other sites where the real estate
office could be built in a commercial area. He referred to the traffic situation
and parking problems, as well as lowering of the residential property values in
the area. He said his father has lived in the neighborhood 40 years and has
seen the neighborhood go downhill , but in recent years there has been a turnaround
and from Newcomb St. on down, there is a lot of investment in rehabbing homes.
He added that residential property owners are� not being given a lot of encouragement
by introducing comnercial into a residential zone.
Mr. Pangal said that anyone buying the building, inasmuch as it is a legal nonconforming
use, would not put any money into it, but would bleed it for investment. He said
OS-1 would encourage the owners of property to maintain it and he wondered if
District 4 would object to an OS-1 .
Mr. Wagner said as far as the neighbors are concerned, they probably would be more
acceptable to OS-1 , but the City Council might not because they are trying to
encourage completely residential areas.
Ms. Claudia Jorgenson, 1220 Ross, opposing the rezoning r�quest, said they had
bought their beautiful home and told of the addition onto it, �nd said that comnercial
zoning on the corner property would make people reluctant to move into the area.
Mr. George W. Rieff, 862 Atlantic, said he owns five lots plus a beautiful home,
and he opposed the rezoning, saying there is a terrible traffic problem with AA.
He told of contacting the police, who say AA have been no trouble. Mr. Rieff wondered
why a duplex could not be put on the property, and why AA?
Mr. Bryan explained the legal nonconforming use.
Mr. Ken Honebrink, 1232 E. 7th Street, said he has known the Arrigonis many years
and he would not be opposed to OS-1 zoning, but would prefer to leave it the way it is.
He said although they say there is no intention of putting in a bar, that intention
might be changed. He opposed the requested rezoning because he thought it would
lower property values in the area. He said he is part owner of the adjacer�tsite.
Mr. Richard Honebrink, 1232 E. 7th St. , also part owner of the adjacer�tsite, said
possibly more people at the hearing would be in agreement with an OS-1 zoning.
He felt that B-3 would just open the door to changes in the future and asked for
denial of the petitoner's request.

Mr. R. Arrigoni said there was a misunderstanding about B-3, as they have no
intention of putting in a �liquor store. He said AA probably will not stay there.
He added that he would be very well satisfied to go for an OS-1 zoning for a
grocery store or whatever. He said the Arrigonis have a two-man real estate
office and that is all it ever was.
Mr. Del Ar�igoni said the lease of AA runs through Dec. 31 , 1978, and his son,
Robert Arrigoni , added that AA wants to renew for another five years.
Mr. Bryan asked if Mr. Del Arrigoni was saying he wanted to change his request to
OS-1 and the answer was yes. Mr. Straughn stated that this was proper.
Mr. Pangal moved to recommend approval of the OS-1 rezoni,ng. His motion
was seconded by Ms. Grittner and passed on a 6 to 0 roll call vote.

This letter is written in response to the petition of Rice Investors to rezone
property located at 1236-1238 E. Seventh Street (Southwest corner of E. Seventh
& Atlantic) from RT-1 (Two-Fami7y Residential) to OS-1 (Office Service).
This matter was heard before the Current Planning & Zoning Committee on December
15, 1977 at which time the petitioner, Arrigoni Brothers, changed their original
request of rezoning from RT-1 to B-3 to RT-1 to OS-1 . Staff recom�nended denial
of the original request to rezone from RT-1 to B-3. Staff recommended at the
Current Planning & Zoning Committee meeting that the revised request to rezone
from RT-1 to OS-1 be approved. Mr. Pangal moved to recommend approval
to rezone to OS-1 . Ms. Grittner seconded the motion and it passed on a 6 to 0
roll call vote.
On December 16, 1977 the Planning Commission confirmed the recommendation of the
Current Planning and Zoning Committee by a 17 to 0 vote.
This meeting is scheduled to be heard before the Saint Paul City Council on
January 26, 1978.

Dear Counci I Members:
The �Dayton's Bluff Community Council would like to voice aur unanimous and firm opposition
to the rezoning from RT-I to B-3 the property at 1236-1238 East Seyenth Street, aka part of
Lot (, Block 3, Messerli nnd Eschbachs Addition.
At our Executive Board Meeting, held December Sth, the Dayton's Bluff Community Council
voted unanimously to oppose this rezoning and to support efforts of neighborhood residents to
prevent the intrusion of this new business into their community.
Such spot commercial zoning is in direct and fundamenta) confli ct with the District 4 Gen-
eral District Plan which has been approved by the residents of Datyon's Bluff, and would
dest�oy the essentialfy residential character of East Seventh Street which runs from Newcombe
Street to White Bear Avenue. It would also undercut and make shambles of the Council's
attempt to maintain and rennovate the precious few remaining neighborhoods in Dayton's
Bluff. '
In addition, a B-3 rezoning is not necessary for the avowed intent of the developer, namely
a real estate office, and would open the door to other less desirable businesses in the future,
as well as encouraging businesses of a similar nature to ask for spot rezonings on this section
of East Seventh Street. Allowing new businesses to creep into a neighborhood would doom
this section of East Seventh to the inevitable fate of one vast commercial strip.
Furthermore, such rezoning is not needed when there is ample space and opportunity for the
development of a real estate office or other business in the commercial st�ip of East Seventh
running from Moria to Duluth Streets, where new businesses arc n�eded. This is espeeially
the case in that section of East Seventh fram F�ank 10 Uuluth Stre�t, less rhan 2 blocks a-
way•from the proposed rezoning site, and where no rezoning should be necessary. Why
destroy a neighborhood, even a border neighborhood, with the intrusion of a new business
when sites just a short distance away ore vacant and begging for new owners?

� Finally, the noise and air pollution from heavy truck and car traffic on fast Seventh already
discouroges people from residing on East Seventh. More businesses would add to this prablem,
cousing traffic and parking problems, and further (owering residenticl property values as well
as destroying any neighborhood. It is time to put a stop to the encroachment of businesses
on new property and neighborhoods of East Seventh Street and encourage them to maintain,
renno'vate, and develop the existing commercial strip of East Seventh.
On behalf of residents of the East $ide, we strongly urge you to de�y Rice Investors their
petition to rezone this property.

15 ft. ceilings, with taxes at $1300 per year. He said it had been purchased
for the Arrigoni real estate office subject to the lease to Alcoholics Anonymous
which will expire December 31 , 1978. He said the site is a $60,000 investment
and their real estate office takes 1/3 of the building. He said they should
be getting more money than they are getting from Alcoholics Anonymous ($300/mo.
for 4000 sq. ft. )
Mr. Pangal asked the petitioner if he would consider reducing his request to OS-1 .
Mr.Arrigoni asked if OS-1 would include a liquor store and Mr. Pangal answered no.
Mr. Arrigoni said the Red Mill might be condemned and might ma�ke him an offer.
Mr. Robert Arrigoni , 2171 Valley View Place, the son of Del Arrigoni , said he grew
up 3 blocks from the subject site when it was a grocery store. He said AA will not
be able to stay in the building after their lease runs out next year. He added
that AA has meetings every day, six days a week. He said the Arrigonis intend to
have the building used for more of a business place, and they have no intention
at the present time to put in a liquor store.
Mr. Humner asked if the present zoning had been known when they purchased the
property, and Robert Arrigoni said yes--they had received a letter from the City
of Saint Paul saying they were nonconforming. He said the building could not be
residential with the high ceilings, etc.
Mr. �Bruce Lightner, 1235 Ross, spoke in opposition to the rezoning request. He
submitted a petition signed by 47 neighbors who live within 350 feet and read
a prepared statement of opposition. Upon being queried by Ms. Grittner, he said
people do park in his backyard where there is no garage.
Mr. Orlando Messerli , 1216 East Seventh Street, said he was interested in trying
to keep up the neighborhood, and that anything below Newcomb Street is definitely
commercial but has deteriorated. He said the corner lot had been a grocery store
for three generations, and all the neighbors were glad to have a grocery store there.
They feel if it is rezoned, a liquor store could very easily be put there, and
property values would go down. He said the Red Mill and other tavern are far

enough away that they do not get the noise, but on this corner noise would affect
all the homes in the area. He said young people have invested their money and
are trying to build up the neighborhood and trying to protect their investments.
Mr. Messerli said that if Mr. Arrigoni bought the property knowing it was zoned
wrong, it is their own fault.
Mr. Ron Wagner, 1787 East Minnehaha, said he represented his father at 1212
East Seventh St. and he also is the new community coordinator for Daytons Bluff.
He read a letter from the Daytons Bluff Community Council in unanimous opposition
to the rezoning request� saying there are other sites where the real estate
office could be built in a commercial area. He referred to the traffic situation
and parking problems, as well as lowering of the residential property values in
the area. He said his father has lived in the neighborhood 40 years and has
seen the neighborhood go downhill , but in recent years there has been a turnaround
and from Newcomb St. on down, there is a lot of investment in rehabbing homes.
, He added that residential property owners are not being given a lot of encouragement
by introducing commercial into a residential zone.
Mr. Pangal said that anyone buying the building, inasmuch as it is a legal nonconforming
use, would not put any money into it, but would bleed it for investment. He said
OS-1 would encourage the owners of property to maintain it and he wondered if
District 4 would object to an OS-1 .
Mr. Wagner said as far as the neighbors are concerned, they probably would be �hore
acceptable to OS-1 , but the City Council might not because they are trying to
encourage completely residential areas.
Ms. Claudia Jorgenson, 1220 Ross, opposing the rezoning request, said they had
bought their beautiful home and told of the addition onto it, and said that commercial
zoning on the corner property would make people reluctant to move into the area.
Mr. George W. Rieff, 862 Atlantic, said he owns five lots plus a beautiful home,
and he opposed the rezoning, saying there is a terrible traffic problem with AA.
He told of contacting the police, who say AA have been no trouble. Mr. Rieff wondered
why a duplex could not be put on the property, and why AA?
Mr. Bryan explained the legal nonconforming use.
Mr. Ken Honebrink, 1232 E. 7th Street, said he has known the Arrigonis many years
and he would not be opposed to OS-1 zoning, but would prefer to leave it the way it is.
He said although they say there is no intention of putting in a bar, that intention
might be changed. He opposed the requested rezoning because he thought it would
lower property values in the area. He said he is part owner of the adjacentsite.
Mr. Richard Honebrink, 1232 E. 7th St. , also part owner of the adjacer�tsite, said
possibly more people at the hearing would be in agreement with an OS-1 zoning.
He felt that 6-3 would just open the door to changes in the future and asked for
denial of the petitoner's request.

Mr. R. Arrigoni said there was a misunderstanding about B-3, as they have no
intention of putting in a liquor store. He said AA probably will not stay there.
He added that he would be very well satisfied to go for an OS-1 zoning for a
grocery store or whatever. He said the Arrigonis have a two-man real estate
office and that is all it ever was.
Mr. Del Arr�igoni said the lease of AA runs through Dec. 31 , 1978, and his son,
Robert Arrigoni , added that AA wants to renew for another five years.
Mr. Bryan asked if Mr. Del Arrigoni was saying he wanted to change his request to
OS-1 and the answer was yes. Mr. Straughn stated that this was proper.
Mr. Pangal moved to recommend approval of tl� OS-1 rezoning. His motion
was seconded by Ms. Grittner and passed on a 6 to 0 roli call vote.
