WHEREAS, Jerry Nelson d/b/a Jerry Nelson Construction Co. ,
Inc. is the holder of a building contractor license issued by
the City of Saint Paul; and
WHEREAS, the License Inspector has recommended denial and
revocation of said license based on the following grounds:
"1. Willful abandonment of contract.
2. Delay in completing agreed upon contracts,
causing undue hardship and concern for the home owner.
3. Misrepresentation of ma.terial to be used.
4. Failure to provide notice of right to
lien, as required by law.
5. Default of contract due to failure to
complete in workma.nlike manner."

WHEREAS, this recommendation was communicated in writing and
verbally to the licensee, together with notice that a hearing would
be held before the License Committee on January 25, 1978 (which was..,.:
continued from January 18, 1978, at the request of the licensee) ;
and
WHEREAS, a hearing was held on January 25, 1978, at 9:00 A.M.
in the City Council Chambers before the License Cocncnittee, at which
hearing neither the licensee nor his attorney chose to appear; and

WHEREAS, the License Committee received testimony and exhibits
from John Thomson, Assistant Attorney General; Connie Green, State
Office of Consumer S�rvices; Howard Waldon, Lloyd Green, James
Ma.rtin, Catherine Stokes, Larry Anderson, Larry Bender, Ernest
Parker, and Neal Nordlund, all homeowners in Saint Paul; and Curtis
Miller, St. Paul Housing and Redev�lopment Authority; and
WHEREAS, the evidence clearly established that the licensee
habitually and regularly did not complete contracts ; did not even
begin work on contracts despite having received payments ranging
as high as $800; did not complete work in a workmanlike. fashion;
did not employ experienced or skilled employees, or failed to super-
vise employees who were inexperienced, all to the detriment of con-
sumers; failed to give legally required notice of lien rights as
required by Minn. Stat. � 514.011; misrepresented methods, materials
and time required for carrying out contracts ; and seldom responded
to customer complaints or inquiries from legitima.te state agencies;
and
WHEREAS, all witnesses were sworn, and testimony recorded by
a court reporter; and
WHEREAS, the License Committee voted 3-0 to recommend that the
City Council revok� and deny the building contractors license held
by the licensee, and to instruct the City Attorney to cause a trans-
cript of the hearing to be prepared and forwarded to the County
Attorney and the City Chief Prosecutor for such action as may be
warranted; and
WHEREAS, a copy of this resolution has been ma.iled to the
licensee prior to its consideration by the City Council; now,
therefore, be it

RESOLVED, that the building contractor' s license held by
Jerry Nelson is hereby denied and revoked, and the City Attorney
is directed to make the transcripts of the hearing available to
the County Attorney and the City Chief Prosecutor for such further
investigation or action as may be warranted.
