Dear Mr. Barry: .
The application of the Knights of Columbus, Council No. 397, for
the on-sale liquor license presently held by the City of Saint �
Paul has been reviewed by the License Inspector and the City
Attorney' s office. You have met all financial qualifications .
and your proposed site has been approved. As you know, one
other applicant for this license has been approved by the
License Inspector' s office. Therefore, pursuant to Section
308.31 of the Saint Paul Legislative Code, the Council has set
� the date of January 5, 1978, as the date for choosing the organ-
ization which will receive the liquor license. The organization
will be chosen by random selection on that date at 10:00 a.m. in
the Chambers of the City Council on the third floor of the City-
County Courthouse. The selection will be in accordance with
. Section 308.31 (b) of the Legislative Code, which provides as
follows: �
(b) At the public hearing, the Secretary of the Council
shall place the names of all eligible applicants on sep-
arate, equal-sized pieces of paper, under the supervision
of the Council. Such pieces of paper shall be placed in
an opaque container, from which one name shall be drawn
at random by a member �of the Council as designated by the
presiding officer of the Council. The applicant so se-
lected shall be announced, and shall be awarded the license,
by resolution, upon payment within forty-eight (48) hours
thereafter of the remaining ninety per cent (90/) of the
special issuance excise tax.

I would also like to call your attention to Section 308.33 of
the Saint Pau1 Legislative Code, which provides as follows:
308.33. Council Contact Prohibited. No person may com-
municate with any member of .the City Council regarding
any application or applicant for re-issuance of a license
pursuant to these sections, unless such communication is
made during the course of a public hearing before the
Council or License Committee held pursuant to these sections.

The application of Bear Construction, Inc. , for the on-sale
liquor license presently held by the City of Saint Paul has

office. You have met all financial qualifications, and your
