BE IT RESOLVED, That the Council of the City of Saint Paul here-
by ratifies and approves the action of the City of Saint Paul Board
of Appeals and Review pertaining to the following listed property and
as shown by the Excerpted Minutes of said Board of Appeals and Revieva,
dated January 10, 1978, and marked EXHIBIT A, and attached hereto and
made a part hereof by reference:

financial loss if appellant could not sell property as a 9-unit building.

PROCEEDINGS:
Mr. Bolin related that the city had allowed occupancy in I970 on con-
dition that a fire escape be provided from the third flaor unit, but
the waiver was effective orily so long as he owned the property. He
now wished to sell it on the basis of a 9-unit rental income . If he
could not do so, he �wou�d� be obliged to sell at a lower price , which
would cause financial hardship. The 1970 waiver also applied to a
basement unit, for which he was asking a continuation of occup ancy.
Alice Bijjani noted that the stairway between the first and second floor
was not enclosed, according to the inspection report, and she felt this
should be done for the purpose of containing smoke from spreading rapidly
to upper floors in case of fire . She inquired as to the size of the
win dows in the basement apartment, and Mr. Bolin said they were about
30" by 30" , larger than the usual basement window an d easily accessible
in case of emergency. Ms . Bijjani agreed that the window size appeared
to be adequate, and that the Code Enforcement Division would not object
to Mr. Bolin' s w aiver rec{uest.
BOARD ACTION:
Mr. Glassman moved to grant a change in the type of waiver previously
granted in 1970, from a waiver effective only for the period of owner-
ship to a waiver effective for the lifetime of the structure , on con-
dition that a city housing inspector approve� the basement unit and the
access to the third floor unit , and that any other recommendation of the
city inspector, such as the enclosing of tlie stairway from the first
floor to the second floor, be followed. Mr. Heider seconded. MOTION
CARRIED AND SO ORDERED.
