WHEREAS, Cicero Flood is the holder of a Restaurant C-1 License
#6354 and Cigarette License 1�6355, both for the premises at 264 West
Seventh Street, Saint Paul; and
FIHEREAS, the License Inspector has recommended that the City
Council revoke said licenses on the following grounds:
"1. September 11, September 30, October 15,
October 22 and October 27, 1977 - .
Selling and/or permitting the sale and/or consumption
of alcoholic beverages on premises without a license.
2. October 27, 1977 -
Allowing person and/or per.sons to use the licensed
premises (264 W. 7th) for the purpose of engaging in
the solicitation and/or acts of prostitution.
3. March 6, 13 and 14, 1976; August 12, 14 and
19, 1976; September 17 and 18, 1976 and March 4, 1977 -
Allowing and/or permitting the sale and/or consumption
of alcoholic beverages on premises without a license.";
and
WHEREAS, these grounds and the recommendation of the License
Inspector, together with notification that a hearing would be held
on January 18, 1978, at which the licensee could be represented by
counsel, were communicated to the licensee by both regular and

certified ma.il, to both the licensee' s home address and his licensed
bu�iness address on December 28, 1977 ; and
WHEREAS, the licensee was in addition personally notified by
the License Inspector on January 16, 1978, and the licensee did not
request a continuance; and .
WHEREAS, despite adequate notice, the licensee chose not to
appear at said hearing, and said hearing was held in �toom 707 of
the Courthouse on January 18, 1978, before the License Committee;
and
WHEREAS, the License Committee received testimony from Officers
C. Kelly and Edward Lundholm; Sgts. Ma.rk Jessen and John Voita,
all of the Saint Paul Police Department; Raymond J. Perron, Investi-
gator, State Crime Bureau; Michael J. Aa.restad; and received police
reports, laboratory reports and other docu.mentary evidence, numbered
as Exhibits 1 through 19; and
WHEREAS, the evidence established beyond any doubt'whatever
that the licensee had regularly and habitually sold and dispensed�
alcoholic beverages and into�icating liquor on the restaurant premises
without possessing the required license; that the licensee per-
mitted and received money from prostitution and solicitat�.on to vice
which occurred on the licensed premises; that the lieensee knew and
was aware that his actions in selling intoxicating liquor and alco-
holic beverages were in violation of law and licensing regulations;
and
WHEREAS, the License Committee voted 2-0 to recommend that '
the City Council revoke all licenses held by the licen�ee for the
premises at 264 West Seventh Street; and
WHEREAS, a copy of this resolution as proposed has been ma.iled
to the licensee at his home address and at the licensed premises,
with notification that he has the opportunity to appear before the
City Council to argue against its adoption and to comment on its
wording; now, therefore, be it
