WHEREAS, the Director of the Department of Human Rights has
determined that he has reason to believe that a violation of
Chapter 74 of the Saint Paul Legislative Code has occurred; and
WHEREAS, the Director desires to initiate civil enforcement
procedures pursuant to Section 74. 13; and
WHEREAS, the respondent in the action will be a City depart-
ment, the Department of Public T�Torks, represented by the Office of
the City Attorney; and
WHEREAS, the City Attorney cannot, by reason of the divergence
of the interests involved, represent both the Director of the
Department of Human Rights and the Department of Public Works in
this action; and
WHEREAS, Section 5.02 of the City Charter permits the appoint-
ment of special counsel where "by reason of interest" the City
Attorney is unable to act in behalf of the City or any of its
departments; and
WHEREAS, it appears that this is an appropriate case for the
appointment of special counsel, and the City Attorney has been
requested by the Director of the Department of Human Rights to
appoint such counsel; now, therefore, be it
RESOLVED, that Pierre N. Regnier, attorney at law, is hereby
appointed to represent the Director of the Department of Human
Rights in carrying out civil and judicial enforcement procedures
under Sections 74.13 and 74. 14 of the Saint Paul Legislative Code
in the ma.tter of Donald Lewis ex rel. Elizabeth J. Hobza vs.
Department of Public Works, et al. ; and, be it
