THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That Chapter 60 of the Saint Paul Legislative Gode, as amended, is hereby further amended by adding a new Section 60. 394 to read as follows: 60.394 Day Care: The care of one or more children on a regular basis, for periods of less than 24 hours per day, in a place other than the child' s own dwelling unit. Day care includes family day care, group family day care, and group day care, as hereinafter defined: a. That Section 60. 412 of the Saint Paul Legislative Code is hereby amended by designating the present subsection "i" as "j" and adding a new sub�ection "i" to read as follows: i. Family day care. Section 3. That Section 60. 413 of the Saint P�,ul Legislative Code is hereby amended by designating the present subsection ��j�� as subsection "1�� and adding new subsections "j " and "k" to read as follows: j . Group family day care, provided that no more than three (3) such facilities shall be located on property abutting either side of a street and lying between the two nearest intersecting streets or between the nearest intersecting street and a railroad right-of-way, unsi�bdivided acreage, body of water, or other physical barrier to the continuity of development, or between the nearest intersecting street and the corporate boundary line. �`�(��2�9 Page 3. k. Group day care, provided that it is located in a non-residential structure currently or formerly occupied by a church, school, publicly owned recreation facility, municipal building, or other similar use permitted as a principal use or as a principal use permitted subject to special conditions. Section 4. That Section 60. 422 of the Saint Paul Legislative Code is hereby amended by designating the present subsection "c" as subsection "d" and adding a new subsection "c" to read as follows: c. Group family day care and group day care. Section 5. That Section 60. 423 of the Saint Paul Legislative Code is hereby amended by deleting subsection '�c" in its entirety and by redesignating subsections "d, " "e, " and "f" as sub- sections "c, " "d, " and "e, " respectively. Section 6. That Sectior� 6f�.462 of the Saint Paui Legislative Code is hereby amended by designating the present subsection "b" : as subsection ��c" and adding a new subsection "b" to read as follows: b. Family day care, group family day care, and group day care. Section 7. That Section 60. 472 of the Saint Paul Legislative Code is hereby amended by designating the present subsection "e" as subsection "f" and adding a new subsection "e" to read as follows: e. That Section 60. 482 of the Saint Paul Legislative Code is hereby amended by designating the present subsection "k�� as subsection "1�� and addiag a new subsection "k" to read as follows: k. Section 10. That Subsection "a" of Section 60.532 of the Saint Paul Legislative Code is hereby amended to read as follows: a. That Section 60.534 is further amended by adding new subsections "a" and "h" to read as follows: a. All uses as permitted and as regulated in the B-3 Business District under Principal Uses Permitted Subject to Special Conditions. h. Enclosed are copies of Planning Commission Resolution 77-30 and the specific text amendments to the zoning ordinance proposed. These amendments pertain to the following: 1 . Allow day care to operate in more locations than are presently available. 2. Specifies the parking requirements for indoor tennis courts open to the general public. 3. When parking requirements are not specified for a proposed use and no similarity can be found with listed uses, then the Planning Commission may directly set the number of parking spaces required. These proposed amendments were discussed at a public hearing before the Planning Comnission on August 12, 1977, in accordance with the requirements for a 40 Acre Study. WHEREAS, the City of Saint Paul Planning Comnission initiated a 40 acre study to amend chapters 60 and 64 of the St. Paul Legislative Code at their regular ; meeting on June 24, 1977; and WHEREAS, the Current Planning Committee of the Planning Comnission reviewed the suggested ordinance amendments and has recommended them to the Planning Commission for approval ; and WHEREAS, pursuant to said chapter § �62.357(5) the Planning Carmission did hold a public hearing on the requested amendments at its regular meeting on August 12, 1977; and WHEREAS, the Planning Commission has determined: 1 . That the number of real estate descriptions affected by the ordinance renders the obtaining of written consents impractical , 2. That a survey of an area in excess of 40 acres has been made, 3. That a determination has been made that the amendments to this ordinance proposed are related to the overall needs of the community, to existing land use and to a plan for future land use, and 4.
