1 WHEREAS, the Council of the City of Saint Paul, upon the petition of the Saint Paul Port Authority,
2 as contained in resolution Council File # 96-316, dated Mazh 27"', 1996, approved the vacation and
3 discontinueance as public property, the following: See Attached Exhibit "A"; and

5 WHEREAS, an error was found in the desciption which approved the said vacation of City owned
6 public property in Council File # 96-316, and

8 WHEREAS, the petitioner and City of Saint Paul Department of Public Works have requested that the
9 legal desciption for said vacation be corrected; so

11 THEREFORE BE IT RESOLVED, that Council File #96-316 is hereby amended with the following
12 changes:

14 I) The descripuon in Exhibit "A" (Council File #96-316) is revised to the description in Elthibit "B"
15
16 AND BE IT FURTHER RESOLVED, that all other terms and conditions set forth in
17 Council File #96-316 shall remain in full force and effect.

ItESOLVED, that upon the petition of the Port Authority of the C�ty of Saint Paul, per Finance
File No. 15-1995, that portion of air rights above the comer of Kellogg Boulevard and Cedaz
Street, hereinafter referenced to as the description in Extubit "A", is hereby vacated and
discontinued as Public Property; subject to the following conditions:
1. That this vacation shall he suhject to the terms and condition of Chapter 130,
codified March i, 1981, of the Saint Paul Legislative Code as amended
2. That the petitioner's, their successors and assigns shall pay $500.00 as an
administrauve fee for this vacarion wMch is due and payable within 60 days
of the publication date of this resoludon.
3. That the petitioner's, their successors and assigns, by acceptance of the terms and
condition of this resolution, agre,e to identify, defend and save harmiess the
City of Saint Paul, its offlcers and employees from all suits, actions or claims of any
cbaracter brought as a result of injuries or damages received or sustained by any
person, persons, or property on account of this vacarion or peritioner's use of this
property, including, but not limited to a claim brought because. of any act of
omission, neglect, or misc.onducc of said petitioner or because of any claims of liability
azising from any violation of any law or regulation made in accordance with the law,
whether by the petitipner or any of its agents or employees.
