WHEREAS, the Director of the Department of Huma.n Rights
desires to investigate a complaint under Chapter 74 of the
Saint Paul Legislative Code involving the Department of
Community Services; and
WHEREAS, the Director has determined that subpoenas should
be sought from the District Court pursv.a.nt to Section 74,10(D)
of the Saint Paul Legislative Code, for the purpose of assisting
in said investigation; and
WHEREAS, the City Attorney cannot, be reason of the
divergence of their interests, represent both the Director
and the Depar tment of Community Services in appearing in
District Court Qn the .question of subpoenas; and �
Wfi�REAS, Section 5.02 of the Ci�� eharter permits the
appointment o� special counsel where 'by reason of interest"
the City Attorney is unable to act in.beha.lf of the city or.
any of its departments; and '
WHEREAS, it appears that this is an appropriate case
for the appointment of special counsel, and the City Attorney
has so requested; now, therefore, be it
RESOLVED, that R. Scott Davies, Attorney at Law, is hereby
appointed. to _represent the Di�ector of the Department of Human
Rights for the sole purpose _of seeking subpoenas in Ramse�
County District" Court under Section 74. 10(D) in the investi-
gation of the Department of Community Servi,ces now underway.
