WHEREAS, Section 74.13(D) of the Saint Paul Legislative
Code provides tha.t hearings before the Htunan Rights Commission
on charges of discriminatory practices shall be presided over
by an attorney who is not a member of the Commission, to rule
on legal questions and chair the hearing; and
WHERFA S�, the Office of the City Attorney represents the
Director of the Department of Human Rights in presenting the
�h.arges of discrimination to the panel, as an advocate for the
position of the Director; and
WHEREAS, therefore, the Office of the City Attorney cannot
by reason of conflict of interest provide an attorney to the
Commission to serve as hearing officer; and
WHEREAS, Section 5.02 of the Charter of the City of Saint
Paul, and Section 2.05 of the Administrative Code, empower the
Council, upon the request of the City Attorney, to appoint
special counsel and provide compensation therefor, in cases
where the City Attorney cannot by reason of conflict of interest
provic�e ?.�representation; now, therefore, be it
RESOLVED, tha.t the Council hereby, upon the request of the
City Attorney, appoints Judith L. Oakes as special counsel to
act as hearing officer in a discrimination case entitled
"Donald Lewis, Director, Department of HUman Rights ex rel.
Jegnne Smith vs.. Amoco Chemical Corporation, dba Amoco Plastic
Products Company", and fixes the compensa tion at $40.00 per
hours; such compensation to be paid out of t�e budget of the
Department of Huma.n Rights.
