WHEREA�, pursuant to the directives of Chapter 764 Laws of
Minnesota 1973, the City of Saint Paul, the Houaing and Redevelopment
Authority, the Science Museum of Minnesota and Sherman-Antler Joint
Venture entered into a Development Agreement, dated October 7, 1975
providing for the purchasa fram the Authority and the redevelopment of
Block 7A by the canstruction of a public Parking Ramp by the City,
the construction of a Science Museum by the 3cience Museum, and the
construction of an apartment building, medical office building ., and
an enclosed public area (Gallery) by Sherman-Antler; and
WHEREAS. by Amended Agreement betwean the parties in .Februa.ry,
1977, Fountain Development was substitutad fo� Sharman Antler as
Developer under the Development Agreement of October 7, 19�75, and the
contract for A irspace over a portion of the parking facility on July 15,
1976t and
WHER.EAS, Fountain Development has reque�ted that the City of Saint
Paul enter into a vertical Easement Agreement with Fountain Development
so as to allow for the efficient construction, opeYation and maintenance
of the Ramp, Medical Off ice Building, and the Gallery; and
WFiEREAS, the Diractor of Planning and Economic Development deems
such a�n a�greement is in the best interest of the redevelopment in
Block 7A and the City of Saint Paul.
NOW THEREF'ORE BE IT RESOLVED, that the proper city officials are
hereby anthorized and directed to execute on behalf of the City of
Saint Paul a vertical Easement Agreament between gountain Development
and the City of Saint Paul in accordance with the terms and conditions
on file in the office of the City Attorney.
