Resolutiox�. and copy for'th.e City Ga;t�:rk. \ .� , . � ,- Title of class: CONTRACT COMPLIANCE SPECIALIST--HUMAN RIGHTS ������ DESCRIPTION OF WORK General Statement of Duties: Conducts compliance reviews of contractors and employers doing business with the City of St. Paul; assists in investigation of complaints of discrimination involving non-compliance of contractors; and performs related duties as required. Supervision Received: Works under the general supervision of a unit or department head. Supervision Exercised: None. TYPICAL DUTIES PERFORMED The listed examples may not include all duties performed by all positions in this class. Conducts compliance reviews of employers who contract with the City to determine acceptability of affirmative action plans (AAP) . Makes a detailed analysis of the contractors ' total employment composition, procedures and practices, including a determination and evaluation of all factors which affect the employment program. Develops statistical analysis, interviews and takes the statements of potential witnesses and assists in preparing cases for enforcement of affirmative action codes and regulations. Visits community agencies to determine the degree of contractor activity which demonstrates the implementation of his AAP for protected class persons. Negotiates with contractors regarding situations covered by guidelines and precedents. Investigates specific non-compliance allegations. Prepares written evaluation reports including detailed documentation of the investigation and recommendation action. Assists in formulating and negotiating equitable resolutions of compliance deficiencies. Participates in the conduct of special social and industrial studies pertinent to EEO matters. Identifies potential and actual problem areas, develops realistic and comprehensive approaches to bring about compliance by contractors and works to establish rapport with management and labor groups. Analyzes and develops information on contractor status as an Equal Opportunity Employer. Discusses compliance issues with contractor personnel and provides technical information relative to specific program areas. Conducts and assists in conducting closeout conferences with officials and the contractor and participates in presenting the findings and recommendations to be implemented for compliance. OF 'PHE CITY COUNCIL �e:.eoom �....e.e�a.s .�.z.�.a June 26, 1978 RUBY HUNT Councilwoman T0: City Council Members FROM: Ruby Hunt, Chairman �� Finance, Management & Personnel Committee SUBJECT: Reconsideration of Council action in connection with positions in Human Rights Department I am hereby requesting the Council to reconsider its action on June 20th in connection with the Resolution establishing the title of Contract Compliance Specialist-Human Rights. The Finance Corranittee recommended approval of this resolution with the contingency that the Civil Service Commission take action to abolish the title of Assistant Director-Human Rights. It was called to my attention by a delegation from the Human Rights Commission that this action would cause considerable delay in filling the position of Contract Compliance Specialist, which position is greatly needed at this time. An additional factor is that the position of Assist- ant Director is part of the Human Rights Ordinance. Since the position of Assistant Director is now vacant and has been for some time, I believe it would be advisable to proceed to establish the new position and request no action on the part of the Civil Service Comrnission in connection with the position of Assistant Director. On Tuesday, June 20, 1978, the Human Rights Commission met to consider the action taken by the Finance, Management and Personnel Committee on June 5, 1978, regarding the following matters: A. A resolution establishing the title of Contract Compliance Specialist--Human Rights. B. Preparation of a resolution abolishing the title of Assistant Director--Human Rights. C. The stipulation which recommended that no action be taken on the title of Contract Compliance Specialist by the City Council until the matter has been referred to the Civil Service Commission for concurrence and returned to the City Council . It is the Human Rights Commission's recommendation that the resolution establishing the job title of Contract Compliance Specialist be acted upon without delay. This position was recommended by a Special Study Committee headed by Budget Director Richard E. Schroeder, assisted by Ed Vizard, Personnel Department; Ron Kline, Budget Director's Office; and Dana Young, Mayor's Office. e � _`Z_ ` The purpose of their study was twofold: (1 ) to review the operations of the Human Rights Department, and (2) to determine the workload associated with the change in the Contract Compliance Program. Based on their findings, this Special Study Corrmittee recorr�nended the addition of a Contract Compliance Specialist to the staff of the Human Rights Department. Their recorr�nendation received the approval of the Mayor's Office, Civil Service Commission and, on June 5, 1978, was approved by the Finance Corr�nittee with an attached stipulation. It is the attached stipulation that has caused deep concern among the Human Rights Commission Members� since tne proposed Contract Compliance Specialist title has no relationship whatso- ever to the position of Assistant Director--Human Rights, which the stipulation presumably intended to abolish. One of the main factors that contributed to the recommendation made by the Special Study Committee was its feeling that a full time employee with specialized skills and a high level of competence, tact, and initiative was needed to meet the new Contract Compliance responsibilities. The Schroeder Committee also emphasized that, in view of the complexity of the Contract Compliance task, it would not be possible for current employees in the Human Rights Department or any other City agencies to absorb the additional workload on a piece-meal fashion. Given the urgent need for this position, the Human Rignts Corrvnission respectfully requests that the City Council consider without further delay, the adoption of the title of Contract Compliance Specialist--Human Rights. With respect to the title of Assistant Director--Department of Human Rights, it is the Comnission's position that, since this would require an amendment to the Human Rights Ordinance and since the position has not been funded since 1975, no action �" -3- should be taken on this matter until the Human Rights Commission has had an opportunity to conduct a full study to determine why this dormant position, out of a number of unfunded positions, has been selected for abolition and what ramifications it would have in the future.
