RESOLVED, That the Council of the City of Saint Paul hereby authorizes .
the proper City officials to execute a lease agreement with the East Side
YMCA Community Center for the lease of Room 101 of the Mounds Park Recreation
Center during the months of June, July, and August, 1978; said lease being
in consideration of the payment of $459.00 by the Center to the City and
upon the proper insurance, as set forth in said lease agreement,being furnished
to the City at the Center's expense.

LEASE AGREEMENT
THIS AGREEMENT, Dated this day of , 19'78, by and '
between the CITY OF SAINT PAUL, Minnesota, hereinafter referred to as "City",
and EAST SIDE Y.M.C.A. COMMUNITY CENTER, hereinafter referred to as
"Center", for the le�se of portions of the City's Mounds Park Recreation Center,
1000 Pa cific Street, Saint Paul, Minnesota, hereinafter referred to as "Facility";
WITNESSETH:
IT IS MUTUALLY AGREED BY AND BETWEEN THE CITY AND CENTER AS
FOLLOWS:
l. In consideration of Four Hundred Fifty Nine and no/100 Dollars ($459.00)
to be paid by Center, the City hereby leases to Ce nt e r those portions of its
Facility for the dates and times set forth below. The sum payable by the Center to
the City shall be remitted in full on September I, 1978.
2. During the months of June, July, and August i9�8, the Center shall have the
exclusive use of Room 101, Monday through F rida v from 6:3 0 a.m. to 6:00 p.m. and
the use of the Kitchen Facilit�r, Monday threu�h Friday from 8:00 a.m. to 12:30 p.m.

shall only be done with the l�: i:,r al�pro��al ��f c;��, ��ity�'s Su��crintendent of 1'arks and

5. Center will save ar.il holci harmle�s the �itv fron� anv and all claims of what—
ever kind that may arise out of it and its staff anci studer.ts' participation in the course
of instruction referenced herein. ln order to �ive this indemnification of the City by
Center full force and effect, Centeragr.eesto provide, at its own expense, general

public liability insurance in the amount of One }{undred Thousand Dollars ($100,000.00)
per individual injury or death, and Three Hundred Thousand llollars ($300,000.00) in �
the aggregate. Additionally, Center t,rill provide, at its own expense, Workers' Compen-
sation Insurance in the statutory amounts and Property Damage Liability Insurance in
the amount of Fifty T�housand Dollars ($50,000.00). Such insurance as referenced here-
in shall name the City as a co-insured and shall be presented to the City Attorney on
June 1, 19�8.
6. Except as qualified above, it is contemplated that this agreement shall commence
June 1, 1978, and shall terminate on September 1, lg'78. At any time during the course
of this agreement, either party may terminate the agreement without cause upon th��^ty
(30) days' written notice of one party to the other.
'7. Center agrees that at all times hereunder they are independent contractors,
not regular employees of the City, and, accordingly, are not entitled to any of the benefits
of regular employees of the City.
