i WHEREAS, on June 5, 1986 the Council approved Council File # 86-738, a resolution vacating all that part of
z Cedar Street lying south of Como Avenue and north of Chazles Avenue, as originally platted in Dawson and
s Smith's Addition to the City of Saint Paul, said vacation to accommodate the development of a senior housing
a project; and
s WHEREAS, the said vacation was approved subject to certain conditions, including that the petitioner assume
e all costs of:
�• maintaining a fire lane for emergency vehicles only, keeping it free from snow and providing proper
s signage:
9• abandoning an existing sewer and service connections; and
io • abandoning an existing 6 inch water main; and
i� WHEREAS, the azea was never developed for senior housing, and the vacated right-of-way continues in use as a
iz public street; and
is WHEREAS, the owners of the property vacated by the said Councii File # 86-738 have offered to rededicate a
ia an easement for street and right of way purposes on, over, under and across the vacated area;
is THEREFORE BE IT RESOLVED, that conditions listed in those certain Pazagraphs numbered 2, 2-a., 2-b., 2-
i6 c., 3, 4 and 8, of Council File # 86-738 aze hereby rescinded; and;
i� BE IT FURTHER RESOLVED, that the proper City officiais are hereby authorized and directed to accept the
is dedication of that part of Cedar Street vacated by Council File # 86-738, and to accept and file the two (2)

DEDICATION OF EASEMENT FOR STREET PURPOSES
CAPITOL HEIGHTS CTTY HOMES LLC, a Minnesota Iimited liability company,
Crrantor, for good and valuable consideration, to them in hand paid and the receipt of which
is hezeby acknowledged, does hereby grant, bargam, sell and convey to the City of Saint
Paul, a municipal corporation of the State of Minnesota, its successors, and assigns, as
Grantee, a permanent easement for street putposes on, over, under and across the following
tract of land being in the County of Ramsey, State of Minnesota, described as follows:
All of that part of Cedar Street lying South of Como Avenue
and North of Charles Avenue, which accrued to Hinken's
Rearrangement and Biock 3, IIawson and Smith's Addition to
the City of St. Paul, by reason of the vacation thereof.
To have and to hold the same forever. The Crrantor does covenant that it is well seized in fea
of the land and premises aforesaid, and has good right to seli and convey the same free of all
encumbrances. The Grantor also covenants that the above granted easement is in the quiet
and peaceable possession of the Grantee. The Crrantor will warrant and defend against all
persons lawfully claiming the whole or any part thereof, subject to encumbrances, if any,
hereinbefore mentioned. It is intended and agreed that this Dedication of Easement shall be a
covenant running with the land and shall be binding to the fullest extent of the law and equiry
for the benefit of the public. It is further intended and agreed that this Dedication of
Easement shall remain if effect without limitation as to time.
