WHEREAS, Charles F. Schwietz, V�rginia M. Schwietz, and
Charles E. Schwietz, are the holders� of Off Sale Intoxicating
Liquor License No. 2849, issued for the premises at 1100 Arcade
Street in the City of Saint Paul; and
WHEREAS, the License Inspector recommended a suspension of
said license on the following �grounds:
"(1) October 13, 1977 - You and/or an employee
of Schwietz' s at 1100 Arcade Street, did sell a
12-pack of beer to a juvenile.
(2) Ma.y 4, 197$ - You and/or an employee of
Schwietz' s Liquor Store at 1100 Arcade Street did
sell one case of beer and one 12-pack of beer to
two juveniles.";
and
WHEREAS, this recommendation and the grounds therefor were
communicated by certified ma.il to the licensees on or about Ma.y
12, 1978, which letter also informed them of a hearing on Ma,y
31, 1978, before the License Committee of the City Council; and �
WHEREAS, the licensees appeared, represented by counsel,
James Rohricht, Attorney at Law; and
WHEREAS, the License Committee took sworn testimony from
Joseph Carchedi, License Inspector; and Officers Gary Gronewald,
Steven Rollins, Keith Mortenson, and John 0'Brien, all of th�
Saint Paul Police Department; and Mr. Charles F. Schwietz, one
of the licensees; together with one exhibit; and

WHEREAS, the evidence established that Mr.Schwietz had
sold beer to a juvenile without asking for identification on
October 13, 1977, ancl had been warned by the License Inspector
that future violations would result in the ma.tter being brought '
to the License Committee; that Mr. Schwietz pled guilty to a
� citation issued for the incident on October 13, 1977, and was
fined $50; that Mr. Schwietz also sold beer to a juvenile on
Ma.y 4, 1978, but believing that he was of age; and that the
licensee and his father had beer� in the off-sale liquor business
in Saint Paul for many years; and
WHEREAS, the License Committee, considering the appearance
and demeanor of the witnesses, and the substance of their testi-
mony, voted 3-0 to suspend the said license for a period of one
day, the suspension to occur on the Tuesday next following the
publication of this resolution; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul, based
upon the recommendation of the License Committee and upon the
recitals herein, does suspend the Off-Sale �,icense held by the
said licensees for the premises at 1100 Arcade Street for a
period of one day, during which the premises are to be closed
for business, said day to be the Tuesday next following the
publication of this resolution.
