Paul Legislative Code provisions pertaining to means of egress and fire doors , because reasonable substitute measures are more feasible ; and also, request waiver of code requirement pertaining to shared bathrooms in eertain units , because of high cost . Previous Hearing 4/11/78 : Granted variance of code provision requir- ing private bathroom for each dwelling unit, so as to allow shared bathrooms on second and third floors , provided appellant would meet with city building inspector and follow his recommen dations as to the installation of fire doors , that basement area not be used for sleepirtg and second floor sleeping room not be rented, and that all other repaixs be completed. APPEAR.ANCE: None PROCEEDINGS: Ms . Bijjani reported that agreement had been reached on the installatioa of fire doors to close off the stairwell '�openings between floor levels : She said the waivers on the shared bathroom and second means of egress , as granted.�.._-for : the third floor occupancy, were no longer required, because the two apartments had been combined into one large unit. Ms . Bijjani stated that Mr. Lindeke now requested that he be allowed to rent the second floor sleeping room, whose occupant would also share the one bathroom on that floor with occupants of the two ap artments located on the same level. She said the Code Enforcement Division would not object to this arrangement, since Mr. Lindeke had agreed to make a11 required repairs that remained, including the fire door installation . Mr. Glassman suggested that occup ancy of the second floor be restricte d to no more than three persons sharing the bathroom. BOARD ACTION: Chairman Wozniak moved to grant a variance of St. Paul LegisTative Code , Section 54 . 11, paragraphs a. , b . , and c. , pertaining to bathroom facili- ties , so as to allow occupancy of two apartments and one sleeping room on the second floor, provided the number of tenants sharing ane bath- room be restricted to three . Mr. Glassman seconded. MOTION CARRIED AND SO ORDERED. THE� VOTE:' Ayes - 6 Nayes - 0 Abstentions - Q - 3- 5/9/78 - Meeting No. I40 APPEARA�tCE: Steven D. Mark and Daniel R. Po��rell , Co-Owners PFOCEEDIVGS : bir. I�iark stated that he was appealing the order to vent kitchen sinks because the seals were not broken and there was no siphonin�g. The bid received for this work was $1 ,648 to tear out a wall and install a vent. Ms . Bijjani related that the Housing Code office had recently altere d their policy in regard to venting violations , whereby vents would n ot be required if there was no siphoning, unless new fixtures were znstalled in some future time . This was not yet official policy, however. Mr. Niark then presented a diagram of the two first floor b athrooms , cited by the inspector as violations of code because each lacked a hand sink . He pointed out the lack of space, saying that the inspector had agreed there was no room for sinks . Mr. Powell said he and his partner had been ordered to completely rewire their building. He explained that all extension cord wiring, surface wiring, and various other types of hazardous wiring mentioned in the inspection report had been or would be eliminated. The owners had a bid for $3, 795 to completely rewire, but they could not obtain finan cing. Mr. Powell said that non-owner-occupied funds were just not available except in certain cases for low-income persons , for which he and his partner were not eligible . They already had first and second mortgages : on the property and were near their limit on home improvement loans . Ms . Bijjani cited the insufficient number of outlets . She said the Code Enforcement Division had worked out a compromise poli cy between the earliest electric codes and present-day codes as applied ta existing property. Under this policy, it was determined that this p articular building fell short on the number of electric outlets by eight, plus one needed in the basement . However, adding this number of outlets would overload the 30-amp service presently in use. Mr. 'Tieso� noted that the bid for rewiring specified 100-amp service to each apartment; which he felt was more than was necessary. He suggested that the owners consult with the city electrical inspector, who could advise them on ways to correct the insufficiencies at the lowest nossible cost commensurate with safety of the tenants , on a temporary basis until such time as they were able to meet the expense of complete rewiring. After diseuss.ion of the Code Enforcement Division's unofficial alteration of policy in regard to venting of plumbing fixtures, Chairman Wozniak said it was his opinion that, until the policy is officially �approved, the granting of a waiver of venting on existing plumbing should be outright, without specifying that a vent be installed when a fixture is replaced. BOARD ACTION: Mr. Glassman moved to grant waivers on the kitchen sink venting an t e bathroom sink installations . As far the electrical wiring deficiencies , appellants were directed to meet with the electrical inspector to work out a modified temporary solution for the safety of the tenants , with the intention of installing electric service to comply with code reauirements before March, 1981, when the next inspection for Certi- ficate of Occupancy would take place .
