THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAINs
Section 1.
That the Zoning Map of Saint Paul, Sheets Nos. 41 and 42, as
incorporated by reference in Section 60.401 of the -:Saint Paul
Legislative Code, is hereby amended as �ollowa:
The property on the Northeast corner of Benson
Avenue and Alton Street, more pa�ticularly described as
follows:
Al1 that part of Lots 17, 18, 19, 20, 21, 22,
23, and 24 of C. W. Youngman' s Rearrangement
of Block 2, Palisade Addition to 5t. Paul,
lying southerly of a line diattant 25 feet
southerly of, measured at a right angle to
and paxallel with, the centerline of the
Chicago, Milwaukee, St. Paul and Pacific Rail—

is rezoned from R-4 to Ri�-3.
Section 2.

� This is written in response to the petition of Stuart Corp. (Shepard Park) to rezone
property on the northeast corner of Alton and Benson from R-4 to RM-3. The legal
description is on file in the Planning Office.
This matter was heard by the Current Planning & Zoning Committee on January 5, 1978
at which time staff recommended approval of the petition. A motion to recommend
approval was made by Ms. McGinley and seconded by Ms. Grittner. The motion carried
on a 5 to 0 roll ca17 vote.
On January 13, 1978 the Planning Commission, by a 16 to 0 roll call vote, recorrmended
that this request to rezone from R-4 to RM-3 be approved.
This matter is scheduled to be heard before the St. Paul City Council on May 2, 1978.

SNEPARD PARK (Stuart Corp. #8220): An application to rezone from R-4 to RM-3 property
located on the northeast corner of�Alton and Benson for the construction of parking for
a hi-rise.
The meeting was chaired by Mr. James Bryan, the chairman.
The petitioner was present. There was opposition.
Ms. McNeally read the staff report and showed slides of the sub�ect site.
Mr. Stuart Nolan, 790 Cleveland Avenue South, said he is one of the partners of Shepard
Park. He showed photographs of the subject site and explained the intentions of
Shepard Park in trying to rezone the triangular piece of land which would otherwise
require variances.
Mr. A. J. Zschokke, 2275 Rockwood, spoke in opposition. He said he lives one block from
the subject site and claimed this was another land grab, as Shepard Park intends to
close off Benson Street. He said Shepard Park has applied for funds from many sources,
such as H.U.D. for �4 million loan, a $32 million bond, and he claimed they are already
into the taxpayers for �7z million without paying out a dime. Mr. Zschokke claimed that
Shepard Park does not really want this property for a parking lot, and that they will
never �ut anything there unless it is worth money to Shepard Park.
Ms. Herman Kaufer, 2190 Stewart Avenue, asked why Shepard Park was not asking for
a parking zone if it is going to be used for parking and wanted to know why it is being
zoned for multi dwelling if it is going to be used for parking.
Ms. Mcf�eally said that parking which is accessory to a building must be within the same
zoning district. and a short form petition had been submitted not requiring signatures.
Ms. Kaufer said H.U.D. has not approved the loan for Shepard Park as of that morning.
Mr. Nolan responded to the opposition by saying that anyone knowing the situation, given
the shape of the triangular piece and the existing requirements of RM-3, and given the
size which approaches 3/4 of an acre, would know it is impossible to put a building
on that triangular piece of land without getting all kinds of variances from the city.
He claimed it was not the intention of Shepard Park to put a building on this site and
if it were, it is not possible. He said the reason they are asking for RM-3 is so at least
the land area can be counted in with other land for �ensity purposes to meet the zoning
code. He said other remarks by the oppasition were gross misunderstandings and not a
part of the rezoning process.

Ms. McGinley asked Mr. Amey to respond to the possibility of developing that triangular
piece of land under RM-3.
Mr. Amey said in RM-3 a building must be 50 feet from the front and rear of both sides.
He asked for the dimensions of the land and then said a hi-rise would require a 50 foot
side yard. He said the dimension here is 100 feet, so some of it may be used, but with
the building located where it is, it could not be used except for lesser uses such as
RM-2, RM-1 , or a townhouse.
Mr. Bryan remarked that it was surprising to him that it was not zoned RM-3 to begin with.
Ms. McGinley then moved to support the staff recommendation to rezone to RM-3. Her motion
was seconded by Ms. Grittner and passed on a 5 to 0 roll call vote.

A. SUFFICIENCY:
The applicant's request was filed on a short form rezoning petition subscribed and
sworn to before a notary public on 23 September 1977, and received by the Planning
Division on 26 September 1977.
B. PROPOSAL:
The proposal is to rezone fran R-4 to RM-3 to allow green space and parking for an
elderly hi-rise proposed for a site south of Benson.
C. FRONTAGE AND AREA:
This irregularly shaped parcel has 140' frontage on Alton and 330' frontage on
Benson for a total area of 32,200 sq. feet or approximately .74 acres.
D. SITE CONDITIONS:
The site is vacant and overgrown. The C.M.St.P 8� Pac.RR Co. tracks form the
eastern boundary of the site.
E. AREA CONDITIONS:
The site is one half block south of the comnercial West Seventh Street. Mixed
residential and office uses are across Alton to the west. To the east and south
of the si�te there is vacant land and single family residential use.
F. FINDINGS:
1 . The site is vacant and overgrown.
2. The purpose of the proposed rezoning is to allow for green space and parking
for the elderly hi-rise proposed for a site south of Benson.
3. The applicant proposes an elderly hi-rise on Block 7 to the south across Benson.

4. The applicant has petitioned for the vacation of Benson in
order to form a contiguous parcel between lots in Block 2
and lots in Block 7.
5. In addition to allowing parking for a structure in an RM-3

would not appear to be detrimental to the neighborhood.
G. STAFF RECOMMENDATION: Based on Findings #2 and #5 above, staff
recorrmends approval of the petitioner's request.

With regard to the recent rezoning application made by
Shepard Park for parts of Lots 17-24, Block 2, C.W.
Youngman Addition, please accept this letter as an
amendment thereto.
Instead of rezoning this property to B-3, we respectfully
request to rezone this property to RM-3. The reason for
this change is that we have concurrently requested a vaca-
tion of part of Benson Avenue lying south of this property
so as to develop the property lying south of Benson to-
gether with this triangular shaped piece of property in
block 2. The requested rezoning will allow us to develop
these two parcels in a cohesive manner for a 168 unit
elderly building that has been planned for several years.
This additional land area together with vacation of part
of Benson street and part of Block 7, Palisade Addition
will allow us to fulfill City requirements for land density
and parking.

Dear Mr. Olson:
With regard to the recent rezoning application made by
Shepard Park for parts of Lots 17-24 , Block 2, C.W.
Youngman Addition, please accept this letter as an
amendment thereto.
Instead of rezoning this property to B-3, we respectfully
request to rezone this property to RM-3. The reason for
this change is that we have concurrently requested a vaca-
tion of part of Benson Avenue lying south of this property
so as to develop the property lying south of Benson to-
gether with this triangular shaped piece of property in
block 2. The requested rezoning will allow us to develop
these two parcels in a cohesive manner for a 168 unit
elderly building that has been planned for several years.
This additional land area together with vacation of part
of Benson street and part of Block 7, Palisade Addition
will allow us to fulfill City requirements for land density
and parking.
