PROCEEDINGS :
�Ir. �fark stated that he tivas appealing the order to vent kitchen sinks
because the seals were not broken and there was na siphonin,g. The
bid received for this work was $1 ,648 to tear out a wall and install a
vent.
I�is . Bijjani related that the Housing Code office had recently altered
their policy in regard to venting violations, whereby vents would n ot
be required if there was no siphoning, unless new fixtures were installed
in some future time . This was not yet official policy, however.
Mr. Mark then presented a diagram of the two first floar b athrooms , cited
by the inspector as violations of code because each lacked a hand sink.
He pointed out the lack of space , saying that the inspector had agreed
there was no room for sinks .
Mr. Powell said he and his partner had been ordered to completely rewire
their building. He explained that all extension cord wirin g, surface
wiring, and various other types of hazardous wiring mentioned in the
inspection report had been or would be eliminated. The owners had a
bid for $3, 795 to completely rewire, but they could nat ob tain fin ancing.
Mr. Powell said that non-owner-occupied funds were just not available
except in certain cases for low-income persons , for which he and his
partner were not eligible . They already had first an d second mortgages
on the property and were near their limit on home improvement loans .
Ms . Bijjani cited the insufficient number of outlets . She said the
Code Enforcement Division had worked out a compramise palicy between
the earliest electric codes and present-day codes as applie d to existing
property. Under this policy, it was determined that this particular
building fell short on the number of electric outlets by eight, plus
one needed in the basement . However, adding this number of outlets
would overload the 30-amp service presently in use .
Mr: -Tieso�: noted :that the bid for rewiring specified 100-amp service to
each apartment, which he felt was more than was necessary. He suggested
that the owners consult with the city electrieal inspector, who could
advise them on ways to correct the insufficiencies a-t the Iowest gossible
cost commensurate with safety of the ten ants , on a temporary b asis until
such time as they were able to meet the expense of c�mplete rewiring.
After discussion of the Code Enforcement Division's unoffieial alteratian
of policy in regard to venting of plumbing fixtures, Chairman Wozniak
said it was his opinion that, until the policy is officially approved,
the granting of a waiver of venting on existing pluinbing should be
outright, without specifying that a vent be instal�e d when a fixture is
replaced.
BOARD ACTION: Mr. Glassman moved to grant waivers on the kitchen sink
venting an the bathroom sink installations . As far the electrical
wiring deficiencies , appellants were directed to meet with the electrical
inspector to work out a modified temporary solution for the safety of the
tenants , with the intention of installing electric service to comply with
code requirements before March, 1981, when the next inspection for Certi-
ficate of Occupancy would take place . Chairman Wozniak seconded. NIOTION

Alice Bijjani asked to report on results of negotiations between the

SUBJECT:
Request waiver of payment of fees due under Vacant Building Registration
Ordinance, because HR.A loan to finance project had been delayed and
payment of fees would be a financial hardship.
APPEARANCE: James � Emma Hilliard
PROCEEDINGS:
Mrs . Hilliard said they had bought the vacant fourplex in 1976 on con-
tract for deed. They also owned 719 Marshall, next-door, a fourplex
they had rehabilitated and which was now occupied. They had applied
for an HRA' loan under Section 312 to rehab 725 Marshall, but HRA had
been cut back to $151,000 from the $1. 2 million requested and were
unable to provide funding at this time. However, HRA hoped to receive
a sufficierit allocation in the fall of 1978 to cover the loan they had
approved for the Hilliards .
Chairman Wozniak questioned whether the Board could consider this a case
of financial hardship because the appellants already owned income
property at 719 Marshall. :
Mrs . Hilliard explained that the income from 719 Marshall did not cover
their expenses , because while that building was being renovated, there
had been a fire, with considerable damage , and the building had not been
insured. This added greatly to their costs, as much of the tiaork had ta
be redone.

Chairman Wozniak asked if there was insurance on 725 Marshall.
l�irs . Hilliard replied. that they had been unable to get it insured, although
they had applied to the risk pool , which is supposed to grovide coverage
for high risk properties , but they had not heard anything furt�.er.
Chairman jVozniak advised Mrs . Hilliard to call Mr. Provost at the State
Insurance Department to report her experience and to get complete informa-
tion on how to go about getting the insurance she needed. He said no
one could be refused, that the risk pool method was established to cover
the very situation being discussed.
Mr. Voigt asked to be excused at this time because of another cammitment .
Alice Bijjani said she had seen the work done by the Hilli�rds at 719
Marshall an d was favorably impressed. One problem at 725 Marshall was
a garage structure which should be torn down, according to the inspectian
report.
Mr. Hilliard said he planned to tear it down the following weekend.
Mrs . Peake stated that there was a new government-funded program coming
in, called the Neighborhood Strategy Act. Gary Stout, of HRA, had talked
to her neighborhood group recently and had said it would apply to housing
of four or more units . Processing of applications was scheduled to start
about the end of May, 1978, and it would be a program specifically for
non-owner-occupied buildings .
Chairman Wozniak asked if the Hilliards had yet paid any vacant building
fees .
Ms . Bijjani replied that �they had not, according to her records , that
billing had been started in March of 1978, so at present only one quarter' s
fees were due .
BOARD ACTION:
Mrs. Peake moved to grant a waiver of the fees due under the Vacant
Building Registration Ordinance for the six-month period beginning
March, 1978, expiring August 31, 1978. Mr. Coleman seconded. MOTI�N
CARRIED AND SO ORDERED.
